It is always present when the act results in a serious, long-lasting, or even permanent impairment of health. Typically, these are injuries that endanger life, leave permanent damage, or exclude the ability to work for several weeks. The law thus aims not only to protect physical integrity but also to safeguard a person&#8217;s long-term health, performance, and personal quality of life. It concerns who, what, with what, what result \u2013 and whether the act causes the severe outcome and is attributable to it. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungsschritte\">Steps of legal assessment<\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Object of the offense:<\/strong> any other living person.<\/li>\n\n\n\n<li><strong>Actus reus:<\/strong> physical impact (hitting, pushing, kicking, strangling, using dangerous tools) or unlawful omission (in case of a guarantor position).<\/li>\n\n\n\n<li><strong>Result of the offense:<\/strong> Occurrence of a severe injury consequence. Required is a health impairment or incapacity to work lasting longer than twenty-four days, an inherently severe injury (e.g., bone fracture, loss of a sensory organ), or a danger to life. The perpetrator must seriously consider the possibility of grave or permanent damage and accept it. <\/li>\n\n\n\n<li>Negligent causation of a severe consequence falls under \u00a7 88 para. 4 StGB. <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Intent is regularly proven through circumstantial evidence: intensity of the attack, body region, means of offense, continuation despite recognizable danger, behavior before and after the act.<br\/>If a plausible explanation is missing as to why the perpetrator could not foresee the severe consequence, conditional intent is usually affirmed.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-rechtswidrigkeit-amp-rechtfertigungen\">Unlawfulness and justifications<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/self-defense\/\" target=\"_blank\" rel=\"noreferrer noopener\">Self-defence:<\/a> <\/strong>an imminent and unlawful attack; the defence must be n<strong>ecessary a<\/strong>nd <strong>proportionate<\/strong>. Decisive factors are voluntariness, stage (completed\/uncompleted attempt), and the suitability of countermeasures. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Diversion:<\/strong> Termination of proceedings <strong>without conviction<\/strong> in cases of non-severe guilt, clarified facts, and suitable measures (monetary payment, community service, probation\/parole, victim-offender mediation). <strong>No criminal record entry.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafzumessung-amp-folgen\">Sentencing and consequences<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/general-principles-of-sentencing\/\" target=\"_blank\" rel=\"noreferrer noopener\">Guiding Principle<\/a>:<\/strong> Severity of guilt, extent of damage\/endangerment, breaches of duty, degree of planning, recklessness, special\/general prevention. <strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/special-aggravating-circumstances-in-sentencing\/\" target=\"_blank\" rel=\"noreferrer noopener\">Aggravating factors<\/a>:<\/strong> Multiple offenses, relevant prior convictions, particular recklessness, offense committed in front of children, among others. <strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/special-mitigating-circumstances-in-sentencing\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mitigating factors<\/a>:<\/strong> Blamelessness, confession, compensation for damages, co-responsibility of the victim, long duration of proceedings, stable lifestyle.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-geldstrafe-tagessatzsystem\">Monetary Penalty \u2013 Day-fine System<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Range:<\/strong> up to <strong>720 daily rates<\/strong> (Number of daily rates = culpability; Amount\/day = financial capacity; min. \u20ac4.00, max. \u20ac5,000.00).<\/li>\n\n\n\n<li><strong>Practical Formula:<\/strong> 6 months imprisonment \u2248 <strong>360 daily rates<\/strong> (Guideline, not a fixed scheme).<\/li>\n\n\n\n<li><strong>Uncollectibility:<\/strong> Substitute custodial sentence (generally applies: 1 day substitute custodial sentence = 2 daily rates).<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-freiheitsstrafe-amp-teil-bedingte-nachsicht\">Imprisonment and (partially) suspended sentence<\/h2>\n\n<p class=\"wp-block-paragraph\">Section 37 StGB: If the <strong>statutory penalty provides for imprisonment of up to five year<\/strong>s, the court should impose a<strong> fine <\/strong><strong>instead of a short prison sentence of no more than one year.<\/strong> This provision is particularly relevant for the <strong>basic case of Section 83 of the Criminal Code<\/strong>, as it regularly avoids a custodial sentence, provided that neither special nor general preventive reasons preclude it.<\/p>\n\n<p class=\"wp-block-paragraph\">Section 43 StGB: A <strong>suspended prison sentence<\/strong> may be imposed if the sentence <strong>does not exceed two years <\/strong>and the convicted person is deemed to have a <strong>favourable social prognosis<\/strong>. The <strong>probation period<\/strong> ranges from <strong>one to three years.<\/strong> If it is completed without revocation, the sentence is considered finally suspended.  <\/p>\n\n<p class=\"wp-block-paragraph\">Section 43a StGB: <strong>Partial suspension<\/strong> allows a combination of <strong>unconditional and conditional parts of a sentence.<\/strong> For <strong>prison terms of more than six months and up to two years<\/strong>, part of the sentence may be suspended or replaced by a <strong>fine of up to seven hundred and twenty day-fines <\/strong>if this appears appropriate in light of the circumstances. <\/p>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/probation-assistance-and-instructions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sections 50 to 52 StGB:<\/a> The court may also issue <strong>instructions <\/strong>and order <strong>probationary supervision<\/strong>. Typical instructions<strong> concern restitution,<\/strong> <strong>therapy, <\/strong><strong>contact or residence prohibitions, and measures aimed at social stabilisation.<\/strong> The objective is to prevent further offences and to promote lasting compliance with the law.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-zustandigkeit-der-gerichte\">Jurisdiction of the courts<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Substantive jurisdiction:<\/strong> In basic cases (<a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=84&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 84 para. 1 StGB <\/a>) the Regional Court has jurisdiction, as the penalty framework exceeds two years.<br\/><strong>Territorial jurisdiction:<\/strong> Court of the place of offense or place of outcome; in case of an unclear place of offense, alternatively domicile, place of residence, or place of apprehension.<br\/><strong>Instances:<\/strong> Appeal to the Higher Regional Court, nullity appeal to the Supreme Court.<\/p>\n\n<h2 class=\"wp-block-heading\">Civil claims in criminal proceedings<\/h2>\n\n<p class=\"wp-block-paragraph\">The victim can join (pain and suffering, medical treatment, loss of earnings, property damage). The joinder <g id=\"gid_0\">interrupts<\/g> the civil law statute of limitations like a lawsuit \u2013 but only against the accused and only to the extent requested.
