Anyone who ignores maintenance, control or safety rules not only creates a risk, but a public danger with its own criminal quality. \u201c<\/span>\n    <\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-objektiver-tatbestand\">objective elements of the offence<\/h2>\n\n<p class=\"wp-block-paragraph\">The <strong>objective element of the offense<\/strong> exclusively covers the <strong>externally perceptible events<\/strong>. What is decisive is what could be <strong>determined by neutral observation<\/strong>, i.e. <strong>concrete actions, procedures, means used and the resulting dangerous situation<\/strong>. <strong>Internal processes<\/strong> such as intent, knowledge, motives or forms of negligence are irrelevant and do <strong>not<\/strong> belong to the objective element of the offense. <\/p>\n\n<p class=\"wp-block-paragraph\">It is required that the perpetrator <strong>other than by arson, intentional endangerment by nuclear energy or ionizing radiation, or intentional endangerment by explosives<\/strong> causes a <strong>danger to the life or limb of a large number of people<\/strong> or to <strong>extensive third-party property<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">A <strong>public danger<\/strong> exists if the danger is <strong>not limited to individual persons<\/strong>, but <strong>simultaneously threatens an indefinite number of people<\/strong> or <strong>extensive third-party assets<\/strong>. The <strong>broad impact of the danger<\/strong> is decisive. <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>creation of a real dangerous situation<\/strong> is sufficient. An <strong>actual occurrence of damage is not required<\/strong>. What is decisive is that the event is suitable for <strong>significantly endangering many people or third-party property<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">Cases of <strong>arson<\/strong>, <strong>intentional endangerment by nuclear energy or ionizing radiation<\/strong> and <strong>intentional endangerment by explosives<\/strong> are not covered, as these offenses are <strong>regulated independently<\/strong>. <strong><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=177&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 177 of the Criminal Code<\/a> only applies<\/strong> if <strong>none of these special offenses<\/strong> exist.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-qualifizierende-umstande\">Qualifying circumstances<\/h3>\n\n<p class=\"wp-block-paragraph\">If the negligent endangerment of the public leads to consequences that correspond to <strong>arson with serious consequences<\/strong>, then <strong>the same increased penalties<\/strong> apply.<\/p>\n\n<p class=\"wp-block-paragraph\">This is particularly the case if<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>a person is killed<\/strong>,<\/li>\n\n\n\n<li><strong>many people are seriously injured<\/strong>, or<\/li>\n\n\n\n<li><strong>a large number of people are placed in a situation of existential distress<\/strong>.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungsschritte\">Steps of legal assessment<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatsubjekt\">Perpetrator:<\/h4>\n\n<p class=\"wp-block-paragraph\">The subject of the offense can be <strong>any person who is criminally responsible<\/strong>. <strong>No special personal characteristics<\/strong> are required.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatobjekt\">Object of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The object of the offense is the <strong>life or limb of a large number of people<\/strong> or <strong>extensive third-party property<\/strong>. The <strong>extent and intensity of the endangerment<\/strong> is decisive, not the individual assignment. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tathandlung\">Act: <\/h4>\n\n<p class=\"wp-block-paragraph\">The act consists of <strong>causing a public danger<\/strong> through <strong>active action or breach of duty by omission<\/strong>. What is required is conduct that <strong>directly creates a general dangerous situation<\/strong>. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-taterfolg\">Result of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The result of the offense lies in the <strong>creation of the concrete public danger<\/strong>. An <strong>occurrence of damage is not required<\/strong>. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-kausalitat\">Causality:<\/h4>\n\n<p class=\"wp-block-paragraph\">There must be a <strong>causal connection<\/strong> between the perpetrator&#8217;s behavior and the dangerous situation. It only applies <strong>if<\/strong> none of the specially regulated public endangerment offenses are applicable. What is decisive is not the means used, but the <strong>negligent causing of a general danger<\/strong> to many people or third-party property on a large scale.