This is particularly the case if <strong>the perpetrator uses a weapon during the act<\/strong> or <strong>inflicts serious bodily harm on the victim<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>attack on property<\/strong> is associated with a <strong>significantly increased violence or danger component<\/strong>. Anyone who uses a weapon or seriously injures the victim is moving within a penalty range that regularly leaves no room for trivialization. \u201c<\/span>\n    <\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-objektiver-tatbestand\">objective elements of the offence<\/h2>\n\n<p class=\"wp-block-paragraph\">The <strong>objective element of the offense<\/strong> covers exclusively the <strong>externally perceptible event<\/strong>. The only thing that is decisive is what could be determined by a <strong>neutral observation<\/strong>, such as a camera: <strong>concrete actions, procedures, means used and consequences that have occurred<\/strong>. <strong>Internal processes<\/strong> such as intent, motives or intentions are not taken into account and do not belong to the objective element of the offense. <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>objective element of aggravated robbery<\/strong> initially requires that <strong>all the characteristics of the basic offense under \u00a7 142 StGB<\/strong> are met. Therefore, the <strong>taking away or extortion of a movable object belonging to another person<\/strong> is required by <strong>use of force against a person<\/strong> or by <strong>threatening with imminent danger to life or limb<\/strong>. The crucial point is that the perpetrator <strong>does not merely obtain<\/strong> the item, but <strong>takes it or has it procured under direct personal coercion<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Taking away<\/strong> exists if the perpetrator deprives the entitled party of <strong>actual control over the object<\/strong> and <strong>establishes new control over the object<\/strong> himself or through a third party. <strong>Extortion<\/strong> exists if the victim <strong>himself takes an action<\/strong> as a result of the violence or threat, through which the perpetrator receives the item. In both variants, it is decisive that the item comes <strong>under duress<\/strong> into the <strong>sphere of control of the perpetrator<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>means of the crime<\/strong> must be <strong>directed against a person<\/strong>. <strong>Violence<\/strong> must have a physical effect or aim directly at <strong>breaking the victim&#8217;s resistance<\/strong>. The <strong>threat<\/strong> must relate to an <strong>imminent danger to life or limb<\/strong> and be capable of causing <strong>justified fear<\/strong> in the victim. The <strong>coercion<\/strong> must be <strong>functionally linked to the taking away or extortion<\/strong> and <strong>enable or secure<\/strong> it.  <\/p>\n\n<p class=\"wp-block-paragraph\">The objective element of the offense is already fulfilled if the perpetrator gains <strong>even only short-term actual control over the object<\/strong>. <strong>Permanent possession<\/strong>, later use or economic benefit are <strong>not required<\/strong>. The <strong>focus of the injustice<\/strong> lies in the <strong>combination of interference with property and an immediate situation of violence or threat<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-qualifizierende-umstande\">Qualifying circumstances<\/h3>\n\n<p class=\"wp-block-paragraph\">Beyond the basic offense, <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a> requires <strong>additional objective qualification characteristics<\/strong> that significantly increase the injustice of the offense.<\/p>\n\n<p class=\"wp-block-paragraph\">A <strong>aggravated robbery according to \u00a7 143 para. 1 StGB <\/strong> exists objectively if<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>the perpetrator commits the robbery using a weapon<\/strong> or<\/li>\n\n\n\n<li><strong>acts as a member of a criminal organization with the participation of another member<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The <strong>use of a weapon<\/strong> requires that an object is used which, by its nature, <strong>is suitable for inflicting significant injuries<\/strong>, and that this object is <strong>functionally used in the crime to apply violence or threats<\/strong>. The <strong>participation within a criminal organization<\/strong> requires a <strong>coordinated cooperation of several members<\/strong> within the framework of a structure designed for a longer period of time. <\/p>\n\n<p class=\"wp-block-paragraph\">According to  <strong>\u00a7 143 para. 2 StGB <\/strong> a further objective qualification exists if the <strong>violence exerted<\/strong> leads to <strong>serious