In a <strong>pyramid scheme<\/strong>, the customer pays a fee and is supposed to gain an advantage by <strong>recruiting further individuals<\/strong> who, in turn, join under the same conditions. In a <strong>gambling-like distribution system<\/strong>, on the other hand, the delivery of goods or the provision of services depends entirely or predominantly on <strong>luck, a lottery, or other chance<\/strong>. The customer decides not because of the product, but because of the prospect of profit or repayment. The UWG expressly prohibits certain models and extends the prohibition to corresponding advertising measures; violations can also result in a <strong>fine of up to \u20ac<\/strong> <strong>2,900<\/strong>.    <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\"><strong>Pyramid schemes and gambling-like distribution systems<\/strong> are <strong>unlawful sales models<\/strong> in which customers are induced to conclude a contract by <strong>recruiting new participants<\/strong> or by <strong>elements of chance<\/strong>, instead of through a normal, transparent service offering. However, this product often plays <strong>only a subordinate role<\/strong>. What is crucial is the promise to <strong>earn money through referrals<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">The typical process is as follows:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>A participant joins and pays an amount<\/li>\n\n\n\n<li>They receive the opportunity or obligation to <strong>recruit new participants<\/strong><\/li>\n\n\n\n<li>For each new participant, they receive <strong>remuneration or repayment<\/strong><\/li>\n\n\n\n<li>The new participants repeat exactly the same process<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>The system grows incrementally in levels<\/strong>, similar to a pyramid. While the first participants can still profit, the situation for later participants deteriorates significantly. The more people participate, the harder it becomes to find new individuals. As a result, the chances of winning decrease rapidly.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>In practice, this means:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>The majority lose money<\/li>\n\n\n\n<li>Early participants profit<\/li>\n\n\n\n<li>Later participants bear the risk<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-verbot-glucksspielartiger-vertriebssysteme-bei-zufallsabhangigkeit-nach-28-uwg\">Prohibition of Gambling-like Distribution Systems Dependent on Chance under <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P28\/NOR12036001\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P28\/NOR12036001\" target=\"_blank\" rel=\"noreferrer noopener\">Section 28 UWG<\/a><\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Section 28 UWG always applies when economic success depends on chance.<\/strong> The law protects consumers from <strong>not certainly receiving<\/strong> goods or services, even though they have already paid.<\/p>\n\n<p class=\"wp-block-paragraph\">Such a system exists when the delivery or service <strong>is determined by a lottery or another element of chance<\/strong>. The customer then no longer makes a classic purchase decision, but is effectively participating in an <strong>uncertain outcome<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>The decisive difference from a normal purchase:<\/strong><br\/>The customer cannot influence whether they actually receive the service.<\/p>\n\n<p class=\"wp-block-paragraph\">Typical manifestations are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>allocation of services by lottery<\/strong><\/li>\n\n\n\n<li><strong>dependence on unpredictable events<\/strong><\/li>\n\n\n\n<li><strong>incentive through chance of winning instead of product quality<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>The law thus prevents gambling mechanisms from being specifically used in sales.<\/strong> The consumer should receive a <strong>clear and reliable consideration<\/strong> for their money.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-voraussetzungen-von-verlosung-und-sonstigem-zufall\">Requirements for Lotteries and Other Forms of Chance<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>A violation under Section 28 UWG only exists if the service actually depends on chance.<\/strong> The decisive factor is therefore not every promotional campaign with a chance to win, but whether the customer <strong>receives the goods or services certainly or only by chance<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">A <strong>lottery<\/strong> is when the allocation of the service follows a system in which <strong>a winner is drawn<\/strong>. This can be done classically via tickets or digitally. The key is that the outcome <strong>is not foreseeable<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">A <strong>further element of chance<\/strong> exists if the success:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>does not depend on the customer&#8217;s behavior or skill<\/strong><\/li>\n\n\n\n<li><strong>is not solely controlled by the provider<\/strong><\/li>\n\n\n\n<li><strong>is determined by unpredictable circumstances<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>The weighting is important:<\/strong><br\/>Chance must play a <strong>decisive role<\/strong>. It is sufficient if the outcome <strong>is predominantly influenced by chance<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-unterschied-schneeballsystem-und-zufallssystem\">Difference Between Pyramid Scheme and Chance-Based System<\/h3>\n\n<p class=\"wp-block-paragraph\">Pyramid schemes and chance-based distribution systems follow <strong>different mechanisms,<\/strong> but lead to <strong>similar risks.