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00a7 176 of the Criminal Code \u2013 Intentional endangerment of the public<\/strong>: There is a clear dividing line to <strong>intentional endangerment of the public under \u00a7 176 of the Criminal Code<\/strong>. \u00a7 176 of the Criminal Code covers the <strong>conscious and deliberate creation<\/strong> of a public danger. <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=177&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 177 of the Criminal Code<\/a>, on the other hand, requires that the danger arises <strong>not intentionally<\/strong>, but <strong>through carelessness or breach of duty<\/strong>. Anyone who intentionally creates a situation that endangers many people or third-party property falls under \u00a7 176 of the Criminal Code. Anyone who <strong>negligently causes<\/strong> such a danger is assessed under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=177&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 177 of the Criminal Code<\/a>. The <strong>internal element of the offense<\/strong>, not the external event, is therefore exclusively decisive.    <\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/?page_id=111524\">\u00a7 169 of the Criminal Code \u2013 Arson:<\/a> <\/strong>If there is <strong>arson under \u00a7 169 of the Criminal Code<\/strong>, <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=177&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 177 of the Criminal Code<\/a> is <strong>not applicable<\/strong>. The arson offense takes precedence as a <strong>special offense<\/strong>. This also applies if the fire endangers many people or third-party property on a large scale. In these cases, the negligent endangerment of the public is <strong>completely displaced<\/strong> because the injustice is already covered by the arson.   <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-konkurrenzen\">Concurrences:<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-echte-konkurrenz\">Genuine Concurrence: <\/h4>\n\n<p class=\"wp-block-paragraph\"><strong>Genuine concurrence<\/strong> exists if <strong>other independent offenses<\/strong> are added to the negligent endangerment of the public, such as bodily harm, serious bodily harm, homicide offenses, property damage or offenses against freedom. In these cases, the offenses <strong>exist side by side<\/strong> because <strong>different legal interests<\/strong> are violated. The negligent endangerment of the public retains its <strong>independent element of injustice<\/strong>, as it covers the broad impact of the danger.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-unechte-konkurrenz\">Spurious Concurrence:<\/h4>\n\n<p class=\"wp-block-paragraph\"><strong>Spurious concurrence<\/strong> exists if another element of the offense <strong>completely covers<\/strong> the entire element of injustice of the negligent endangerment of the public. In the case of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=177&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 177 of the Criminal Code<\/a>, this is only conceivable in <strong>rare exceptional cases<\/strong>. In practice, the negligent endangerment of the public regularly remains in place because it covers precisely that <strong>general dangerous situation<\/strong> that other offenses do not fully depict.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatmehrheit\">Multiple Offenses: <\/h4>\n\n<p class=\"wp-block-paragraph\"><strong>Multiple commission<\/strong> is to be assumed if several endangerments of the public are committed <strong>independently of each other<\/strong>, for example in different places or at different times. Each of these actions then constitutes a <strong>separate criminal act<\/strong>. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-fortgesetzte-handlung\">Continued Action: <\/h4>\n\n<p class=\"wp-block-paragraph\">A <strong>single act<\/strong> may exist if several endangering actions are <strong>directly related<\/strong> and part of a <strong>single sequence of events<\/strong>. As a result, a defect occurs, causing exhaust gases to escape into the stairwell and several apartments. The smell quickly spreads throughout the building, residents complain of dizziness and breathing problems, the house has to be evacuated, the fire department and rescue services are on site. Several apartments are temporarily unusable. What is decisive is that the person responsible <strong>did not deliberately want to create a danger<\/strong>, but <strong>through breach of duty by omission and lack of care<\/strong> caused a <strong>general dangerous situation<\/strong> for many people and third-party property on a large scale.    <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">This example shows that <strong>negligent endangerment of the public<\/strong> already exists if <strong>negligence in maintenance and control<\/strong> creates a situation in which <strong>a large number of people are simultaneously<\/strong> seriously endangered, even if no damage was intended.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-subjektiver-tatbestand\">subjective elements of the offence<\/h2>\n\n<p class=\"wp-block-paragraph\">Negligent endangerment of the public does <strong>not require intent<\/strong>. The perpetrator must <strong>not have wanted<\/strong> the danger and must <strong>not have consciously accepted<\/strong> it. It is sufficient that he <strong>disregards the required duty of care<\/strong> and thereby causes a danger to many people or third-party property on a large scale.  <\/p>\n\n<p class=\"wp-block-paragraph\">Negligence exists if the perpetrator<br\/>does <strong>not recognize the danger, even though he should have recognized it<\/strong>, or<br\/><strong>recognizes the danger, but negligently trusts<\/strong> that nothing will happen.<\/p>\n\n<p class=\"wp-block-paragraph\">It is therefore sufficient that the perpetrator <strong>acts carelessly, recklessly or in breach of duty<\/strong> and thereby creates a general dangerous situation. A conscious intention to endanger is not required. <\/p>\n\n<p class=\"wp-block-paragraph\">With regard to serious consequences such as <strong>serious injuries, deaths or placing many people in distress<\/strong>, <strong>no intent is required either<\/strong>. Mere ignorance, indifference or recklessness do not exclude guilt.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Principle of culpability:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Only those who act <strong>culpably<\/strong> are punishable. Negligent endangerment of the public is <strong>not an intentional offense<\/strong>, but requires <strong>breach of duty of care<\/strong>. The perpetrator must <strong>not want<\/strong> the danger and must <strong>not consciously accept<\/strong> it. It is sufficient that he <strong>does not recognize the dangerousness of his behavior, even though he should have recognized it<\/strong>, or <strong>negligently underestimates<\/strong> the danger.   <\/p>\n\n<p class=\"wp-block-paragraph\">If there is no breach of duty of care, for example because the perpetrator <strong>could not recognize<\/strong> that a general danger was arising even with dutiful conduct, there is <strong>no negligent endangerment of the public<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Incapacity to be held accountable:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">No guilt is incurred by anyone who, at the time of the offense, was unable to recognize the injustice of their actions or to act in accordance with this insight due to a <strong>severe mental disorder<\/strong>, a <strong>morbid mental impairment<\/strong> or a <strong>significant inability to control<\/strong>. In the event of corresponding doubts, a <strong>psychiatric report<\/strong> will be obtained. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/exculpatory-necessity\/\">Excusable state of necessity<\/a>:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">An excusable emergency situation may exist if the perpetrator acts in an <strong>extreme emergency<\/strong> to avert an <strong>acute danger to their own life or the lives of others<\/strong>. Even in the case of negligent endangerment of the public, the behavior <strong>remains unlawful<\/strong>, but can have a <strong>guilt-reducing or excusing<\/strong> effect if there was no other way out and the dangerous situation could not be averted otherwise. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/erroneous-assumption-of-justifying-circumstances\/\">Putative self-defense<\/a>:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Anyone who mistakenly believes that they are <strong>entitled to a defensive action<\/strong> by causing a dangerous situation acts <strong>without intent<\/strong> if the mistake was serious and comprehensible. Such a mistake can reduce or exclude guilt. However, if a <strong>breach of duty of care<\/strong> remains, <strong>negligent responsibility<\/strong> comes into consideration, but not a justification.