It protects individuals from unlimited criminal prosecution and forces the judiciary to conduct proceedings expeditiously.<br\/>At the same time, it ensures that particularly serious offenses, such as murder or sexual offenses against minors, never become statute-barred. <\/p>\n\n<p class=\"wp-block-paragraph\">The Criminal Code distinguishes between two types of statute of limitations:<\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>Statute of limitations for criminal liability<\/strong> \u2013 concerns the period within which an offense may be prosecuted.<\/li>\n\n\n\n<li><strong>Statute of limitations for enforceability<\/strong> \u2013 concerns the period within which a penalty that has already been imposed may be enforced.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\" id=\"h-verjahrung-der-strafbarkeit\">Statute of Limitations for Criminal Liability<\/h2>\n\n<p class=\"wp-block-paragraph\">The criminal liability for an offense expires after certain periods. However, particularly serious offenses do not become statute-barred.<br\/>According to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=57&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 57 StGB<\/a>, the period begins as soon as the punishable act is completed or the punishable conduct ceases. <\/p>\n\n<p class=\"wp-block-paragraph\">The period is:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>20 years if the offense is punishable by imprisonment for more than ten years,<\/li>\n\n\n\n<li>10 years if the offense is punishable by imprisonment for more than five years but not more than ten years,<\/li>\n\n\n\n<li>5 years if the offense is punishable by imprisonment for more than one year but not more than five years,<\/li>\n\n\n\n<li>3 years if the offense is punishable by imprisonment for more than six months but not more than one year,<\/li>\n\n\n\n<li>1 year if the offense is punishable by imprisonment for a maximum of six months or only by a fine.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Upon the statute of limitations taking effect, forfeiture and preventive measures may no longer be ordered.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verlangerung-und-hemmung-der-verjahrung\">Extension and Suspension of the Statute of Limitations<\/h2>\n\n<p class=\"wp-block-paragraph\">According to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=58&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 58 StGB<\/a>, the limitation period may be extended or suspended in certain cases. According to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=59&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 59 StGB<\/a>, the enforceability of particularly severe penalties does not become statute-barred.<br\/>This concerns: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>life imprisonment,<\/li>\n\n\n\n<li>imprisonment for more than ten years,<\/li>\n\n\n\n<li>penalties for offenses under the twenty-fifth section of the Criminal Code,<\/li>\n\n\n\n<li>placement in a forensic-therapeutic center or in an institution for dangerous recidivists.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The following deadlines apply to all other penalties from the date the judgment becomes final:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>15 years for imprisonment of more than one year,<\/li>\n\n\n\n<li>10 years for imprisonment of up to one year or for a fine with a substitute prison sentence of more than three months,<\/li>\n\n\n\n<li>5 years in all other cases.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Forfeiture, the skimming of enrichment, and preventive measures also become statute-barred according to the same principles.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verlangerung-der-vollstreckungsverjahrung\">Extension of the Statute of Limitations for Enforcement<\/h2>\n\n<p class=\"wp-block-paragraph\">The period for the statute of limitations for enforcement may be extended or suspended in accordance with <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=60&amp;Anlage=&amp;Uebergangsrecht=\">\u00a7 60 StGB<\/a> if certain circumstances occur.<br\/>This is the case if:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>a new criminal offense is committed and legally punished during the period,<\/li>\n\n\n\n<li>the convicted person is in a current probationary period,<\/li>\n\n\n\n<li>a deferral of punishment has been granted,<\/li>\n\n\n\n<li>the convicted person is in custody or abroad.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If the penalty is enforced, this interrupts the statute of limitations.
