The legal foundations are primarily found in the Road Traffic Act (StVO). Furthermore, motorways have <strong>separate directional carriageways<\/strong> and are subject to <strong>special traffic rules<\/strong>, which differ significantly from those on ordinary roads.  <\/p>\n\n<p>As a general rule, a permissible <strong>maximum speed of 130 km per hour<\/strong> applies to motorways. These are regulated in particular in the Motor Vehicle Act Implementing Regulation. For example, buses are generally allowed to drive at a maximum of 100 km\/h.  <\/p>\n\n<p>In addition, lower speeds may be ordered by traffic signs, for example at construction sites, in heavy traffic, or at special hazard points.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-zu-langsames-fahren-auf-autobahnen\">Driving Too Slowly on Motorways<\/h3>\n\n<p>Drivers are also not permitted to drive arbitrarily slowly on motorways. According to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10011336&amp;Artikel=&amp;Paragraf=20&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 20 StVO<\/a>, drivers must choose their speed so that they do not unnecessarily obstruct the flow of traffic. Anyone who drives significantly slower than the rest of the traffic without a factual reason and thereby endangers or obstructs other road users may be committing an administrative offense.  <\/p>\n\n<p>Although there is no legally defined minimum speed on motorways, driving too slowly can still be unlawful if there is no factual reason and the flow of traffic is consequently obstructed or endangered. <\/p>\n\n<p>Factual reasons for a lower speed can include, for example:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>bad weather<\/li>\n\n\n\n<li>heavy traffic<\/li>\n\n\n\n<li>technical problems with the vehicle<\/li>\n\n\n\n<li>construction sites or special hazard points<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-benutzung-der-autobahn\">Use of the Motorway<\/h2>\n\n<p>Motorways may only be used by motor vehicles that can reach a design speed of <strong>at least 60 km\/h<\/strong>. This rule arises from <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10011336&amp;Artikel=&amp;Paragraf=46&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 46 StVO<\/a>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verbotene-verkehrsteilnehmer\">Prohibited Road Users<\/h3>\n\n<p>Use is therefore prohibited for<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Pedestrians<\/li>\n\n\n\n<li>cyclists<\/li>\n\n\n\n<li>horse-drawn vehicles<\/li>\n\n\n\n<li>riders or cattle drives<\/li>\n\n\n\n<li>slow vehicles without sufficient design speed<\/li>\n<\/ul>\n\n<p>Motorways are intended to serve <strong>exclusively<\/strong> for <strong>fast and safe motor vehicle traffic<\/strong>.<\/p>\n\n<p>In <strong>exceptional cases<\/strong>, persons may enter the motorway. This is permissible if assistance is being provided after a traffic accident or if a hazard point must be secured. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-zufahrt-und-abfahrt-von-autobahnen\">Entering and Exiting Motorways<\/h2>\n\n<p><strong>Access<\/strong> to motorways is generally only permitted via <strong>specially marked junctions<\/strong>. Signposts to the motorway usually announce these entrances several hundred meters before an intersection. <\/p>\n\n<p>When <strong>entering<\/strong> the motorway, the <strong>acceleration lane<\/strong> must also be used. This allows the driver to reach the speed of the flowing traffic and to merge safely. <\/p>\n\n<p>Conversely, <strong>leaving<\/strong> the motorway may only be done via marked exits. The <strong>deceleration lane<\/strong> must be used in each case so that the speed can be reduced in good time. <\/p>\n\n<p>Before exiting, the driver must also move into the right-hand lane in good time.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-anhalten-auf-der-autobahn\">Stopping on the Motorway<\/h2>\n\n<p>As a rule, a vehicle <strong>must not be stopped<\/strong> on the motorway. An <strong>exception<\/strong> exists only if there is an important reason. This rule arises from <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10011336&amp;Artikel=&amp;Paragraf=46&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 46 StVO<\/a>.  <\/p>\n\n<p>An important reason may exist in the event of:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>a technical defect<\/li>\n\n\n\n<li>a traffic accident<\/li>\n\n\n\n<li>a medical emergency<\/li>\n<\/ul>\n\n<p>If a vehicle must be stopped, this should be done <strong>on the hard shoulder if possible<\/strong>. This obligation arises directly from <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10011336&amp;Artikel=&amp;Paragraf=46&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 46 StVO<\/a>. <\/p>\n\n<p>The emergency corridor allows emergency vehicles to reach the scene of an accident or other emergencies quickly. Therefore, drivers must form the emergency corridor as soon as traffic congestion becomes apparent. <\/p>\n\n<p>In the case of <strong>two lanes<\/strong>, vehicles position themselves so that a clear corridor is created <strong>between the left and the right<\/strong> lane. In the case of <strong>more than two lanes<\/strong>, drivers form the emergency corridor between the <strong>outermost left lane and the adjacent lane<\/strong>. <\/p>\n\n<p>Other vehicles are generally not permitted to use this emergency corridor, as it is reserved exclusively for <strong>emergency vehicles<\/strong>, <strong>road service vehicles<\/strong>, and <strong>breakdown service vehicles<\/strong>. Violations are strictly punished. