The primary legal basis is the Road Traffic Act (<strong>StVO<\/strong>). On the one hand, <strong>they protect other road users<\/strong> and thereby increase road safety. On the other hand, <strong>they also reduce noise and emissions<\/strong>, particularly from heavy trucks.  <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, the StVO provides not only for the <strong>traffic sign<\/strong> but also for <strong>statutory driving bans<\/strong>. These apply regardless of whether a corresponding traffic sign has been erected. Particularly relevant are, in particular:  <\/p>\n\n<ol class=\"wp-block-list\">\n<li>Weekend and public holiday driving bans for heavy trucks<\/li>\n\n\n\n<li>Night driving bans for trucks<\/li>\n\n\n\n<li>special driving bans based on regulations<\/li>\n\n\n\n<li>special restrictions such as the right-turn ban for certain trucks<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">The specific details are derived primarily from <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1960\/159\/P42\/NOR40222686\">Section 42<\/a> <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1960\/159\/P42\/NOR40222686\" target=\"_blank\" rel=\"noreferrer noopener\">S<\/a><a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1960\/159\/P42\/NOR40222686\">tVO<\/a> as well as from supplementary regulations issued by the competent Federal Ministry.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-das-verkehrszeichen-fahrverbot\">The &#8220;Driving ban&#8221; traffic sign<\/h2>\n\n<p class=\"wp-block-paragraph\">This traffic sign prohibits certain vehicles, or all vehicles, from entering a road or a section of road. It is therefore particularly important for road users to understand the meaning of this sign correctly. <\/p>\n\n<p class=\"wp-block-paragraph\">Depending on the depiction, the ban applies either to all vehicles or only to certain types of vehicles.<\/p>\n\n<p class=\"wp-block-paragraph\">The &#8220;Driving ban for all vehicles&#8221; sign (a round traffic sign with a white background and red border) means that no vehicles may enter this section of road. Exceptions usually apply only to emergency vehicles or vehicles for which a supplementary sign expressly provides an exemption. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-arten-von-fahrverboten\">Types of driving bans<\/h3>\n\n<p class=\"wp-block-paragraph\">There are also specific driving bans for certain types of vehicles. Examples include: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Driving ban for motor vehicles<\/li>\n\n\n\n<li>Driving ban for trucks<\/li>\n\n\n\n<li>Driving ban for motorcycles<\/li>\n\n\n\n<li>Driving ban for bicycles<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-fahrverbote-mit-zusatztafel\">Driving bans with supplementary sign<\/h3>\n\n<p class=\"wp-block-paragraph\">Whether and which exceptions apply is often indicated by a supplementary sign below the traffic sign. It may state, for example: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>&#8220;Residents excepted&#8221;<\/li>\n\n\n\n<li>&#8220;Delivery traffic excepted&#8221;<\/li>\n\n\n\n<li>&#8220;except cyclists&#8221;<\/li>\n\n\n\n<li>&#8220;except scheduled services&#8221;<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Such supplementary signs restrict the driving ban accordingly. A delivery vehicle may continue to use a road with the supplementary sign &#8220;Delivery traffic excepted&#8221;. <\/p>\n\n<p class=\"wp-block-paragraph\">It is also important for road users to note that a driving ban sign applies from the location of the sign. This means that vehicles may not proceed beyond this point unless the ban is lifted by another traffic sign. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-missachtung-eines-fahrverbotsschildes\">Disregarding a driving ban sign<\/h3>\n\n<p class=\"wp-block-paragraph\">Anyone who disregards a driving ban sign commits an administrative offence. In such cases, a fine may be imposed. This provision regulates in particular the <strong>weekend driving ban and the night driving ban for trucks.<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Objectives:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Protection of road safety<\/li>\n\n\n\n<li>Relief for the population on weekends and at night<\/li>\n\n\n\n<li>Reduction of noise and environmental impact<\/li>\n\n\n\n<li>better predictability of traffic flow<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-verwaltungsstrafrechtliche-folgen\">Administrative penal consequences<\/h3>\n\n<p class=\"wp-block-paragraph\">A breach of a driving ban therefore constitutes an administrative offence. The relevant legal basis is <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1960\/159\/P99\/NOR40253985\" target=\"_blank\" rel=\"noreferrer noopener\">Section 99 StVO<\/a>. <\/p>\n\n<p class=\"wp-block-paragraph\">In such cases, the authorities may impose <strong>fines<\/strong>. In addition, further measures may be threatened in certain circumstances, such as a <strong>report<\/strong> or <strong>other administrative-law consequences<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-wochenend-und-feiertagsfahrverbot\">Weekend and public holiday driving ban<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-zweck-der-regelung\">Purpose of the regulation<\/h3>\n\n<p class=\"wp-block-paragraph\">The weekend driving ban is intended to make traffic on weekends and public holidays <strong>safer<\/strong> and <strong>quieter<\/strong>. Heavy traffic is particularly affected, as large trucks pose a higher accident risk and cause greater noise pollution. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-betroffene-fahrzeuge\">Affected vehicles<\/h3>\n\n<p class=\"wp-block-paragraph\">The driving ban applies in particular to:<\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>trucks with trailers<\/strong> if the maximum permissible gross weight of one of the vehicles is <strong>more than 3.5 tonnes<\/strong><\/li>\n\n\n\n<li><strong>trucks over 7.5 tonnes<\/strong> maximum permissible gross weight<\/li>\n\n\n\n<li><strong>articulated vehicles<\/strong> over 7.5 tonnes<\/li>\n\n\n\n<li><strong>self-propelled work machines<\/strong> over 7.5 tonnes<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Certain vehicle types, such as tractor units, may be exempt from this rule.