It makes it possible to prevent a main hearing if the indictment is legally or factually flawed. The Higher Regional Court examines in particular:

whether there is a sufficient suspicion,

whether the investigations are complete,

whether the evidence is admissible,

whether the legal classification is correct.

If the objection is granted, the proceedings must either be terminated or referred back to the public prosecutor’s office for further investigation.

Remand in custody and detention review

The review of remand in custody is one of the most important competences of the Higher Regional Court. As soon as a complaint is lodged against the imposition of detention, it is no longer the Regional Court, but the Higher Regional Court that decides on the further detention.

A person may only remain in detention if the Higher Regional Court expressly confirms this. Each of these decisions triggers a new statutory detention period. These include in particular:

Remand in custody,

House searches,

Telephone surveillance,

Seizures,

Surveillance measures.

It examines the necessity, proportionality and legality of these interventions.

Jurisdictional decisions and delegations

The Higher Regional Court makes binding decisions on jurisdictional conflicts between courts. In practice, it is therefore a central instance for safeguarding personal freedom.

What is the significance of the objection to the indictment before the Higher Regional Court?

The objection to the indictment can prevent a main hearing if the indictment is not legally or factually sound. The Higher Regional Court examines whether the suspicion is sufficient, whether the investigations have been carried out completely and whether the legal classification is consistent. If the objection is granted, the public prosecutor’s office must conduct further investigations or the proceedings are terminated. The decisive factor is whether there are procedural errors, whether the assessment of evidence is sustainable and whether the legal subsumption is correct. It is therefore the instance that can effectively rectify incorrect developments in the first instance.

Why is legal representation particularly important before the Higher Regional Court?

Before the Higher Regional Court, a great deal depends on precise reasoning for legal remedies and sound procedural complaints. Errors in deadlines, admissibility or argumentation often lead to substantive points no longer being examined. Legal representation ensures that procedural defects are clearly identified, detention issues are challenged in a well-founded manner and legal opportunities are used realistically. Anyone who proceeds in a structured manner here significantly improves the chances of success.

Select your preferred appointment now:Free initial consultation

The Higher Regional Court is the court level that reviews, corrects and definitively determines the decisions of the Regional Courts in criminal proceedings in key areas. It decides on appeals against …
[345

post-116617","page","type-page","status-publish","has-post-thumbnail","hentry","category-criminal-law
["https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht.webp",1920,1080,false
https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-100x100.webp",100,100,true
https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-800x450.webp",800,450,true
https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht.webp",1920,1080,false
https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht.webp",1920,1080,false],"1536x1536":["https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-1536x864.webp",1536,864,true],"2048x2048":["https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht.webp",1920,1080,false],"336x":["https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-336x189.webp",336,189,true],"352x":["https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-352x198.webp",352,198,true
https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-300x300.webp",300,300,true
https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-600x338.webp",600,338,true
https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-100x100.webp",100,100,true
https://harlander-partner.eu/wp-content/uploads/Oberlandesgericht-120x120.webp",120,120,true
The Higher Regional Court is the court level that reviews, corrects and definitively determines the decisions of the Regional Courts in criminal proceedings in key areas. It decides on appeals against ...
["GET
