I mods\u00e6tning til tvangsforvaltning, der omfatter de l\u00f8bende indt\u00e6gter fra en ejendom, og tvangsauktion, der har til form\u00e5l at s\u00e6lge ejendommen, giver tvangsfuldbyrdelse af pantebrev kreditor <strong>en tvangsfuldbyrdelsesret<\/strong>, men <strong>ingen \u00f8jeblikkelig betaling<\/strong>. <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Eksekutionsmidlet er reguleret i <strong><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001700&amp;Artikel=&amp;Paragraf=88&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 88 EO<\/a><\/strong>. Pantebrevet registreres p\u00e5 hans ejendom og sikrer den ud\u00f8vende kreditors krav. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-exekutionsantrag\">Eksekutionsbeg\u00e6ring<\/h2>\n\n<p class=\"wp-block-paragraph\">Tvangsstiftelsen af pantebrevet indledes med en <strong>eksekutionsbeg\u00e6ring<\/strong>. Eksekutionen sker ved tinglysning af pantebrevet p\u00e5 den p\u00e5g\u00e6ldende ejendom tilh\u00f8rende skyldneren.  <\/p>\n\n<p class=\"wp-block-paragraph\">Kompetent for godkendelse og fuldbyrdelse er den byret, der administrerer tingbogen for den p\u00e5g\u00e6ldende ejendom. Afg\u00f8relsen om tvangsstiftelse af pantebrevet tr\u00e6ffes af retsassistenten. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-vollzug\">Fuldbyrdelse<\/h2>\n\n<p class=\"wp-block-paragraph\">Fuldbyrdelsen sker ved tinglysning af pantebrevet i tingbogen. I den forbindelse betegnes det krav, som pantebrevet er registreret for, udtrykkeligt som tvangsfuldbyrdelsesberettiget. <\/p>\n\n<p class=\"wp-block-paragraph\">Tinglysningen af pantebrevet har den virkning, at kreditor ogs\u00e5 kan h\u00e5ndh\u00e6ve sit krav over for senere ejere af ejendommen ved tvangsfuldbyrdelse. Pantebrevet bevares s\u00e5ledes ved ejerskifte. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-aufhebung-oder-einschrankung\">Oph\u00e6velse eller begr\u00e6nsning <\/h3>\n\n<p class=\"wp-block-paragraph\">Skyldneren kan anmode om, at det tvangsstiftede pantebrev oph\u00e6ves eller begr\u00e6nses, hvis kreditor derved opn\u00e5r en st\u00f8rre sikkerhed, end loven foreskriver.<\/p>\n\n<p class=\"wp-block-paragraph\">En begr\u00e6nsning kan is\u00e6r betyde, at pantebrevet kun begr\u00e6nses til enkelte ejendomme eller bygninger p\u00e5 fremmed grund.