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafaufhebung-amp-diversion\">Extinction of punishment and diversion<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-diversion\">Diversion:<\/h3>\n\n<p class=\"wp-block-paragraph\">According to the Code of Criminal Procedure, a diversion necessarily requires that<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the offense is <strong>not punishable by more than five years&#8217; imprisonment<\/strong><\/li>\n\n\n\n<li>the <strong>guilt is not serious<\/strong><\/li>\n\n\n\n<li><strong>no death<\/strong> has occurred<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The <strong>negligent endangerment of the public<\/strong> is punishable in the basic element of the offense by <strong>imprisonment of up to one year<\/strong> or a <strong>fine of up to 720 daily rates<\/strong>. A diversionary settlement is therefore <strong>generally possible<\/strong>, provided that the other requirements are met. <\/p>\n\n<p class=\"wp-block-paragraph\">What is decisive above all is whether the <strong>breach of duty is not to be assessed as serious<\/strong> and the dangerous situation was <strong>not particularly far-reaching or uncontrollable<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">If there are <strong>serious injuries<\/strong>, <strong>deaths<\/strong> or the <strong>placing of many people in distress<\/strong>, a diversion is generally <strong>excluded<\/strong>. In these cases, there is <strong>no minor injustice<\/strong>, but an act with considerable weight. <\/p>\n\n<p class=\"wp-block-paragraph\">Therefore, a diversion only comes <strong>into consideration<\/strong> if<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the offense <strong>does not carry a sentence of more than five years<\/strong><\/li>\n\n\n\n<li>the <strong>guilt is not severe<\/strong><\/li>\n\n\n\n<li><strong>no death<\/strong> has occurred<\/li>\n\n\n\n<li>the offense is <strong>not classified as serious<\/strong><\/li>\n\n\n\n<li>a formal punishment does <strong>not appear necessary<\/strong> to prevent further offenses<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If a diversion is considered, <strong>monetary payments<\/strong>, <strong>community service<\/strong>, <strong>probation models<\/strong>, or <strong>victim-offender mediation<\/strong> are possible. The goal is a <strong>resolution without a guilty verdict<\/strong> if punishment is not necessary. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ausschluss-der-diversion\">Exclusion of Diversion:<\/h3>\n\n<p class=\"wp-block-paragraph\">An exclusion of diversion in the case of negligent endangerment <strong>does not occur automatically<\/strong>, but rather from the legal requirements. Decisive is how severely <strong>the life or limb of people were endangered or injured<\/strong> and the extent of the danger to <strong>third-party property<\/strong>. The pure property damage is significantly less important than the <strong>endangerment component<\/strong>, but remains relevant for the overall assessment.  <\/p>\n\n<p class=\"wp-block-paragraph\">Of particular importance is <strong>how serious the breach of duty was<\/strong>, whether warning signs were ignored, safety regulations were disregarded, or obvious risks were ignored. It must be considered whether the dangerous situation <strong>could have been easily avoided<\/strong>, whether it quickly spiraled out of control, and what <strong>potential for escalation and spread<\/strong> existed. In the case of serious consequences such as <strong>serious injuries, deaths, or the distress of many people<\/strong>, these consequences are a <strong>central factor in determining the sentence<\/strong>.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-erschwerungsgrunde-bestehen-insbesondere-wenn\">Aggravating Factors Exist in Particular If<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>the dangerous situation was caused by <strong>gross negligence<\/strong>,<\/li>\n\n\n\n<li>the situation <strong>quickly got out of control<\/strong>,<\/li>\n\n\n\n<li><strong>people were concretely endangered or injured<\/strong>,<\/li>\n\n\n\n<li><strong>third-party property was affected to a large extent<\/strong>,<\/li>\n\n\n\n<li>there was a <strong>high degree of irresponsibility<\/strong>,<\/li>\n\n\n\n<li>the perpetrator <strong>ignored warnings<\/strong> or disregarded safety rules,<\/li>\n\n\n\n<li><strong>relevant previous convictions<\/strong> exist.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-milderungsgrunde-sind-etwa\">Mitigating Factors Include<\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>a clean record<\/strong>,<\/li>\n\n\n\n<li>an <strong>early, comprehensive confession<\/strong>,<\/li>\n\n\n\n<li><strong>recognizable remorse and insight<\/strong>,<\/li>\n\n\n\n<li><strong>active restitution<\/strong>, as far as possible,<\/li>\n\n\n\n<li>a <strong>subordinate participation in the act<\/strong>,<\/li>\n\n\n\n<li>an <strong>excessively long duration of proceedings<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Due to the <strong>comparatively low statutory penalty<\/strong>, the <strong>upper limit of the penalty is clearly defined<\/strong>. Nevertheless, the penalty can be severe in individual cases if the dangerous situation was particularly serious or serious consequences have occurred. In practice, prison sentences are often <strong>suspended<\/strong>, fines are <strong>typical<\/strong>, but in the case of serious consequences or massive breaches of duty, <strong>unconditional imprisonment<\/strong> is also possible.