consequences of the crime<\/strong>. The decisive factor here is <strong>the consequences that have actually occurred<\/strong>, not just the dangerousness of the procedure. <\/p>\n\n<p class=\"wp-block-paragraph\">Covered in particular are<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>serious bodily harm<\/strong>,<\/li>\n\n\n\n<li><strong>bodily harm with serious permanent consequences<\/strong> or<\/li>\n\n\n\n<li><strong>the death of a person<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">These consequences must be <strong>causally attributable to the use of force in the context of the robbery<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungsschritte\">Steps of legal assessment<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatsubjekt\">Perpetrator:<\/h4>\n\n<p class=\"wp-block-paragraph\">The subject of the crime can be <strong>any person who is criminally responsible<\/strong>. No special personal characteristics are required. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatobjekt\">Object of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The object of the crime is a <strong>movable object belonging to another person with asset value<\/strong>, which <strong>is not the sole property of the perpetrator<\/strong> and can actually be <strong>taken away or extorted<\/strong>.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tathandlung\">Act: <\/h4>\n\n<p class=\"wp-block-paragraph\">The act consists of the <strong>taking away or extortion<\/strong> of the item <strong>using force or qualified threat<\/strong>, supplemented by the <strong>qualifying circumstances of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong> such as <strong>use of weapons<\/strong>, <strong>participation within a criminal organization<\/strong> or <strong>serious consequences of the crime<\/strong>.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-taterfolg\">Result of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The success of the crime lies in the <strong>acquisition of actual control over the object<\/strong> by the perpetrator and the <strong>loss of control over the object by the entitled party<\/strong>. <strong>Short-term control<\/strong> is sufficient.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-kausalitat\">Causality:<\/h4>\n\n<p class=\"wp-block-paragraph\">The taking away or extortion must be <strong>causally attributable to the violence or threat<\/strong>. The <strong>focus of the injustice<\/strong> lies in the <strong>functional link between a property offense and direct personal coercion<\/strong>. The decisive factor is not only the deprivation of assets, but the <strong>concrete endangerment of the physical integrity<\/strong> of the victim <strong>at the time of the taking away or extortion<\/strong>.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/robbery-by-theft\/\" title=\"Robbery by theft\">\u00a7 131 StGB<\/a> \u2013 Robbery-related theft<\/strong>: The delimitation is based on the <strong>time of the use of force<\/strong>. In the case of <strong>robbery<\/strong>, the perpetrator uses <strong>violence or qualified threat already to obtain the item<\/strong>. In the case of <strong>robbery-related theft<\/strong>, the perpetrator <strong>initially commits a theft without violence<\/strong> and applies <strong>violence only after the taking away has been completed<\/strong> or threatens with <strong>imminent danger to life or limb<\/strong> in order to <strong>obtain, secure the loot or enable the escape<\/strong>.  <\/li>\n\n\n\n<li><strong>\u00a7 144 StGB \u2013 Extortion:<\/strong> The <strong>extortion<\/strong> differs from robbery by the <strong>point of attack of the crime<\/strong>. While in the case of <strong>robbery<\/strong> the <strong>movable object belonging to another person is obtained directly under duress<\/strong>, the extortion is directed at an <strong>action, toleration or omission<\/strong> of the victim, through which <strong>the financial disadvantage is only brought about<\/strong>. The damage arises <strong>indirectly through the behavior of the coerced person<\/strong>, not through a direct access of the perpetrator to the thing.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-konkurrenzen\">Concurrences:<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-echte-konkurrenz\">Genuine Concurrence: <\/h4>\n\n<p class=\"wp-block-paragraph\">Genuine concurrence exists if further independent offenses are added to the <strong>aggravated robbery<\/strong>, such as <strong>property damage<\/strong>, <strong>bodily harm<\/strong>, <strong>trespassing<\/strong> or <strong>dangerous threat<\/strong>. The aggravated robbery retains its independent content of injustice, as different legal interests are violated. The offenses stand side by side, provided that no displacement occurs.