If it becomes clear that the dangerousness persists or the person concerned does not comply with the conditions, the court can revoke the release and reinstate the measure. <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p>A revocation under<a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=54&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\"> \u00a7 54 StGB<\/a> occurs when the court annuls a conditional release from a preventive measure because the person&#8217;s dangerousness persists.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-45819ab6\"><picture>\n\t\t<source srcset=\"https:\/\/harlander-partner.eu\/wp-content\/uploads\/Widerruf-bei-vorbeugenden-Massnahmen-352x198.webp\" >\n\t\t<img decoding=\"async\" class=\"mr-picture-small\" src=\"https:\/\/harlander-partner.eu\/wp-content\/uploads\/Widerruf-bei-vorbeugenden-Massnahmen.webp\" alt=\"Revocation of conditional release: Requirements, procedure, and judicial alternatives under \u00a7 54 StGB clearly explained.\" >\n\t<\/picture>\n<\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-voraussetzungen-fur-den-widerruf\">Requirements for Revocation<\/h2>\n\n<p>Revocation is carried out according to the same principles as in \u00a7 53 StGB. The decisive factor is whether the dangerousness, which the preventive measure addresses, still persists and whether the revocation is necessary to prevent further offenses. <\/p>\n\n<p>According to \u00a7 53 StGB, two fundamental scenarios are considered. Firstly, a new criminal offense committed within the probationary period that leads to a conviction. Secondly, a significant failure to comply with instructions, such as willful non-compliance with formally issued instructions or persistent evasion of probation supervision. In both cases, the court examines whether revocation is truly warranted. There is no automatic process. Before a revocation, the court must consider less severe measures, particularly the extension of the probationary period, the issuance of additional instructions, and the ordering or continuation of probation supervision.     <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-typische-widerrufsgrunde-sind\">Typical Grounds for Revocation Include<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>Relapses into addiction or violence,<\/li>\n\n\n\n<li>the refusal of therapeutic instructions,<\/li>\n\n\n\n<li>the discontinuation of treatment or aftercare,<\/li>\n\n\n\n<li>new criminal offenses that indicate a persistent danger.<\/li>\n<\/ul>\n\n<p>The court always examines whether a stable lifestyle outside the institution is realistic or whether a return to the measure appears necessary to prevent further offenses.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-gerichtliche-entscheidung-und-alternativen\">Judicial Decision and Alternatives<\/h2>\n\n<p>A revocation may only be ordered if milder measures are insufficient. Alternatives include: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Extension of the probationary period,<\/li>\n\n\n\n<li>new therapy or reporting instructions,<\/li>\n\n\n\n<li>closer supervision by probation services,<\/li>\n\n\n\n<li>continuation of outpatient treatment under medical supervision.<\/li>\n<\/ul>\n\n<p>The court is obliged to always choose the <strong>least restrictive appropriate means<\/strong>. Er dient der Sicherung der Rechtsordnung und dem Schutz der Allgemeinheit, nicht der Bestrafung.\u201c<\/span>\n    <\/div>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Free initial consultation\"><span class=\"mr-cta-link-normal\">Select your preferred appointment now:<\/span><span class=\"mr-cta-link-bold\">Free initial consultation<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-verlangerung-der-probezeit\">Extension of the Probationary Period<\/h2>\n\n<p>If the release from an institution under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=21&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 21 StGB<\/a> is not revoked, the court can extend the probationary period <strong>up to a maximum of fifteen years<\/strong>.<br\/>If the originally determined probationary period is <strong>five years<\/strong>, it may be extended <strong>to a maximum of ten years<\/strong>.<\/p>\n\n<p>Towards the end of the original or extended probationary period, the court can order a <strong>further extension by up to three years<\/strong> if special reasons indicate that the threat of placement is still necessary to avert dangerousness.<br\/>Repeated extension is expressly permitted.<\/p>\n\n<p>At the same time, the court examines whether new instructions are to be issued and whether probation supervision is required.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-medizinische-behandlung-und-unterbringung\">Medical Treatment and Placement<\/h2>\n\n<p>If, as part of the conditional release, the instruction was given to undergo medical treatment, and there is a justified suspicion that the person concerned is not complying with this instruction, the court can order inpatient treatment.<br\/>In such cases, the security authority must be notified, which must proceed according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002936&amp;Artikel=&amp;Paragraf=9&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 9 of the Placement Act (UbG)<\/a>. The court will be informed about the measures initiated and will decide whether the release is maintained or is to be revoked. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-neue-massnahme-wahrend-der-probezeit\">New Measure During the Probationary Period<\/h2>\n\n<p>If the person concerned commits a new criminal offense during the probationary period and a preventive measure under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=21&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7\u00a7 21<\/a> to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=23&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">23 StGB<\/a> is subsequently ordered again, the previous order becomes <strong>obsolete<\/strong>.<br\/>This is to ensure that only one current measure applies and no double regulation arises.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ausnahme-aussichtslosigkeit-der-behandlung\">Exception: Futility of Treatment<\/h2>\n\n<p>A revocation is <strong>not permissible<\/strong> if the continuation of treatment appears <strong>futile<\/strong> from the outset. In such cases, a return to the institution would have no therapeutic or security-relevant benefit.
