Similarly liable is anyone who physically abuses another person and thereby negligently injures them or harms their health. The basic penalty framework is imprisonment for up to one year or a fine of up to 720 daily rates. It concerns <em>who, what, with what, what result<\/em> \u2013 and whether the action <strong>caused<\/strong> the outcome and is <strong>attributable<\/strong> to it. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungsschritte\">Steps of legal assessment<\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Object of the offense:<\/strong> any other living person.<\/li>\n\n\n\n<li><strong>Actus reus:<\/strong> physical impact (hitting, pushing, pressing, throwing) or unlawful omission (in case of guarantor status).<\/li>\n\n\n\n<li><strong>Result of the offense:<\/strong> violation of physical integrity or <em>harm to health<\/em> (including functional disorders; findings are decisive).<\/li>\n\n\n\n<li><strong>Causality:<\/strong> conditio sine qua non; in case of omission: hypothetical prevention of success with high probability.<\/li>\n\n\n\n<li><strong>Objective attribution:<\/strong> realization of the legally disapproved risk created in the outcome (protective purpose context; no completely atypical third-party course).<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-qualifizierende-umstande\">Qualifying Circumstances<\/h3>\n\n<p class=\"wp-block-paragraph\">Increased penalty for acts committed <strong>during<\/strong> or <strong>due to<\/strong> activity against: control\/driving personnel of public transport; <strong>healthcare professions<\/strong>; <strong>rescue organizations<\/strong>; <strong>administration<\/strong> in the healthcare sector (especially hospitals); <strong>fire departments<\/strong>. A situation of self-defense excludes unlawfulness if the defense was necessary and proportionate. The accused is not required to prove anything; concrete indications are sufficient to raise doubt (in dubio pro reo \u2013 when in doubt, for the accused). <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-schuld-amp-irrtumer\">Culpability and mistakes<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Principle of culpability: <\/strong>only those who act with fault are punishable.<\/li>\n\n\n\n<li><strong>Lack of criminal responsibility: <\/strong>no culpability in cases of severe mental disorder, etc.; a forensic psychiatric assessment is required as soon as there are indications of such a condition.<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/exculpatory-necessity\/\">Excusing necessity:<\/a><\/strong> unreasonableness of lawful conduct in an extreme situation of coercion.<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/erroneous-assumption-of-justifying-circumstances\/\">Putative self-defence:<\/a><\/strong> a mistaken belief in a justification negates intent; negligence remains if provided for by law.<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/legal-error\/\">Mistake of law:<\/a><\/strong> excuses only if unavoidable (duty to inform oneself about the law).<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafaufhebung-amp-diversion\">Extinction of punishment and diversion<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/withdrawal-from-attempt\/\" target=\"_blank\" rel=\"noreferrer noopener\">Withdrawal from attempt:<\/a><\/strong> Timely voluntary abandonment or prevention of the outcome leads to no punishment for the attempt. Decisive factors are voluntariness, stage (completed\/uncompleted attempt), and the suitability of countermeasures. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Diversion:<\/strong> termination of proceedings <strong>without conviction<\/strong> in cases of minor guilt, clarified facts, and suitable measures (monetary payment, community service, probation\/probationary assistance, victim-offender mediation). <strong>No criminal record entry.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafzumessung-amp-folgen\">Sentencing and consequences<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/general-principles-of-sentencing\/\" target=\"_blank\" rel=\"noreferrer noopener\">Guiding principle<\/a>:<\/strong> Severity of guilt, extent of harm\/endangerment, breaches of duty, degree of planning, recklessness, special\/general prevention. <strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/special-aggravating-circumstances-in-sentencing\/\" target=\"_blank\" rel=\"noreferrer noopener\">Aggravating factors<\/a>:<\/strong> multiple offenses, relevant prior convictions, particular recklessness, offense committed in front of children, among others <strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/special-mitigating-circumstances-in-sentencing\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mitigating factors<\/a>:<\/strong> blamelessness, confession, compensation for damages, victim&#8217;s co-responsibility, long duration of proceedings, stable lifestyle.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-geldstrafe-tagessatzsystem\">Monetary Penalty \u2013 Day-fine System<\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Range:<\/strong> up to <strong>720 daily rates<\/strong> (Number of daily rates = culpability; Amount\/day = financial capacity; min. \u20ac4.00, max. \u20ac5,000.00).<\/li>\n\n\n\n<li><strong>Practical Formula:<\/strong> 6 months imprisonment \u2248 <strong>360 daily rates<\/strong> (Guideline, not a fixed scheme).<\/li>\n\n\n\n<li><strong>Uncollectibility:<\/strong> Substitute custodial sentence (generally applies: 1 day substitute custodial sentence = 2 daily rates).<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-freiheitsstrafe-amp-teil-bedingte-nachsicht\">Imprisonment and (partially) suspended sentence<\/h3>\n\n<p class=\"wp-block-paragraph\">Section 37 StGB: If the <strong>statutory penalty provides for imprisonment of up to five year<\/strong>s, the court should impose a<strong> fine <\/strong><strong>instead of a short prison sentence of no more than one year.<\/strong> This provision is particularly relevant for the <strong>basic case of Section 83 of the Criminal Code<\/strong>, as it regularly avoids a custodial sentence, provided that neither special nor general preventive reasons preclude it.<\/p>\n\n<p class=\"wp-block-paragraph\">Section 43 StGB: A <strong>suspended prison sentence<\/strong> may be imposed if the sentence <strong>does not exceed two years <\/strong>and the convicted person is deemed to have a <strong>favourable social prognosis<\/strong>. The <strong>probation period<\/strong> ranges from <strong>one to three years.<\/strong> If it is completed without revocation, the sentence is considered finally suspended.  <\/p>\n\n<p class=\"wp-block-paragraph\">Section 43a StGB: <strong>Partial suspension<\/strong> allows a combination of <strong>unconditional and conditional parts of a sentence.<\/strong> For <strong>prison terms of more than six months and up to two years<\/strong>, part of the sentence may be suspended or replaced by a <strong>fine of up to seven hundred and twenty day-fines <\/strong>if this appears appropriate in light of the circumstances. <\/p>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/probation-assistance-and-instructions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sections 50 to 52 StGB:<\/a> The court may also issue <strong>instructions <\/strong>and order <strong>probationary supervision<\/strong>. Typical instructions<strong> concern restitution,<\/strong> <strong>therapy, <\/strong><strong>contact or residence prohibitions, and measures aimed at social stabilisation.<\/strong> The objective is to prevent further offences and to promote lasting compliance with the law.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-zustandigkeit-der-gerichte\">Jurisdiction of the courts<\/h2>\n\n<p class=\"wp-block-paragraph\">Subject-matter: For proceedings under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=83&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 83 Para 1 and 2 StGB<\/a>, the <strong>District Court<\/strong> has jurisdiction and decides through a <strong>single judge<\/strong>. If a qualified case under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=83&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 83 Para 3 StGB<\/a> exists, jurisdiction falls to the <strong>Regional Court<\/strong>, also with a <strong>single judge<\/strong>. A lay judge or jury court is excluded, as the penalty framework does not exceed two years.  <\/p>\n\n<p class=\"wp-block-paragraph\">Territorial: Primarily, the court of the <strong>place of offense<\/strong> has jurisdiction; for outcome offenses, additionally that of the <strong>place of outcome<\/strong>. If the place of offense cannot be clearly determined, recourse can alternatively be made to the <strong>residence or stay of the accused<\/strong>, the <strong>place of apprehension<\/strong>, or the <strong>seat of the public prosecutor&#8217;s office<\/strong>.