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-unechte-konkurrenz\">Spurious Concurrence:<\/h4>\n\n<p class=\"wp-block-paragraph\">A displacement due to <strong>specialty<\/strong> comes into consideration if another element of the offense completely covers the entire content of injustice of the aggravated robbery. This is particularly the case in cases in which the increased potential for violence or the serious consequences of the crime constitute a <strong>qualitatively increased form of appearance<\/strong>. In these cases, the basic offense recedes.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatmehrheit\">Multiple Offenses: <\/h4>\n\n<p class=\"wp-block-paragraph\">Multiple offenses exist if several <strong>robbery acts<\/strong> are committed independently, such as in the case of temporally separated attacks or with different objects of the crime. Each act forms its own criminal unit, provided that there is no natural unit of action. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-fortgesetzte-handlung\">Continued Action: <\/h4>\n\n<p class=\"wp-block-paragraph\">A uniform act can be assumed if several <strong>acts of coercion and deprivation of property<\/strong> are directly related and are supported by a <strong>uniform intent<\/strong>, such as in the case of several accesses within the same plan of action. The decisive factor is initially the proof that the entitled party <strong>a movable object belonging to another person<\/strong> under <strong>use of force against a person<\/strong> or by <strong>threatening with imminent danger to life or limb<\/strong> was <strong>taken away or extorted<\/strong>. The decisive factor is not only the deprivation of assets, but in particular the <strong>direct coercion on a person<\/strong> in connection with the acquisition of the item.  <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, it must be proven that <strong>qualifying circumstances of aggravated robbery<\/strong> have been realized, such as <strong>the use of a weapon<\/strong>, <strong>the participation of several perpetrators within the framework of a criminal organization<\/strong> or <strong>the occurrence of serious consequences of the crime<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">It must be proven, in particular, that<\/p>\n\n<ul class=\"wp-block-list\">\n<li>a taking away or extortion actually took place,<\/li>\n\n\n\n<li>the object belonged to someone else, i.e., was not exclusively owned by the accused,<\/li>\n\n\n\n<li>violence against a person or a qualified threat was used,<\/li>\n\n\n\n<li>the coercion was functionally linked to the acquisition of the item,<\/li>\n\n\n\n<li>the entitled party has consequently lost actual control over the item,<\/li>\n\n\n\n<li>the accused himself or through a third party has established new custody, even if this was only for a short time,<\/li>\n\n\n\n<li>the interference with property is causally attributable to the violence or threat,<\/li>\n\n\n\n<li>additionally a <strong>qualification characteristic of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong> exists, such as <strong>use of weapons<\/strong>, <strong>organized commission of the crime<\/strong> or <strong>serious injury consequences<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The public prosecutor&#8217;s office must also present whether the alleged use of force, threat, taking away and the respective <strong>qualification characteristic<\/strong> are objectively ascertainable.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-gericht\">Court: <\/h3>\n\n<p class=\"wp-block-paragraph\">The court examines all evidence in the <strong>overall context<\/strong> and assesses whether, according to objective standards, <strong>a robbery with qualifying circumstances of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong> exists. The focus is on the question of whether <strong>violence or threat directed against a person<\/strong> was used, whether this was <strong>causal and functional for the deprivation of assets<\/strong> and whether the accused thereby <strong>actual control over the item<\/strong> has obtained. <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, the court examines whether the <strong>aggravating circumstances<\/strong> of aggravated robbery were actually realized and are <strong>objectively attributable<\/strong> to the accused.