In particular, it supplements the right to information, the right to participate as a private party, and the right to protection of interests worthy of protection. By inspecting the criminal file, the victim can <strong>classify the proceedings objectively<\/strong> and make their decisions <strong>on a reliable basis<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">File inspection supports victim rights primarily by:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>creating <strong>transparency about the charges and the status of the investigation<\/strong>,<\/li>\n\n\n\n<li>facilitating the <strong>assessment of one&#8217;s own claims<\/strong>,<\/li>\n\n\n\n<li>enabling <strong>well-founded communication with authorities<\/strong>,<\/li>\n\n\n\n<li>supporting the <strong>preparation of further procedural steps<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">At the same time, the system of victim rights takes into account the <strong>requirements of orderly criminal proceedings<\/strong>. The law therefore grants file inspection <strong>on an interest-related basis<\/strong> and draws boundaries where investigative purposes or the legitimate interests of other parties involved are affected. In this way, the victim&#8217;s file inspection maintains a <strong>balanced relationship between the interest in information and the protection of the proceedings<\/strong>.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-reichweite-und-einordnung-des-akteneinsichtsrechts-des-opfers\">Scope and classification of the victim&#8217;s right to inspect files<\/h2>\n\n<p class=\"wp-block-paragraph\">The victim&#8217;s right to inspect files is linked to the <strong>concrete impact of the criminal offense<\/strong>. What is decisive is not the formal position in the proceedings, but rather the question of <strong>whether and to what extent one&#8217;s own interests are affected<\/strong>. This distinguishes the victim&#8217;s file inspection significantly from that of the accused.  <\/p>\n\n<p class=\"wp-block-paragraph\">The right is granted to victims <strong>regardless of whether they participate as a private party or private prosecutor<\/strong>. The criminal proceedings thus open up an <strong>independent access to information<\/strong>, which allows the victim to understand the progress of the proceedings and to classify their own role objectively. <\/p>\n\n<p class=\"wp-block-paragraph\">At the same time, the law classifies the victim&#8217;s right to inspect files <strong>within the overall context of the investigation proceedings<\/strong>. The inspection does not serve the purpose of complete control over the proceedings, but rather the <strong>objective information about the relevant procedural material<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">In particular, the authority grants file inspection into documents that:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>concern the <strong>accusation and the course of events<\/strong>,<\/li>\n\n\n\n<li>contain statements that <strong>directly affect<\/strong> the victim,<\/li>\n\n\n\n<li>are significant for the <strong>assertion of claims<\/strong>,<\/li>\n\n\n\n<li>reveal the <strong>current status of the proceedings<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Not covered by the scope of file inspection are parts of the file that have <strong>no relation to the position of the victim<\/strong> or predominantly concern other parties involved in the proceedings. The authority limits the scope of the inspection <strong>on a case-by-case basis<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">What is always decisive is <strong>whether knowledge of the respective parts of the file is necessary<\/strong> in order to be able to exercise the rights of the victim appropriately. In doing so, it always examines <strong>specifically and on a case-by-case basis<\/strong> whether the inspection would impair the proper course of the criminal proceedings. <\/p>\n\n<p class=\"wp-block-paragraph\">Restrictions are particularly relevant if the file inspection:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>endangers ongoing investigations<\/strong>,<\/li>\n\n\n\n<li>could impair an <strong>uninfluenced witness statement<\/strong>,<\/li>\n\n\n\n<li>affects <strong>interests of other parties involved in the proceedings that are worthy of protection<\/strong>,<\/li>\n\n\n\n<li>would disclose sensitive <strong>personal data of third parties<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The authority restricts the file inspection <strong>only to the extent necessary<\/strong>. It resorts to milder means, such as <strong>redactions<\/strong> or the <strong>exception of individual parts of the file<\/strong>, instead of denying the inspection altogether. <\/p>\n\n<p class=\"wp-block-paragraph\">A complete denial represents the <strong>exception<\/strong>. It requires that no other measure can guarantee the necessary protection. The authority must <strong>substantiate and document<\/strong> each restriction.  <\/p>\n\n<p class=\"wp-block-paragraph\">The regulation thus maintains the <strong>balance between the victim&#8217;s interest in information and the protection of the investigation proceedings<\/strong> as well as the rights of other parties involved.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verhaltnis-zur-akteneinsicht-des-beschuldigten\">Relationship to the file inspection of the accused<\/h2>\n\n<p class=\"wp-block-paragraph\">The victim&#8217;s file inspection in the criminal proceedings exists <strong>alongside<\/strong>, but <strong>not equal<\/strong> to the file inspection of the accused. Both rights serve different functions under criminal procedure and are subject to <strong>independent legal standards<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">The accused uses the file inspection to <strong>exercise their rights of defense<\/strong>. The victim accesses file inspection in order to exercise their <strong>position under criminal procedure in the proceedings<\/strong> and to be able to understand the progress of the investigation or main proceedings. <\/p>\n\n<p class=\"wp-block-paragraph\">The authority therefore always examines applications <strong>separately<\/strong> and takes into account in particular:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the <strong>different roles<\/strong> of the victim and the accused in the criminal proceedings,<\/li>\n\n\n\n<li>the <strong>concrete purpose<\/strong> of the requested file inspection,<\/li>\n\n\n\n<li>possible <strong>effects on ongoing investigations<\/strong>,<\/li>\n\n\n\n<li>the protection of an <strong>uninfluenced taking of evidence<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The victim&#8217;s file inspection must <strong>not lead to<\/strong> the undermining of the accused&#8217;s rights of defense or the impairment of investigative measures. Conversely, the authority must <strong>not restrict the victim&#8217;s right to inspect files across the board<\/strong> if the requested part of the file is relevant to their rights under criminal procedure. <\/p>\n\n<p class=\"wp-block-paragraph\">In practice, the authority therefore often grants <strong>different scopes of inspection<\/strong>, although both applications relate to the same criminal file.