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-pannenstreifen\">Hard Shoulder<\/h2>\n\n<p>The hard shoulder is a paved area on the right edge of the carriageway and is used <strong>exclusively for emergencies<\/strong>. The use of the hard shoulder by normal vehicles is generally prohibited. <strong>Exceptions<\/strong> apply, for example, to: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>road service<\/li>\n\n\n\n<li>breakdown service<\/li>\n\n\n\n<li>emergency vehicles<\/li>\n<\/ul>\n\n<p>On individual motorway sections, however, the hard shoulder may be temporarily opened for traffic. This so-called <strong>hard shoulder release<\/strong> is indicated by special lane signals. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-uberholregeln-auf-der-autobahn\">Overtaking Rules on the Motorway<\/h2>\n\n<p>On Austrian motorways, the requirement to drive on the right generally applies. Drivers must therefore use the right-hand lane whenever possible. The left-hand lane is primarily for overtaking. Anyone who drives continuously on the left, even though there is sufficient space on the right, commits an administrative offense.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-sicherheitsabstand\">Safe Following Distance<\/h2>\n\n<p>Drivers must maintain a sufficient distance from the vehicle in front. Especially on motorways, this distance is regularly monitored by police distance measurements. An insufficient distance can result in high fines and demerit points in the driving license register.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-autobahnvignette-und-maut\">Motorway Toll Sticker and Tolls<\/h2>\n\n<p>In Austria, motorways and expressways may generally only be used with a <strong>valid toll sticker<\/strong> or with a <strong>properly paid section toll<\/strong>. This obligation arises from the Federal Road Toll Act. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-autobahn-ohne-gultige-vignette-oder-maut\">Motorway Without a Valid Toll Sticker or Toll<\/h3>\n\n<p>Anyone who uses a toll road without a valid toll sticker or without a paid section toll commits an administrative offense. In such cases, <strong>ASFINAG first prescribes a substitute toll<\/strong>. <strong>If the driver pays this within the deadline<\/strong>, the matter is usually considered settled. <\/p>\n\n<p>Conversely, if the driver <strong>does not pay<\/strong> the substitute toll <strong>or if there is a serious violation<\/strong>, the authority initiates <strong>administrative penal proceedings<\/strong>. In this case, significantly higher fines are threatened. <\/p>\n\n<p>Drivers should therefore <strong>check before using a motorway or expressway<\/strong> whether they possess a valid toll sticker or must pay a corresponding section toll.<\/p>\n\n<p><a href=\"https:\/\/harlander-partner.eu\/en\/traffic-law\/substitute-toll-and-administrative-penalty-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">Read detailed information on substitute tolls and penal orders here.<\/a><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ig-l-geschwindigkeitsbeschrankung-auf-autobahnen\">IG-L Speed Limits on Motorways<\/h2>\n\n<p>On some motorway sections, a <strong>lower speed limit according to the Air Pollution Control Act (IG-L)<\/strong> applies instead of the normal maximum speed of 130 km per hour.<\/p>\n\n<p>These restrictions are introduced to reduce <strong>air pollution from pollutants<\/strong> such as nitrogen oxides and particulate matter. They are intended in particular to improve air quality in heavily polluted regions. <\/p>\n\n<p>Typical IG-L speed limits include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>100 km\/h <\/li>\n\n\n\n<li>80 km\/h<\/li>\n<\/ul>\n\n<p>Such restrictions are marked by <strong>their own traffic signs with the suffix &#8220;IG-L&#8221;<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-besonderheit-bei-strafen\">Special Provisions Regarding Penalties<\/h3>\n\n<p>An important difference from normal speeding violations exists in the penal provisions.<\/p>\n\n<p>In the event of a speeding violation in an IG-L zone:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>there is no tolerance regulation as with some other measurements<\/li>\n\n\n\n<li>higher administrative fines can be imposed<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-regionen-mit-ig-l-beschrankungen\">Regions with IG-L Restrictions<\/h3>\n\n<p>IG-L speed limits are frequently found on motorways in regions with high air pollution, for example:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>in Tyrol<\/li>\n\n\n\n<li>in Styria<\/li>\n\n\n\n<li>in Upper Austria<\/li>\n\n\n\n<li>in parts of Salzburg<\/li>\n<\/ul>\n\n<p>They apply permanently or temporarily on certain motorway sections.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wichtig-fur-fahrzeuglenker\">Important for Drivers<\/h3>\n\n<p>As soon as a traffic sign with the suffix <strong>IG-L<\/strong> is displayed, drivers must adhere to the speed prescribed there. This rule applies regardless of whether traffic is currently heavy or not. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ausnahme-fur-elektrofahrzeuge-bei-ig-l\">Exception for Electric Vehicles under IG-L<\/h3>\n\n<p>Electric cars are exempt from certain <strong>IG-L speed limits on motorways<\/strong>. This means that they may continue to <strong>drive at 130 km\/h<\/strong> on such stretches, even though a limit of <strong>100 km\/h<\/strong> applies to other vehicles, for example. <\/p>\n\n<p>The reason for this lies in the purpose of the law.