<\/p>\n\n<p class=\"wp-block-paragraph\">In doing so, the court takes into account in particular<\/p>\n\n<ul class=\"wp-block-list\">\n<li>type, intensity and course of the use of force or threat,<\/li>\n\n\n\n<li>temporal connection between coercion and deprivation of assets,<\/li>\n\n\n\n<li>custody relationships before and after the incident,<\/li>\n\n\n\n<li>type and manner of use of an alleged weapon or dangerous instrument,<\/li>\n\n\n\n<li>participation of other perpetrators and their cooperation,<\/li>\n\n\n\n<li>type and severity of injuries or consequences of the crime that have occurred,<\/li>\n\n\n\n<li>witness statements on the course of the act and the participation of the accused,<\/li>\n\n\n\n<li>Video recordings, medical documentation or other objective evidence,<\/li>\n\n\n\n<li>circumstances that suggest an imminent danger to life or limb,<\/li>\n\n\n\n<li>whether a reasonable average person would assume a <strong>coercion-induced surrender or taking away under increased endangerment<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The court clearly distinguishes between <strong>mere intimidation without coercive quality<\/strong>, <strong>purely verbal conflicts<\/strong>, <strong>simple forms of robbery without qualification<\/strong> and situations in which the <strong>aggravating conditions of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong> are not demonstrable.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-beschuldigte-person\">Accused Person: <\/h3>\n\n<p class=\"wp-block-paragraph\">The accused person bears <strong>no burden of proof<\/strong>. He demands the immediate surrender of the wallet and announces that he will stab if there is resistance. Fearing serious injury, the victim hands over the wallet with cash and identification documents. The perpetrator thereby gains new actual control over the movable object belonging to another person. The decisive factor is that the taking away does not only take place under threat of imminent danger to life or limb, but also using a weapon. This not only fulfills the element of robbery, but also the qualification of aggravated robbery.     <\/li>\n\n\n\n<li><strong>Taking with the use of force resulting in serious injury:<\/strong> In the course of a robbery, the perpetrator repeatedly punches a victim in the face, causing them to fall to the ground and sustain a serious injury. While the victim is lying on the ground dazed, the perpetrator takes their bag and flees. The deprivation of assets is directly related to the violence previously used. It is essential that the use of force not only serves the purpose of the taking but also leads to serious bodily injury. This constitutes a particularly qualified form of aggravated robbery.    <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">These examples illustrate that <strong>in aggravated robbery, circumstances are added beyond the basic offense<\/strong> that <strong>significantly increase the potential for violence or endangerment<\/strong> or lead to <strong>serious consequences of the crime<\/strong>. The <strong>focus of the injustice<\/strong> lies <strong>not solely in the deprivation of assets<\/strong>, but in the <strong>particularly intensive endangerment of the victim&#8217;s life or limb<\/strong> or in the <strong>serious consequences of the use of force<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-subjektiver-tatbestand\">subjective elements of the offence<\/h2>\n\n<p class=\"wp-block-paragraph\">The subjective element of <strong>aggravated robbery<\/strong> requires <strong>intent with regard to all objective elements of the robbery<\/strong>. The perpetrator must know that <strong>by using force against a person or by threatening imminent danger to life or limb<\/strong>, they are <strong>taking or extorting<\/strong> a <strong>movable object belonging to another<\/strong> and <strong>depriving<\/strong> the entitled party of <strong>actual control over the object<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">For intent, it is sufficient that the perpetrator <strong>seriously considers the possibility of force or qualified threat<\/strong> as well as the <strong>taking or extortion<\/strong> and <strong>accepts it<\/strong>. <strong>Conditional intent is sufficient<\/strong>. The intent must also relate to the fact that the <strong>use of coercion is functionally linked to the deprivation of assets<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, aggravated robbery requires an <strong>intent to enrich oneself<\/strong>. The perpetrator must at least tacitly accept obtaining an <strong>unlawful financial advantage<\/strong> for themselves or a third party through the <strong>appropriation of the item<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">Beim <strong>\u00a7 143 Abs. 1 StGB <\/strong>  the intent must also relate to the <strong>qualifying element of the offense<\/strong>, such as the <strong>use of a weapon<\/strong> or <strong>participation within a criminal organization<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Bei den <strong>schweren Tatfolgen nach \u00a7 143 Abs. 2 StGB <\/strong>  is <strong>no intent required with regard to the consequence of the injury<\/strong>. Anyone who engages in conduct that <strong>recognizably interferes with the rights of others<\/strong> cannot claim that they did not recognize the illegality. Everyone is obliged to inform themselves about the <strong>legal limits<\/strong> of their actions. Mere ignorance or a reckless error does not absolve one of responsibility.