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-zeitlicher-geltungsbereich\">Period of validity<\/h3>\n\n<p class=\"wp-block-paragraph\">The weekend driving ban applies at the following times:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Saturday from 3:00 PM to Sunday 10:00 PM<\/li>\n\n\n\n<li>Public holidays from 12:00 AM to 10:00 PM<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">These periods generally apply across the entire road network, unless specific exceptions are provided.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ausnahmen-vom-wochenendfahrverbot\">Exceptions to the weekend driving ban<\/h3>\n\n<p class=\"wp-block-paragraph\">The StVO provides for numerous exceptions. These mainly concern journeys that are necessary for economic or public reasons. <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>most important exceptions<\/strong> include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Journeys in combined transport between terminals and railway stations within a radius of 65 km<\/li>\n\n\n\n<li>Transport of slaughter livestock<\/li>\n\n\n\n<li>Transport of postal items or periodical printed matter<\/li>\n\n\n\n<li>Supplying tourist excursion areas with beverages<\/li>\n\n\n\n<li>Journeys to carry out urgent repairs<\/li>\n\n\n\n<li>Operations by towing services or breakdown assistance<\/li>\n\n\n\n<li>Disaster response operations and operations by the public security service<\/li>\n\n\n\n<li>Refuse collection and road maintenance service vehicles<\/li>\n\n\n\n<li>Vehicles in scheduled services to maintain public transport<\/li>\n\n\n\n<li>humanitarian aid transports<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The transport of <strong>perishable foodstuffs<\/strong> is also permitted. This includes, for example: <\/p>\n\n<ol class=\"wp-block-list\">\n<li>fresh fruit and vegetables<\/li>\n\n\n\n<li>milk and dairy products<\/li>\n\n\n\n<li>fresh meat<\/li>\n\n\n\n<li>fish<\/li>\n\n\n\n<li>Eggs<\/li>\n\n\n\n<li>baked goods<\/li>\n\n\n\n<li>fresh herbs<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">For such transports, a <strong>consignment note<\/strong> or <strong>loading list<\/strong> must be carried in the vehicle and <strong>presented during inspections<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-nachtfahrverbot-fur-lastkraftfahrzeuge\">Night driving ban for trucks<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-geltungsbereich\">Scope<\/h3>\n\n<p class=\"wp-block-paragraph\">The night driving ban applies to <strong>trucks<\/strong> with a maximum permissible gross weight of <strong>more than 7.5 tonnes<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-zeitlicher-rahmen\">Time frame<\/h3>\n\n<p class=\"wp-block-paragraph\">The driving ban applies daily between:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>10:00 PM and 6:00 AM<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The aim of this rule is primarily to protect the population from night-time traffic noise.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ausnahmen\">Exceptions<\/h3>\n\n<p class=\"wp-block-paragraph\">Certain vehicles may be on the road despite the night driving ban. If, for example, a traffic sign is erected clearly outside the designated location, the effectiveness of the rule may be called into question. A careful legal review can therefore be decisive in administrative penal proceedings.  \u201c<\/span>\n    <\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-rechtsabbiegeverbot-fur-schwere-lastkraftfahrzeuge\">Right-turn ban for heavy trucks<\/h2>\n\n<p class=\"wp-block-paragraph\">A special form of driving ban is the right-turn ban for certain trucks. This rule is aimed at <strong>trucks with a maximum permissible gross weight of more than 7.5 tonnes.<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>aim<\/strong> of this rule is, in particular, to prevent accidents caused by the so-called blind spot when turning right.<\/p>\n\n<p class=\"wp-block-paragraph\">The ban is therefore intended primarily to <strong>protect cyclists and pedestrians<\/strong> who are in the immediate vicinity of a truck.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ausnahmebewilligungen-von-fahrverboten\">Exemption permits from driving bans<\/h2>\n\n<p class=\"wp-block-paragraph\">Under certain conditions, companies or vehicle owners may apply for an <strong>exemption permit<\/strong>. Such a permit may be granted in particular for the <strong>weekend driving ban<\/strong>. Responsibility generally lies with the respective <strong>provincial government<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">In doing so, the authority examines in particular whether there is an <strong>economic necessity<\/strong>. In addition, it assesses whether reasonable alternatives to the transport exist and what impact the requested exemption could have on road safety and the environment. <\/p>\n\n<p class=\"wp-block-paragraph\">An exemption is granted only if there is an <strong>overriding public or economic interest<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-bedeutung-der-ordnungsgemassen-kundmachung\">Importance of proper promulgation<\/h2>\n\n<p class=\"wp-block-paragraph\">In administrative penal proceedings, the proper promulgation of a driving ban plays a decisive role.<\/p>\n\n<p class=\"wp-block-paragraph\">A driving ban is effective only if it has been lawfully promulgated. This includes, in particular, the correct erection of traffic signs or the lawful issuance of a corresponding regulation. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-typische-verwaltungsstrafverfahren-bei-fahrverboten\">Typical administrative penal proceedings relating to driving bans<\/h2>\n\n<p class=\"wp-block-paragraph\">Breaches of driving bans frequently lead to administrative penal proceedings.
