Anyone announcing such a clearance sale due to <strong>business closure<\/strong> or <strong>relocation<\/strong> generally requires <strong>prior official authorization<\/strong>. In the case of a clearance sale due to a <strong>natural disaster<\/strong>, there is at least a <strong>notification obligation<\/strong>. A clearance sale announcement may not be prohibited solely because an authorization is missing. This very circumstance justifies selling goods <strong>quickly and often at reduced prices<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">This creates a clear picture for customers:<br\/><strong>The business is closing \u2013 the goods must be sold.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">For such an announcement to be legally permissible, several points must be met:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The <strong>closure must be seriously planned<\/strong><\/li>\n\n\n\n<li>The business must <strong>not simply be continued<\/strong><\/li>\n\n\n\n<li>The announcement must be <strong>temporally plausible<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The consequence is particularly important: Anyone who announces a clearance sale due to business closure <strong>cannot simply continue as before<\/strong>. The law even attaches <strong>far-reaching consequences for the trade license<\/strong> to this. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-standortverlegung-als-zulassiger-anlass\">Relocation of premises as a permissible reason<\/h3>\n\n<p class=\"wp-block-paragraph\">A <strong>relocation of premises<\/strong> can also justify a clearance sale. In this case, the company moves to a new location and takes the opportunity to <strong>reduce inventory before the move<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">For customers, this situation appears similar to a business closure, but with one important difference:<br\/>The company <strong>continues to exist<\/strong>, only the location changes.<\/p>\n\n<p class=\"wp-block-paragraph\">For the announcement to be permissible, there must also be a <strong>genuine background<\/strong> here. Therefore, the decisive factor remains that the announcement <strong>correctly reflects the actual operational process<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-elementarereignisse-als-besonderer-grund\">Natural disasters as a special reason<\/h3>\n\n<p class=\"wp-block-paragraph\">A clearance sale can also be permissible if a company is affected by an <strong>unforeseeable event<\/strong>. This primarily includes situations in which business operations <strong>suddenly become impaired or impossible<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">Typical examples include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>fire or water damage<\/strong><\/li>\n\n\n\n<li><strong>flooding or storm damage<\/strong><\/li>\n\n\n\n<li><strong>comparable extraordinary events<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In such cases, a plausible pressure arises: The goods must often <strong>be sold quickly<\/strong> because storage, operation, or resale is no longer possible. In this case, the entrepreneur <strong>does not need prior authorization<\/strong>, but must <strong>notify the competent authority<\/strong> of the clearance sale. <\/p>\n\n<p class=\"wp-block-paragraph\">This notification serves an important purpose. The authority should have the opportunity to <strong>quickly check<\/strong> whether the announcement is <strong>lawful and not misleading<\/strong>.
