The <strong>purpose<\/strong> of this provision is to place affected parties in the financial position they would have been in without the competition infringement. Unlike the injunction claim, which aims to prevent future legal violations, the claim for damages serves to <strong>compensate for disadvantages already incurred<\/strong>. A prerequisite is that the competition infringement has led to specific damage and that the <strong>general civil liability requirements<\/strong> are met. These include, in particular, <strong>unlawfulness, damage, causality, adequacy, scope of protection<\/strong>, and fault. The claim is thus directly linked to the general rules on damages in <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/jgs\/1811\/946\/P1293\/NOR12019035\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/jgs\/1811\/946\/P1293\/NOR12019035\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7\u00a7 1293 et seq. ABGB<\/a>.    <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">The <strong>claim for damages under \u00a7<\/strong> <strong>16<\/strong> <strong>UWG<\/strong> enables consumers and businesses to demand compensation for financial disadvantages arising from a competition infringement. Liability rather requires that both the <strong>competition law<\/strong> and the <strong>general civil law prerequisites<\/strong> of Austrian damages law are met. <\/p>\n\n<p class=\"wp-block-paragraph\">The basis for this is <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/jgs\/1811\/946\/P1293\/NOR12019035\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/jgs\/1811\/946\/P1293\/NOR12019035\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7\u00a7 1293 et seq. ABGB<\/a>. According to these provisions, there must be, in particular, <strong>unlawful conduct<\/strong>, <strong>specific damage<\/strong>, a <strong>causal link between the conduct and the damage<\/strong>, and <strong>fault on the part of the tortfeasor<\/strong>. Additionally, the damage incurred must belong to the type of disadvantages that the violated legal norm is intended to protect against.  <\/p>\n\n<p class=\"wp-block-paragraph\">Only when these prerequisites are met can a claim for damages be successfully enforced. The burden of proof for this generally lies with the party asserting the claim for damages. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-vorliegen-eines-wettbewerbsverstosses\">Existence of a Competition Infringement<\/h3>\n\n<p class=\"wp-block-paragraph\">The most important prerequisite for a claim for damages is a <strong>violation of competition law<\/strong>. The conduct of the defendant must violate a provision of the UWG and therefore be classifiable as unfair. Which violations can trigger a claim for damages depends on whether <strong>consumers<\/strong> or <strong>businesses<\/strong> are affected.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-wettbewerbsverstosse-gegenuber-verbrauchern\">Competition Infringements against Consumers<\/h4>\n\n<p class=\"wp-block-paragraph\">Consumers can, according to <strong>\u00a7 16 para. 1 UWG <\/strong> demand damages if a business uses one of the following unfair business practices:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Aggressive or misleading business practices<\/strong> according to <a href=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/ANL1\/NOR40245462\" type=\"link\" id=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/ANL1\/NOR40245462\" target=\"_blank\" rel=\"noreferrer noopener\">points 1 to 31 of the Annex to the UWG<\/a><\/li>\n\n\n\n<li><strong>Other unfair business practices<\/strong> according to <a href=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P1\/NOR40245447\" type=\"link\" id=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P1\/NOR40245447\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>1<\/strong> <strong>para.<\/strong> <strong>1<\/strong> <strong>point<\/strong> <strong>2<\/strong> <strong>UWG<\/strong><\/a><\/li>\n\n\n\n<li>Violations of <a href=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P1a\/NOR40187729\" type=\"link\" id=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P1a\/NOR40187729\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>1a<\/strong> <strong>para.<\/strong> <strong>1<\/strong> <strong>to<\/strong> <strong>3<\/strong> <strong>UWG<\/strong><\/a><\/li>\n\n\n\n<li>Violations of<a href=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P2\/NOR40245448\" type=\"link\" id=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P2\/NOR40245448\" target=\"_blank\" rel=\"noreferrer noopener\"> <strong>\u00a7<\/strong> <strong>2<\/strong> <strong>UWG<\/strong><\/a><\/li>\n\n\n\n<li>Violations of <a href=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P2a\/NOR40245449\" type=\"link\" id=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P2a\/NOR40245449\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>2a<\/strong> <strong>UWG<\/strong><\/a><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Additionally, the unfair business practice must have actually influenced the consumer&#8217;s <strong>freedom of decision<\/strong>. The consumer must have made a <strong>business decision<\/strong> based on the action that they would <strong>not have made<\/strong> with accurate information or without undue influence. This includes, in particular, purchasing decisions, contract conclusions, or the use of a service. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-wettbewerbsverstosse-gegenuber-unternehmern\">Competition Infringements against Businesses<\/h4>\n\n<p class=\"wp-block-paragraph\">Businesses can, according to <strong>\u00a7<\/strong> <strong>16<\/strong> <strong>para.<\/strong> <strong>2<\/strong> <strong>UWG<\/strong>, demand damages if they are harmed by a violation of one of the following provisions:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Unfair business practice according to <\/strong><a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P1\/NOR40245447\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P1\/NOR40245447\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>1<\/strong> <strong>para.<\/strong> <strong>1<\/strong> <strong>point<\/strong> <strong>1<\/strong> <strong>UWG<\/strong><\/a><\/li>\n\n\n\n<li>Disparagement of a business <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P7\/NOR40245450\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P7\/NOR40245450\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>7<\/strong> <strong>UWG<\/strong><\/a><\/li>\n\n\n\n<li>Misuse of trademarks <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P9\/NOR40245451\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P9\/NOR40245451\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>9<\/strong> <strong>UWG<\/strong><\/a><\/li>\n\n\n\n<li>Bribery of employees or agents according to <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P10\/NOR12033583\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P10\/NOR12033583\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>10<\/strong> <strong>UWG<\/strong><\/a> in conjunction with <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P13\/NOR40245452\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P13\/NOR40245452\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>13<\/strong> <strong>UWG<\/strong><\/a><\/li>\n\n\n\n<li>Use of unauthorized means in print advertising <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P21\/NOR40245457\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P21\/NOR40245457\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>21<\/strong> <strong>para.<\/strong> <strong>3<\/strong> <strong>UWG<\/strong><\/a><\/li>\n\n\n\n<li>Violation of administrative law provisions, <a href=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P34\/NOR40245459\" type=\"link\" id=\"https:\/\/ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P34\/NOR40245459\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7<\/strong> <strong>34<\/strong> <strong>para.<\/strong> <strong>3<\/strong> <strong>UWG<\/strong><\/a><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Unlike with consumers, the law does not focus on whether a business decision was influenced. The decisive factor is that the business suffered <strong>compensable damage<\/strong> due to the competition infringement. Under the <strong>statutory conditions<\/strong>, in addition to actual damage, <strong>lost profits<\/strong> can also be claimed.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-eintritt-eines-konkreten-schadens\">Incurrence of Specific Damage<\/h3>\n\n<p class=\"wp-block-paragraph\">A claim for damages under \u00a7 16 UWG requires that the affected party has actually incurred <strong>specific damage<\/strong>. A mere competition infringement alone is not sufficient. Anyone claiming damages must be able to <strong>prove<\/strong> that the unfair act led to an economic disadvantage.  <\/p>\n\n<p class=\"wp-block-paragraph\">Compensable damage exists if a <strong>business<\/strong> loses customers, suffers sales losses, or incurs additional costs to remedy the consequences of the competition infringement. <strong>Consumers<\/strong> must also demonstrate that they suffered a financial disadvantage due to the unfair business practice. <\/p>\n\n<p class=\"wp-block-paragraph\">Mere assumptions or theoretical disadvantages are not sufficient. The damage must have <strong>actually<\/strong> occurred and be <strong>verifiably ascertainable<\/strong>. The more precisely the economic effects can be documented and quantified, the easier it is to enforce the claim later.  <\/p>\n\n<p class=\"wp-block-paragraph\">Specific damage therefore constitutes a <strong>central prerequisite<\/strong> for a claim for damages. Without verifiable disadvantage, there is no claim for damages, even in the case of a clear competition infringement. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-kausalitat-zwischen-verstoss-und-schaden\">Causality between Infringement and Damage<\/h3>\n\n<p class=\"wp-block-paragraph\">There must be a <strong>causal link<\/strong> between the competition infringement and the damage incurred. Lawyers refer to this as <strong>causality<\/strong>. The damage must have occurred precisely because of the unlawful conduct and must not be attributable to other causes.  <\/p>\n\n<p class=\"wp-block-paragraph\">The affected party must prove that the damage would not have occurred, or at least not in the same form, without the unfair act.<\/p>\n\n<p class=\"wp-block-paragraph\">Especially with sales losses or lost customer relationships, this proof can be difficult. Therefore, documenting the economic effects and the circumstances of the competition infringement is of particular importance. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-adaquanzzusammenhang\">Adequacy of Causation<\/h3>\n\n<p class=\"wp-block-paragraph\">In addition to causality, damages law requires a so-called <strong>adequacy of causation<\/strong>. Not every damage that is somehow related to a competition infringement must be compensated. <\/p>\n\n<p class=\"wp-block-paragraph\">Only damages that appear as a typical and foreseeable consequence of the unlawful conduct according to general life experience are compensable. The incurred disadvantage must not be based on <strong>extraordinary or atypical circumstances<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Extraordinary or atypical circumstances<\/strong> refer to events that normally do not have to be expected. The damage must be a direct consequence of the competition infringement and must not have arisen from an unusual chain of multiple circumstances. <\/p>\n\n<p class=\"wp-block-paragraph\">This requirement is intended to prevent a tortfeasor from being liable for consequences that are <strong>beyond any reasonable expectation<\/strong>. Liability is limited to those damages that, from an objective perspective, appear to be a direct consequence of the competition infringement. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-rechtswidrigkeit-und-rechtswidrigkeitszusammenhang\">Unlawfulness and scope of protection<\/h3>\n\n<p class=\"wp-block-paragraph\">For a claim for damages, the tortfeasor&#8217;s conduct must not only have caused damage but also be <strong>unlawful<\/strong>. In competition law, unlawfulness arises from a <strong>violation of a provision of the UWG<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">Furthermore, a so-called <strong>scope of protection<\/strong> must exist. This means that the damage incurred must belong to the type of disadvantages that the violated provision is intended to protect against. <\/p>\n\n<p class=\"wp-block-paragraph\">The law only protects those interests that are covered by the respective prohibition. In competition law, mere negligence is generally sufficient for a claim under \u00a7 16 UWG. In competition law, even slight negligence is usually sufficient for a claim for damages.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Intent<\/strong> exists if the tortfeasor consciously commits the competition infringement or at least knows that their conduct could be unlawful and nevertheless accepts this. The tortfeasor then acts not merely carelessly, but knowingly or at least with indifference to the possible consequences of their actions. <\/p>\n\n<p class=\"wp-block-paragraph\">Whether <strong>fault<\/strong> exists always depends on the <strong>circumstances of the individual case<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ersatzfahige-schaden-nach-16-uwg\">Compensable Damages under \u00a7 16 UWG<\/h2>\n\n<p class=\"wp-block-paragraph\">If the prerequisites for a claim for damages are met, the <strong>injured party<\/strong> can demand compensation for the damages caused by the competition infringement. The purpose of damages is to place the affected party in the financial position they would have been in without the unlawful act. <\/p>\n\n<p class=\"wp-block-paragraph\">Which damages can be compensated is determined by the <strong>general principles of damages law<\/strong>. These include <strong>positive damage<\/strong> and, under certain conditions, <strong>lost profits<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">Whether and to what extent damage is compensated always depends on the circumstances of the individual case and the available evidence.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-positiver-schaden\">Positive damage<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Positive damage<\/strong> includes all directly incurred financial disadvantages caused by the competition infringement. These include, in particular, financial losses, additional expenses, or other economic burdens that reduce the existing assets of the injured party. <\/p>\n\n<p class=\"wp-block-paragraph\">Case law interprets the concept of positive damage broadly. Economic advantages are also included even if their <strong>occurrence was already largely secured<\/strong>. The decisive factor is that the disadvantage can be specifically determined and verifiably attributed to the competition infringement.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Consumers<\/strong> can only claim <strong>actual damage<\/strong> (positive damage) under \u00a7 16 para. 1 UWG. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-entgangener-gewinn\">Lost Profit<\/h3>\n\n<p class=\"wp-block-paragraph\">In addition to <strong>positive damage<\/strong>, businesses can also claim <strong>lost profits<\/strong> under <strong>\u00a7<\/strong> <strong>16<\/strong> <strong>para.<\/strong> <strong>2<\/strong> <strong>UWG<\/strong>. The injured party must be able to credibly demonstrate that the profit expectation was not merely based on hope but would have been realistic given the circumstances of the individual case. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-haftung-fur-wettbewerbsverstosse\">Liability for Competition Infringements<\/h2>\n\n<p class=\"wp-block-paragraph\">Anyone wishing to assert a claim for damages under \u00a7 16 UWG must sue the correct person or company. The party <strong>liable for damages<\/strong> is the one who culpably caused the competition infringement. Depending on the facts, however, other persons may also be liable for the damage incurred. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-haftung-des-unmittelbaren-schadigers\">Liability of the Direct Tortfeasor<\/h3>\n\n<p class=\"wp-block-paragraph\">Primarily, the person who committed the competition infringement themselves is liable. This is regularly the <strong>business<\/strong> or the <strong>person who, through their conduct<\/strong>, <strong>caused<\/strong> the unfair business practice or other competition infringement. <\/p>\n\n<p class=\"wp-block-paragraph\">A prerequisite is that the tortfeasor acted <strong>unlawfully<\/strong> and <strong>culpably<\/strong>, and that the competition infringement was <strong>causal<\/strong> for the damage incurred. If these prerequisites are met, the injured party can demand <strong>direct compensation for the damage incurred from the responsible party<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-haftung-von-unternehmen-und-organen\">Liability of Companies and Organs<\/h3>\n\n<p class=\"wp-block-paragraph\">However, competition infringements are often committed not only by individuals but also within the framework of a company. In such cases, the <strong>company<\/strong> itself may be responsible for the conduct of its <strong>organs, employees, or other agents<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">Liability is based on the fact that <strong>companies participate in business transactions<\/strong> and use their employees and decision-makers to do so. Unlawful acts committed in the context of entrepreneurial activity are therefore attributed to the company. <\/p>\n\n<p class=\"wp-block-paragraph\">Under certain circumstances, <strong>personal liability of managing directors or board members<\/strong> may also be considered. A <strong>prerequisite<\/strong> is regularly that the person concerned has made their own contribution to the competition infringement and can be accused of at least negligence. The involvement must go <strong>beyond a merely subordinate<\/strong> or <strong>incidental<\/strong> <strong>participation<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-durchsetzung-des-schadenersatzanspruchs\">Enforcement of the Claim for Damages<\/h2>\n\n<p class=\"wp-block-paragraph\">A claim for damages does not exist automatically. The injured party must present the facts establishing the claim and, in case of dispute, also prove them. Especially in competition infringements, the evidence often determines whether a claim can be successfully enforced.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-beweislast\">Burden of Proof<\/h3>\n\n<p class=\"wp-block-paragraph\">The <strong>injured party<\/strong> bears the burden of proof for all prerequisites of the claim for damages. They must prove the <strong>competition infringement<\/strong>, the <strong>damage<\/strong> incurred, the <strong>causality<\/strong>, and the <strong>fault<\/strong> of the tortfeasor. <\/p>\n\n<p class=\"wp-block-paragraph\">In practice, the <strong>proof of damage<\/strong> and the causal link pose particular difficulties. Therefore, it is advisable to secure evidence early and to document economic disadvantages as precisely as possible. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verjahrung-des-anspruchs\">Statute of Limitations for the Claim<\/h3>\n\n<p class=\"wp-block-paragraph\">Claims for damages under \u00a7 16 UWG are subject to the general statute of limitations rules of Austrian damages law. A distinction must be made between a <strong>subjective<\/strong> and an <strong>objective limitation period<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>subjective limitation period<\/strong> is <strong>three years<\/strong>. It begins to run as soon as the injured party has knowledge of the damage and the person of the tortfeasor, or could have obtained this knowledge with reasonable care. <\/p>\n\n<p class=\"wp-block-paragraph\">Irrespective of this, an <strong>objective limitation period<\/strong> of <strong>30 years<\/strong> applies from the damaging event.