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Principle of culpability:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Only those who act <strong>culpably<\/strong> are punishable. Intentional offenses require that the perpetrator recognizes the essential events and at least <strong>accepts them as a possibility<\/strong>. If this intent is lacking, for example, because the perpetrator mistakenly assumes that their behavior is permitted or is <strong>voluntarily supported<\/strong>, at most negligence exists. This is not sufficient for intentional offenses.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Incapacity to be held accountable:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">No guilt is attributed to someone who, at the time of the offense, was unable to recognize the injustice of their actions or to act in accordance with this insight due to a <strong>severe mental disorder<\/strong>, a <strong>pathological mental impairment<\/strong>, or a <strong>significant inability to control their actions<\/strong>. In case of corresponding doubts, a <strong>psychiatric assessment<\/strong> will be obtained. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/exculpatory-necessity\/\">Excusable state of necessity<\/a>:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">An excusable state of necessity may exist if the perpetrator acts in an <strong>extreme situation of duress<\/strong> in order to avert an <strong>acute danger<\/strong> to their own life or the lives of others. The behavior remains unlawful but can have a <strong>mitigating<\/strong> or excusing effect if there was no other way out. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/erroneous-assumption-of-justifying-circumstances\/\">Putative self-defense<\/a>:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Anyone who mistakenly believes that they are entitled to an act of defense acts without intent if the error was <strong>serious and comprehensible<\/strong>. Such an error can <strong>reduce or exclude guilt<\/strong>. However, if a breach of duty of care remains, a negligent or mitigating assessment comes into consideration, but not a justification.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafaufhebung-amp-diversion\">Extinction of punishment and diversion<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-diversion\">Diversion:<\/h3>\n\n<p class=\"wp-block-paragraph\">A <strong>diversion is excluded in the case of aggravated robbery pursuant to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong>. The offense requires <strong>qualified use of force<\/strong>, <strong>the use of a weapon<\/strong>, <strong>organized commission of the offense<\/strong>, or <strong>serious consequences of the offense<\/strong>, and thus exhibits a <strong>particularly high degree of personal injustice<\/strong>. The <strong>significant potential for violence and endangerment<\/strong> does <strong>not allow<\/strong> a diversionary settlement.  <\/p>\n\n<p class=\"wp-block-paragraph\">While in the case of <strong>robbery pursuant to \u00a7 142 StGB<\/strong>, a diversion can <strong>theoretically only be examined in narrowly limited exceptional cases<\/strong>, it is ruled out in the case of <strong>aggravated robbery<\/strong> due to the <strong>legal qualification<\/strong> and the <strong>significant minimum penalty threat<\/strong>. Already the <strong>realization of a qualification characteristic according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong> leads to the fact that <strong>neither guilt nor consequences of the crime are to be classified as minor<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">A diversion is therefore <strong>not an option<\/strong> if<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>a weapon was used<\/strong>,<\/li>\n\n\n\n<li><strong>the crime was committed as a member of a criminal organization<\/strong>,<\/li>\n\n\n\n<li><strong>serious bodily injury resulted from the use of force<\/strong>, <strong>serious permanent consequences<\/strong>, or <strong>the death of a person<\/strong>,<\/li>\n\n\n\n<li>the crime scene exhibits a <strong>significant potential for endangerment to life or limb<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In these constellations, a <strong>diversionary settlement is legally excluded<\/strong>. Measures such as <strong>monetary payments<\/strong>, <strong>community service<\/strong>, <strong>supervision instructions<\/strong>, or <strong>victim-offender mediation<\/strong> are <strong>not permitted<\/strong>. A <strong>formal criminal procedure with a guilty verdict is mandatory<\/strong>.