Both <strong>state and private awards<\/strong> may be relevant. These mainly concern <strong>professional titles, corporate presentation and quality seals<\/strong>, because they have a strong influence on purchasing decisions. <\/p>\n\n<p class=\"wp-block-paragraph\">Typical problem areas are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>exaggerated or unclear advertising claims<\/strong><\/li>\n\n\n\n<li><strong>use of terms with special meaning without a basis<\/strong><\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-unzulassige-berufsbezeichnungen\">Unlawful professional titles<\/h3>\n\n<p class=\"wp-block-paragraph\">Professional titles are particularly trust-building for customers. A presentation becomes problematic if it creates the impression that a company is <strong>larger, more official or more qualified<\/strong> than it actually is. <\/p>\n\n<p class=\"wp-block-paragraph\">This often happens through deliberately chosen designations or through a design that suggests <strong>closeness to authorities or special institutions<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Typical constellations include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Company names with misleading implications<\/strong><\/li>\n\n\n\n<li><strong>Presentations that pretend state oversight or recognition<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">For the legal assessment, it always depends on the effect. What matters is the impression an average customer gains. As soon as that impression no longer corresponds to reality, an infringement is likely.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-irrefuhrende-verwendung-von-gutezeichen\">Misleading use of quality marks<\/h3>\n\n<p class=\"wp-block-paragraph\">Quality marks and seals have a particularly strong effect in commercial dealings. At first glance, they signal <strong>verified quality, reliability and trust<\/strong> to customers. That is precisely why they are subject to strict legal requirements.  <\/p>\n\n<p class=\"wp-block-paragraph\">A problem always arises when a company uses such a mark <strong>without meeting the necessary requirements<\/strong>. In such cases, customers assume that an independent body has reviewed the service, although that is not true. <\/p>\n\n<p class=\"wp-block-paragraph\">Typical violations include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Use of a seal without valid certification<\/strong><\/li>\n\n\n\n<li><strong>Use of a mark for services that were not reviewed at all<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Even minor inaccuracies can be decisive. Section 31 UWG often operates as a <strong>specific supplement<\/strong> when the issue specifically concerns titles or awards. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-bedeutung-der-schwarzen-liste-im-anhang\">Significance of the blacklist in the annex<\/h3>\n\n<p class=\"wp-block-paragraph\">In addition, the UWG contains a so-called \u201cblacklist\u201d. It lists business practices that are <strong>unlawful under all circumstances<\/strong>. This also includes the use of certain quality marks without authorisation.  <\/p>\n\n<p class=\"wp-block-paragraph\">This rule is particularly strict because it <strong>no longer requires a case-by-case assessment<\/strong>. As soon as conduct falls under it, it is automatically deemed unlawful. <\/p>\n\n<p class=\"wp-block-paragraph\">Typical cases from practice are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Use of quality or certification seals without permission<\/strong><\/li>\n\n\n\n<li><strong>Misleading references to special recognitions<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The blacklist ensures that particularly clear deceptions are <strong>prohibited immediately<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-rechtliche-folgen-bei-verstossen\">Legal consequences of infringements<\/h2>\n\n<p class=\"wp-block-paragraph\">A breach of Section 31 UWG does not remain without consequences. The law provides clear consequences to ensure that companies <strong>do not gain advantages from unlawful statements<\/strong>. Both administrative and civil-law measures play a role.  <\/p>\n\n<p class=\"wp-block-paragraph\">Even negligent conduct may be sufficient. Companies must therefore actively ensure that their statements are <strong>fully accurate and legally permissible<\/strong>. In such cases, the competent authority may <strong>impose fines<\/strong>. These can be substantial and often catch companies by surprise.  <\/p>\n\n<p class=\"wp-block-paragraph\">The sanction does not require intentional conduct. Simple negligence may suffice. This increases the risk, as many infringements in everyday business arise from <strong>unclear or imprecise advertising<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">For companies, this means:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>even minor errors may be sanctioned<\/strong><\/li>\n\n\n\n<li><strong>regular review of public presentation becomes necessary<\/strong><\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-zivilrechtliche-anspruche-und-unterlassung\">Civil-law claims and injunctive relief<\/h3>\n\n<p class=\"wp-block-paragraph\">In addition to the authorities, competitors may also take action against unlawful practices. They have the right to <strong>seek injunctive relief and removal<\/strong>. In many cases, <strong>claims for damages<\/strong> may also be considered.  <\/p>\n\n<p class=\"wp-block-paragraph\">This means that an infringement often has double consequences.