<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">In a <strong>pyramid scheme,<\/strong> economic success depends on whether a participant <strong>can recruit enough new customers.<\/strong> Profit thus arises from <strong>active participation in the system.<\/strong>  <\/p>\n\n<p class=\"wp-block-paragraph\">In a <strong>chance-based distribution system,<\/strong> however, <strong>the customer&#8217;s behavior<\/strong> does not decide, but predominantly <strong>chance<\/strong>. The customer only receives the goods or services if a specific event occurs, such as a lottery. <\/p>\n\n<p class=\"wp-block-paragraph\">The differences can be clearly presented:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Pyramid scheme:<\/strong> Profit through recruiting new participants<\/li>\n\n\n\n<li><strong>Chance-based system:<\/strong> Profit through luck or chance<\/li>\n\n\n\n<li><strong>Pyramid scheme:<\/strong> Active participation required<\/li>\n\n\n\n<li><strong>Chance-based system:<\/strong> Outcome is beyond the customer&#8217;s control<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Despite these differences, both models have one thing in common:<\/strong><br\/>They distract the customer from a <strong>factual decision<\/strong> and prioritize <strong>uncertain promises of profit<\/strong>. From a legal perspective, the legislator therefore intervenes in both cases to protect consumers from <strong>financial losses and misleading business models<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verbot-getarnter-verzeichniseintragungsangebote-nbsp-28a-nbsp-uwg\">Prohibition of Disguised Directory Entry Offers <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P28a\/NOR40091902\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P28a\/NOR40091902\" target=\"_blank\" rel=\"noreferrer noopener\">Section 28a UWG<\/a><\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Not every form of disguised advertising automatically falls under this prohibition.<\/strong> The regulation specifically covers those misleading business practices where an offer <strong>is deliberately designed to appear like an existing payment obligation<\/strong>. The recipient is intended to gain the impression that they must pay an invoice, although in reality, a contract would only be concluded through payment. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>The focus here is on so-called offers for directory entries.<\/strong> This refers to offers where companies or self-employed individuals are to be entered <strong>into a business directory, online register, or similar database<\/strong> for a fee.<\/p>\n\n<p class=\"wp-block-paragraph\">Typical are letters or forms that outwardly appear like official documents, thereby creating trust. Such letters often give the impression that they are: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>an existing invoice for an alleged service<\/strong><\/li>\n\n\n\n<li><strong>a payment slip that only needs to be settled<\/strong><\/li>\n\n\n\n<li><strong>a form for confirming or correcting an existing entry<\/strong><\/li>\n\n\n\n<li><strong>an official-looking notification with a payment request<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>The legal focus is therefore not on every form of misleading advertising<\/strong>, but on this specific design of forms and letters. This particularly covers cases where companies send <strong>invitations, letters, or other communications<\/strong> to many people to induce them to participate in a prohibited system. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>The decisive point:<\/strong> Even the solicitation can be unlawful, even if no contract is concluded.<\/p>\n\n<p class=\"wp-block-paragraph\">Typical forms of such advertising are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>mass mailings by post or email<\/strong><\/li>\n\n\n\n<li><strong>invitations to presentations or events<\/strong><\/li>\n\n\n\n<li><strong>promotional letters with promises of participation<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The law is directed not only against the operator, but against <strong>all parties involved<\/strong> who actively contribute to the dissemination.<\/p>\n\n<blockquote class=\"wp-block-quote\">\n<p class=\"wp-block-paragraph\"><\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"h-abgrenzung-zu-erlaubten-geschaftsmodellen\">Distinction from Permitted Business Models<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Not every distribution system with a referral character is automatically prohibited.<\/strong> The decisive factor is whether the economic focus is on a <strong>genuine service<\/strong> or on the recruitment of <strong>new participants<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Permitted business models are based on customers <strong>paying for a product or service<\/strong> because they receive a concrete benefit.