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ausschluss-der-diversion\">Exclusion of Diversion:<\/h3>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>aggravated robbery pursuant to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong>, the <strong>exclusion of diversion exists by law<\/strong>. The <strong>increased level of violence<\/strong>, the <strong>particular dangerousness of the means of committing the crime<\/strong>, or the <strong>serious consequences of the crime<\/strong> preclude classification as a <strong>minor or diversion-suitable offense<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">Even with <strong>comprehensive confession<\/strong>, <strong>restitution<\/strong>, or <strong>remorse on the part of the perpetrator<\/strong>, there is <strong>no room for diversion<\/strong>. What is decisive is <strong>how severely the victim&#8217;s life or limb was endangered or injured<\/strong>, whether <strong>weapons were used<\/strong>, <strong>multiple perpetrators were involved<\/strong>, or <strong>serious injuries<\/strong> occurred. The <strong>asset aspect is significantly less important than the violence component<\/strong>, but remains relevant for the overall assessment.  <\/p>\n\n<p class=\"wp-block-paragraph\">Of particular importance is whether the perpetrator acted in a <strong>targeted, planned, or organized<\/strong> manner, whether the crime was <strong>spontaneous or prepared<\/strong>, and what <strong>potential for endangerment<\/strong> existed for the victim. In the case of \u00a7 143 Abs. 2 StGB, the <strong>resulting consequences of the injury<\/strong> are the central penalty assessment factor.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-erschwerungsgrunde-bestehen-insbesondere-wenn\">Aggravating Factors Exist in Particular If<\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>a weapon was used<\/strong> or particularly dangerous violence was applied,<\/li>\n\n\n\n<li><strong>several perpetrators knowingly cooperated<\/strong>, especially within the framework of a <strong>criminal organization<\/strong>,<\/li>\n\n\n\n<li>the victim was <strong>seriously injured<\/strong>, <strong>permanently harmed<\/strong>, or <strong>killed<\/strong>,<\/li>\n\n\n\n<li>there was a <strong>high degree of brutality or ruthlessness<\/strong>,<\/li>\n\n\n\n<li>the perpetrator acted in a <strong>targeted or planned<\/strong> manner,<\/li>\n\n\n\n<li>the victim was particularly defenseless or at the mercy of the perpetrator,<\/li>\n\n\n\n<li>relevant <strong>prior convictions<\/strong> exist.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-milderungsgrunde-sind-etwa\">Mitigating Factors Include<\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>a clean record<\/strong>,<\/li>\n\n\n\n<li>an <strong>early, comprehensive confession<\/strong>,<\/li>\n\n\n\n<li>recognizable <strong>remorse and insight<\/strong>,<\/li>\n\n\n\n<li><strong>active restitution<\/strong>, as far as possible,<\/li>\n\n\n\n<li>a <strong>subordinate participation in the crime<\/strong> in the case of joint perpetration,<\/li>\n\n\n\n<li>an <strong>excessively long duration of proceedings<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Due to the <strong>high statutory penalty threat<\/strong>, the scope for mitigations is limited. A <strong>conditional remission of sentence<\/strong> is only considered if the imposed penalty framework allows this and a <strong>positive social prognosis<\/strong> exists. In the case of the qualifications of \u00a7 143 Abs. 2 StGB, a conditional remission is <strong>regularly excluded<\/strong>.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafrahmen\">Penalty Range<\/h2>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>aggravated robbery<\/strong>, the law provides for <strong>clearly graduated prison sentences<\/strong>, which are based on the <strong>nature of the qualification<\/strong> and the <strong>consequences of the use of force<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">If a robbery is committed <strong>under particularly dangerous circumstances<\/strong>, for example, because <strong>a weapon is used<\/strong> or <strong>several perpetrators cooperate in an organized manner<\/strong>, the penalty framework is <strong>at least one year and at most fifteen years imprisonment<\/strong>. Already these forms of commission are considered so dangerous that a milder punishment is excluded. <\/p>\n\n<p class=\"wp-block-paragraph\">If the use of force leads to <strong>serious physical injuries<\/strong>, the penalty framework increases significantly. In these cases, a <strong>prison sentence of at least five years up to fifteen years<\/strong> is threatened. The legislator assumes here that the attack on physical integrity is particularly serious.  <\/p>\n\n<p class=\"wp-block-paragraph\">If <strong>serious permanent consequences<\/strong> result from the crime, such as permanent health damage, the penalty framework is <strong>ten to twenty years imprisonment<\/strong>. The crime is assessed in these constellations as a particularly serious violent crime. <\/p>\n\n<p class=\"wp-block-paragraph\">If the use of force <strong>results in the death of a person<\/strong>, the penalty threat ranges from <strong>ten to twenty years imprisonment<\/strong> or even up to <strong>life imprisonment<\/strong>. In these cases, the focus is no longer on the property damage, but on the <strong>fatal attack on life and limb<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-geldstrafe-tagessatzsystem\">Monetary Penalty \u2013 Day-fine System<\/h2>\n\n<p class=\"wp-block-paragraph\">Austrian criminal law calculates monetary penalties according to the <strong>day-fine system<\/strong>. The <strong>number of day-fines<\/strong> depends on the <strong>guilt<\/strong>, the <strong>amount per day<\/strong> depends on the <strong>financial capacity<\/strong>. In this way, the penalty is adapted to the personal circumstances and yet remains noticeable.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Range:<\/strong> up to <strong>720 daily rates<\/strong> \u2013 at least <strong>\u20ac4<\/strong>, maximum <strong>\u20ac5,000<\/strong> per day.<\/li>\n\n\n\n<li><strong>Practical formula:<\/strong> Approximately <strong>6 months imprisonment corresponds to around 360 day-fines<\/strong>. This conversion serves only as <strong>orientation<\/strong> and is <strong>not a rigid scheme<\/strong>. <\/li>\n\n\n\n<li><strong>In case of non-payment:<\/strong> The court can impose a <strong>substitute custodial sentence<\/strong>. As a rule, the following applies: <strong>1 day of substitute custodial sentence corresponds to 2 day-fines<\/strong>. <\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\" id=\"h-hinweis\">Note:<\/h4>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>aggravated robbery pursuant to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong>, a <strong>monetary penalty is not provided for<\/strong>. Due to the <strong>mandatory minimum prison sentences<\/strong>, the <strong>day-fine system is not applied<\/strong>. A <strong>pure monetary penalty is excluded<\/strong>.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-freiheitsstrafe-amp-teil-bedingte-nachsicht\">Imprisonment and (partially) suspended sentence<\/h2>\n\n<p class=\"wp-block-paragraph\">\u00a7 37 StGB: If the statutory penalty threat ranges <strong>up to five years<\/strong>, the court may impose a <strong>monetary penalty<\/strong> instead of a short prison sentence of at most one year. <\/p>\n\n<p class=\"wp-block-paragraph\">This possibility <strong>does not exist in the case of aggravated robbery pursuant to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=143&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 143 StGB<\/a><\/strong>. Aggravated robbery in all variants is threatened with <strong>minimum prison sentences of at least one year<\/strong>, and even significantly more in the case of serious consequences of the crime. Thus, the scope of application of \u00a7 37 StGB is <strong>excluded from the outset<\/strong>. A replacement of the prison sentence with a monetary penalty is <strong>legally not an option<\/strong>.   <\/p>\n\n<p class=\"wp-block-paragraph\">\u00a7 43 StGB: A prison sentence can be <strong>conditionally suspended<\/strong> if it <strong>does not exceed two years<\/strong> and the perpetrator has a <strong>positive social prognosis<\/strong>. In the case of <strong>aggravated robbery<\/strong>, this possibility is  <strong>nur theoretisch im untersten Bereich der Strafdrohung nach \u00a7 143 Abs. 1 StGB <\/strong>  conceivable only theoretically in the lowest range of the penalty threat according to \u00a7 143 Abs. 1 StGB. In practice, a conditional remission is granted <strong>extremely cautiously<\/strong>, as the offense already requires <strong>qualified violence<\/strong>, <strong>use of weapons<\/strong>, or <strong>organized commission of the offense<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>serious consequences of the crime<\/strong> according to \u00a7 143 Abs. 2 StGB with minimum penalties of <strong>five or ten years<\/strong>, a conditional remission of sentence is <strong>legally excluded<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">\u00a7 43a StGB: The <strong>partially conditional remission<\/strong> allows a combination of <strong>unconditional and conditionally suspended parts of the sentence<\/strong>. It is possible for penalties <strong>over six months and up to two years<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">In the case of aggravated robbery, this possibility is considered <strong>only in rare exceptional cases<\/strong> of \u00a7 143 Abs. 1 StGB, if the <strong>sentence commensurate with guilt is just over six months<\/strong>, no serious consequences of the crime have occurred, and exceptionally favorable circumstances of the perpetrator exist. <\/p>\n\n<p class=\"wp-block-paragraph\">In all forms of aggravated robbery with an <strong>increased minimum prison sentence<\/strong>, a partially conditional remission is <strong>regularly excluded<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/probation-assistance-and-instructions\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7\u00a7 50 to 52 StGB:<\/a> The court may issue <strong>instructions<\/strong> and order <strong>probation assistance<\/strong>. These concern, for example, <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>restitution<\/strong>,<\/li>\n\n\n\n<li><strong>contact or approach bans<\/strong>,<\/li>\n\n\n\n<li><strong>behavioral training<\/strong> or<\/li>\n\n\n\n<li><strong>structuring measures to prevent relapse<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In the case of aggravated robbery, such measures are considered <strong>only supplementary<\/strong> and <strong>exclusively within the framework of a (partially) conditional remission of sentence<\/strong>. They cannot <strong>replace<\/strong> the prison sentence, but only accompany it. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-zustandigkeit-der-gerichte\">Jurisdiction of the courts<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-sachliche-zustandigkeit\">Subject-matter Jurisdiction<\/h3>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>aggravated robbery<\/strong>, <strong>only the Regional Court<\/strong> has jurisdiction. What is decisive is <strong>where the violence was used or the threat was uttered<\/strong> and <strong>where the deprivation of assets was realized<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">If the place of the offense cannot be clearly determined, the jurisdiction is based on<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the <strong>residence of the accused person<\/strong>,<\/li>\n\n\n\n<li>the <strong>place of arrest<\/strong>,<\/li>\n\n\n\n<li>or the <strong>seat of the competent public prosecutor&#8217;s office<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The proceedings are conducted where a <strong>practical and orderly implementation<\/strong> is best guaranteed.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-instanzenzug\">Hierarchy of Courts<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Appeals and nullity complaints<\/strong> are permitted against judgments of the <strong>Regional Court as a court of lay assessors or a jury court<\/strong>. The <strong>Supreme Court<\/strong> is responsible for the decision on these legal remedies, provided that the legal requirements are met. <\/p>\n\n<p class=\"wp-block-paragraph\">Preliminary decisions and resolutions can be brought before the <strong>Higher Regional Court<\/strong> within the framework of the legal provisions.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-zivilanspruche-im-strafverfahren\">Civil claims in criminal proceedings<\/h2>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>aggravated robbery<\/strong>, the injured person as a <strong>private party<\/strong> can assert their <strong>civil law claims directly in the criminal proceedings<\/strong>. Since the aggravated robbery also concerns the <strong>unauthorized removal of a movable object belonging to another<\/strong> through the use of force or qualified threat, the claims relate in particular to the <strong>value of the object<\/strong>, <strong>replacement costs<\/strong>, <strong>loss of use<\/strong>, <strong>loss of use advantage<\/strong>, as well as <strong>further property damage<\/strong> that has arisen as a result of the crime. <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, <strong>consequential damages<\/strong> can be demanded to be replaced, for example, if the deprivation of assets is associated with <strong>physical injuries<\/strong>, <strong>medical treatment costs<\/strong>, <strong>loss of earnings<\/strong> or other <strong>direct consequences of the crime<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>private party connection<\/strong> inhibits the <strong>statute of limitations<\/strong> of the asserted claims as long as the criminal proceedings are pending. After a legally binding conclusion, the statute of limitations only continues to run insofar as the claims have not been awarded. <\/p>\n\n<p class=\"wp-block-paragraph\">A <strong>voluntary compensation<\/strong>, such as the <strong>return of the item<\/strong> or <strong>compensation for the damage<\/strong>, may have a mitigating effect if it is carried out <strong>promptly and earnestly<\/strong>.