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafrahmen\">Penalty Range<\/h2>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>negligent endangerment<\/strong>, the following is fundamentally threatened<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Imprisonment of up to one year<\/strong> or<\/li>\n\n\n\n<li><strong>Fine of up to 720 daily rates<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">This penalty applies whenever &#8220;only&#8221; a dangerous situation has arisen for many people or third-party property, <strong>without serious consequences<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">If, as a result of negligent endangerment, <strong>many people suffer serious injuries<\/strong>, <strong>a person dies<\/strong>, or <strong>many people find themselves in a situation of existential distress<\/strong>, the penalty is significantly increased.<\/p>\n\n<p class=\"wp-block-paragraph\">In these cases, the following is threatened<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Imprisonment of up to three years<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If there are even <strong>deaths of several people<\/strong>, the penalty increases further. Then the following is threatened <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Imprisonment from six months to five years<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-geldstrafe-tagessatzsystem\">Monetary Penalty \u2013 Day-fine System<\/h2>\n\n<p class=\"wp-block-paragraph\">Austrian criminal law calculates monetary penalties according to the <strong>day-fine system<\/strong>. The <strong>number of day-fines<\/strong> depends on the <strong>guilt<\/strong>, the <strong>amount per day<\/strong> depends on the <strong>financial capacity<\/strong>. In this way, the penalty is adapted to the personal circumstances and yet remains noticeable.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Range:<\/strong> up to <strong>720 daily rates<\/strong> \u2013 at least <strong>\u20ac4<\/strong>, maximum <strong>\u20ac5,000<\/strong> per day.<\/li>\n\n\n\n<li><strong>Practical formula:<\/strong> Approximately <strong>6 months imprisonment corresponds to around 360 day-fines<\/strong>. This conversion serves only as <strong>orientation<\/strong> and is <strong>not a rigid scheme<\/strong>. <\/li>\n\n\n\n<li><strong>In case of non-payment:<\/strong> The court can impose a <strong>substitute custodial sentence<\/strong>. As a rule, the following applies: <strong>1 day of substitute custodial sentence corresponds to 2 day-fines<\/strong>. <\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\" id=\"h-hinweis\">Note:<\/h4>\n\n<p class=\"wp-block-paragraph\">In the case of negligent endangerment, <strong>fines are common in practice<\/strong>, but in the case of serious consequences, <strong>imprisonment<\/strong> is also realistic.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-freiheitsstrafe-amp-teil-bedingte-nachsicht\">Imprisonment and (partially) suspended sentence<\/h2>\n\n<p class=\"wp-block-paragraph\">\u00a7 37 of the Criminal Code: If the statutory penalty threat reaches up to five years, the court can impose a <strong>fine<\/strong> instead of a short imprisonment of no more than one year.<\/p>\n\n<p class=\"wp-block-paragraph\">This possibility <strong>exists in principle in the case of negligent endangerment<\/strong>. The basic offense is threatened with <strong>imprisonment of up to one year or a fine<\/strong>. This opens up the scope of \u00a7 37 StGB <strong>.<\/strong> A substitution of a short prison sentence by a fine is <strong>legally possible<\/strong> and common in practice.   <\/p>\n\n<p class=\"wp-block-paragraph\">\u00a7 43 StGB: A prison sentence can be <strong>conditionally suspended<\/strong> if it <strong>does not exceed two years<\/strong> and a <strong>positive social prognosis<\/strong> exists.<\/p>\n\n<p class=\"wp-block-paragraph\">In the case of negligent endangerment, conditional remission is <strong>regularly possible<\/strong>, as the penalty is low and it is typically not intentional wrongdoing.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a7 43a StGB: The <strong>partially conditional remission<\/strong> allows a combination of <strong>unconditional and conditionally suspended part of the sentence<\/strong>.
