Act 1967<\/a><\/strong> in conjunction with <strong>Regulation (EU) No. 165\/2014<\/strong> exists if a <strong>legally required control device<\/strong> is either <strong>not installed<\/strong>, <strong>not type-approved<\/strong>, <strong>not functional<\/strong>, or <strong>not used properly<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Covered are both the <strong>operation of a vehicle subject to equipment requirements without a tachograph<\/strong> and the <strong>omission or incorrect use<\/strong> of an existing device, for example, due to <strong>missing records<\/strong>, <strong>non-use of the driver card<\/strong>, or <strong>unauthorized operating modes<\/strong>. It protects the health of drivers and contributes significantly to road safety. At the same time, it ensures that all companies in the transport sector work under comparable conditions.  <\/p>\n\n<p class=\"wp-block-paragraph\">The device automatically records relevant driving data. Control bodies can read and evaluate this data during inspections. The tachograph is therefore a central instrument for enforcing working time regulations in road traffic.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-begriffe-aus-der-praxis\">Practical terms<\/h3>\n\n<p class=\"wp-block-paragraph\">Different terms are used in practice. What is meant is always the same technical system: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Tachograph<\/li>\n\n\n\n<li>Tachograph<\/li>\n\n\n\n<li>EU control device<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">All these terms describe the control device that must be installed and used in certain vehicles.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-analoger-und-digitaler-fahrtenschreiber\">Analog and digital tachograph<\/h3>\n\n<p class=\"wp-block-paragraph\">A distinction is made between <strong>analog<\/strong> and <strong>digital tachographs<\/strong>.<br\/>Analog devices record data on paper discs. Digital devices store the data electronically on a driver card and in the device memory. <\/p>\n\n<p class=\"wp-block-paragraph\">Vehicles with an <strong>initial registration from May 2006<\/strong> must be equipped with a <strong>digital tachograph<\/strong>. Older vehicles may continue to be operated with analog devices, provided there is no retrofitting obligation. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-rechtliche-grundlage-der-fahrtenschreiberpflicht\">Legal basis of the tachograph obligation<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-warum-es-eine-fahrtenschreiberpflicht-gibt\">Why is there a tachograph obligation?<\/h3>\n\n<p class=\"wp-block-paragraph\">The obligation to use a tachograph is intended to prevent drivers from driving for too long or falling below legally required rest periods. This increases safety on the roads. At the same time, fair competition between companies should be guaranteed.  <\/p>\n\n<p class=\"wp-block-paragraph\">To achieve this goal, uniform rules apply within the European Union for road traffic.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-einheitliche-regeln-innerhalb-der-europaischen-union\">Uniform rules within the European Union<\/h3>\n\n<p class=\"wp-block-paragraph\">In the European Union, there are common requirements for <strong>in which vehicles a tachograph is required<\/strong> and <strong>how it is to be used<\/strong>. These rules apply primarily to vehicles in freight and passenger transport. <\/p>\n\n<p class=\"wp-block-paragraph\">As soon as a vehicle falls under these common requirements, a suitable control device must be used. It does not matter whether transports take place regularly or only occasionally. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-kontrolle-und-durchsetzung-in-osterreich\">Control and enforcement in Austria<\/h3>\n\n<p class=\"wp-block-paragraph\">In Austria, authorities monitor compliance with these requirements on the basis of the Motor Vehicle Act. This obligation applies regardless of whether transports are carried out for third parties or in one&#8217;s own company. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-personenverkehr-mit-omnibussen\">Passenger transport with buses<\/h3>\n\n<p class=\"wp-block-paragraph\">Also <strong>buses with more than eight seats<\/strong> are subject to the tachograph obligation. The aim is to control the working hours of drivers in scheduled and occasional transport <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-werkverkehr-und-untergeordnete-transporte\">Company transport and subordinate transports<\/h3>\n\n<p class=\"wp-block-paragraph\">The obligation also exists in principle in <strong>company transport<\/strong>, for example, when a company transports its own goods or work equipment. It is irrelevant whether these transports characterize the company&#8217;s purpose or only represent an ancillary service. <\/p>\n\n<ul class=\"wp-block-list\">\n<li><\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-technische-anforderungen-an-den-fahrtenschreiber\">Technical requirements for the tachograph<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-zulassigkeit-und-genehmigung\">Admissibility and approval<\/h3>\n\n<p class=\"wp-block-paragraph\">Only <strong>approved and authorized tachographs<\/strong> may be used. Devices without corresponding approval are legally considered non-existent. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-bedeutung-der-erstzulassung\">Importance of initial registration<\/h3>\n\n<p class=\"wp-block-paragraph\">The date of initial registration determines whether an analog or digital device is permissible. Vehicles with initial registration from May 2006 necessarily require a digital control device. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungen-und-kontrollen\">Tests and inspections<\/h3>\n\n<p class=\"wp-block-paragraph\">The tachograph must be <strong>checked every two years<\/strong>. In addition, a check is required after each repair and after each change in tire circumference. Companies must actively monitor these dates.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-technische-mangel-und-ihre-folgen\">Technical defects and their consequences<\/h3>\n\n<p class=\"wp-block-paragraph\">A defective or incorrectly set tachograph is considered not properly used. Technical defects do not relieve either drivers or companies if they could have been avoided. <\/p>\n\n<ul class=\"wp-block-list\">\n<li><\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-abweichung-zur-erreichung-eines-halteplatzes\">Deviation to reach a stopping place<\/h3>\n\n<p class=\"wp-block-paragraph\">If it is necessary for safety, the driver may <strong>deviate briefly from the time specifications<\/strong> in order to reach a suitable stopping place. The driver must <strong>document the reason and nature of the deviation<\/strong>, either in the tachograph or in the work records. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-fehlen-eines-typgenehmigten-fahrtenschreibers\">Absence of a type-approved tachograph<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-wann-ein-fahrtenschreiber-als-fehlend-gilt\">When is a tachograph considered missing?<\/h3>\n\n<p class=\"wp-block-paragraph\">A tachograph is legally considered missing if a vehicle <strong>has no control device installed<\/strong> despite an existing obligation. The same applies if a device is present, but it is <strong>not approved<\/strong> or <strong>not functional<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">For the authorities, it makes no difference whether the device was never installed or does not work due to a defect. In both cases, there is a serious violation <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-nichtbenutzung-des-fahrtenschreibers\">Non-use of the tachograph<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-begriff-der-nichtbenutzung\">Definition of non-use<\/h3>\n\n<p class=\"wp-block-paragraph\">Non-use exists if an existing tachograph is <strong>not used properly<\/strong>. Incorrect or missing entries regularly lead to administrative penalties. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-bedeutung-kollektivvertraglicher-regelungen\">Importance of collective agreement regulations<\/h3>\n\n<p class=\"wp-block-paragraph\">In addition to the legal requirements, the collective agreement regulates in detail which obligations drivers must comply with when dealing with analog and digital tachographs. These regulations are binding. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-pflichten-des-unternehmens\">Obligations of the company<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-einbau-und-funktionssicherheit\">Installation and functional safety<\/h3>\n\n<p class=\"wp-block-paragraph\">Companies must ensure that their vehicles are equipped with a <strong>properly functioning tachograph<\/strong>. They must have defects repaired immediately. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-einschulung-und-organisation\">Training and organization<\/h3>\n\n<p class=\"wp-block-paragraph\">Companies must <strong>demonstrably train<\/strong> their drivers. They must create clear organizational requirements so that records are made correctly. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-datenverwaltung\">Data management<\/h3>\n\n<p class=\"wp-block-paragraph\">Companies must regularly read out the recorded data, store it, and make it available for inspections.
