St\u00edm je spojeno pr\u00e1vo vlastn\u00edka bytu v\u00fdlu\u010dn\u011b u\u017e\u00edvat ur\u010dit\u00fd byt vt\u00e9to nemovitosti.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Jak vznik\u00e1 vlastnictv\u00ed bytu?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Vlastnictv\u00edm bytu se rozum\u00ed pr\u00e1vo spoluvlastn\u00edka budovy zapsan\u00e9 vpozemkov\u00e9 knize v\u00fdlu\u010dn\u011b u\u017e\u00edvat asamostatn\u011b disponovat sbytovou jednotkou, obchodn\u00edm prostorem nebo gar\u00e1\u017e\u00ed, kter\u00e1 se vn\u00ed nach\u00e1z\u00ed. <\/p>\n\n<p class=\"wp-block-paragraph\">Existuj\u00ed zde zvl\u00e1\u0161tn\u00ed ustanoven\u00ed, kter\u00e1 jsou upravena vz\u00e1kon\u011b o vlastnictv\u00ed byt\u016f (WEG). Vlastnictv\u00ed bytu vznik\u00e1 v\u011bt\u0161inou p\u0159i nov\u00e9 v\u00fdstavb\u011b obytn\u00e9ho domu. Krom\u011b toho m\u016f\u017ee b\u00fdt vlastnictv\u00ed bytu zalo\u017eeno pouze pro fyzickou nebo pr\u00e1vnickou osobu nebo vlastnick\u00e9 partnerstv\u00ed dvou osob.  <\/p>\n\n<p class=\"wp-block-paragraph\">Nejprve mus\u00ed p\u0159\u00edslu\u0161n\u00fd stavebn\u00ed \u00fa\u0159ad, p\u0159\u00edpadn\u011b znalec stanovit po\u010det byt\u016f vosobn\u00edm vlastnictv\u00ed. Zpravidla se tak d\u011bje na z\u00e1klad\u011b ji\u017e schv\u00e1len\u00fdch stavebn\u00edch pl\u00e1n\u016f ana \u017e\u00e1dost vlastn\u00edka, p\u0159\u00edpadn\u011b kupuj\u00edc\u00edho.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Znaleck\u00fd posudek o u\u017eitn\u00e9 hodnot\u011b<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Po pod\u00e1n\u00ed \u017e\u00e1dosti se vypracuje znaleck\u00fd posudek o u\u017eitn\u00e9 hodnot\u011b. Vn\u011bm se stanov\u00ed, kolik pod\u00edl\u016f na nemovitosti je spojeno sjednotliv\u00fdmi byty. U\u017eitn\u00e1 hodnota bytu se p\u0159itom stanov\u00ed na z\u00e1klad\u011b u\u017eitn\u00e9 plochy.   <\/p>\n\n<p class=\"wp-block-paragraph\">Krom\u011b toho se vypo\u010d\u00edt\u00e1vaj\u00ed p\u0159ir\u00e1\u017eky asr\u00e1\u017eky za okolnosti, kter\u00e9 zvy\u0161uj\u00ed nebo sni\u017euj\u00ed hodnotu. Tyto okolnosti mohou vypl\u00fdvat nap\u0159. zvelikosti, stavu vybaven\u00ed, polohy bytu nebo zjin\u00fdch skute\u010dnost\u00ed.  <\/p>\n\n<p class=\"wp-block-paragraph\">Po stanoven\u00ed u\u017eitn\u00e9 hodnoty m\u016f\u017ee b\u00fdt uzav\u0159ena smlouva o vlastnictv\u00ed bytu.
