Obnoven\u00ed hranice zem\u011bm\u011b\u0159i\u010dsk\u00fdm \u00fa\u0159adem <strong><\/strong>  na \u017e\u00e1dost vlastn\u00edka na z\u00e1klad\u011b podklad\u016f katastru nemovitost\u00ed. <\/p>\n\n<p>Pokud hroz\u00ed, \u017ee se hranice stanou neznateln\u00fdmi, nebo pokud jsou hranice ji\u017e neznateln\u00e9 nebo sporn\u00e9, pak obnoven\u00ed hranic zahrnuje nov\u00e9 vyzna\u010den\u00ed pevn\u011b stanoven\u00e9 hranice. P\u0159itom se rozli\u0161uje mezi obnovou hranic a opravou hranic. Obnova hranic se t\u00fdk\u00e1 nov\u00e9ho vyzna\u010den\u00ed pevn\u011b stanoven\u00e9 hranice, zat\u00edmco oprava hranic m\u00e1 za c\u00edl nastolen\u00ed spr\u00e1vn\u00e9 hranice odpov\u00eddaj\u00edc\u00ed pr\u00e1vn\u00edmu stavu.<\/p>\n\n<p>\u0158\u00edzen\u00ed o obnoven\u00ed hranic je zah\u00e1jeno zem\u011bm\u011b\u0159i\u010dsk\u00fdm \u00fa\u0159adem  <strong><\/strong> na \u017e\u00e1dost vlastn\u00edka pozemku. Toto \u0159\u00edzen\u00ed mus\u00ed b\u00fdt provedeno do jednoho roku od pod\u00e1n\u00ed \u017e\u00e1dosti. K tomuto \u00fakonu mus\u00ed b\u00fdt z\u00fa\u010dastn\u011bn\u00ed vlastn\u00edci pozv\u00e1ni. <\/p>\n\n<p>Obnoven\u00e1 hranice mus\u00ed b\u00fdt \u017eadatelem ozna\u010dena zp\u016fsobem, kter\u00fd stanov\u00ed \u00a7 845 obecn\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku (ABGB).<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-grenzverhandlungen-durch-das-va-mrop-lp-rarad-name\">Jedn\u00e1n\u00ed o hranic\u00edch prost\u0159ednictv\u00edm VA <\/h3>\n\n<p>Jedn\u00e1n\u00ed o hranic\u00edch je postup pro stanoven\u00ed hranic pozemk\u016f podle \u00a7\u00a7 24 a 25 rakousk\u00e9ho z\u00e1kona o zem\u011bm\u011b\u0159ictv\u00ed (VermG). C\u00edlem jedn\u00e1n\u00ed o hranic\u00edch je dohodou stanovit hranice mezi dot\u010den\u00fdmi vlastn\u00edky nemovitost\u00ed a ozna\u010dit je pro n\u00e1sledn\u00e9 zam\u011b\u0159en\u00ed.<\/p>\n\n<p>P\u0159itom jsou z\u00fa\u010dastn\u011bn\u00ed vlastn\u00edci zem\u011bm\u011b\u0159i\u010dsk\u00fdm \u00fa\u0159adem <strong><\/strong> pozv\u00e1ni na m\u00edsto, aby stanovili a ozna\u010dili pr\u016fb\u011bh hranic.<\/p>\n\n<p>P\u0159i jedn\u00e1n\u00ed o hranic\u00edch je pr\u016fb\u011bh hranic stanoven a ozna\u010den dohodou z\u00fa\u010dastn\u011bn\u00fdch vlastn\u00edk\u016f po p\u0159edlo\u017een\u00ed st\u00e1vaj\u00edc\u00edch pom\u016fcek (jako je katastr dan\u011b z nemovitosti a pl\u00e1ny) zp\u016fsobem, kter\u00fd stanov\u00ed \u00a7 845 obecn\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku (ABGB).<\/p>\n\n<p>Pokud se vlastn\u00edci nemohou dohodnout na pr\u016fb\u011bhu hranic, je vlastn\u00edk, kter\u00fd tvrd\u00ed, \u017ee hranice neodpov\u00edd\u00e1 st\u00e1vaj\u00edc\u00edmu pr\u016fb\u011bhu hranic, vyzv\u00e1n zem\u011bm\u011b\u0159i\u010dsk\u00fdm \u00fa\u0159adem <strong><\/strong>, aby do \u0161esti t\u00fddn\u016f zah\u00e1jil soudn\u00ed \u0159\u00edzen\u00ed k vy\u0159e\u0161en\u00ed sporu o hranice.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-vermessung-und-eintragung-im-grenzkataster\">Zam\u011b\u0159en\u00ed a z\u00e1pis do katastru nemovitost\u00ed<\/h3>\n\n<p>Na \u017e\u00e1dost z\u00fa\u010dastn\u011bn\u00fdch vlastn\u00edk\u016f m\u016f\u017ee b\u00fdt po \u00fasp\u011b\u0161n\u00e9m ukon\u010den\u00ed jedn\u00e1n\u00ed o hranic\u00edch zem\u011bm\u011b\u0159i\u010dsk\u00fdm \u00fa\u0159adem <strong><\/strong> provedeno zam\u011b\u0159en\u00ed a z\u00e1pis pozemk\u016f do katastru nemovitost\u00ed.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-gerichtliche-erneuerung-oder-berichtigung-der-grenze\">Soudn\u00ed obnova nebo oprava hranice<\/h3>\n\n<p>Pokud se hrani\u010dn\u00ed znaky mezi dv\u011bma pozemky staly neznateln\u00fdmi nebo jsou hranice mezi sousedn\u00edmi vlastn\u00edky sporn\u00e9, m\u00e1 ka\u017ed\u00fd soused nav\u00edc pr\u00e1vo po\u017eadovat soudn\u00ed obnovu nebo opravu hranice podle \u00a7 850 ABGB.<\/p>\n\n<p>To je mo\u017en\u00e9 i bez p\u0159edchoz\u00edho proveden\u00ed jedn\u00e1n\u00ed o hranic\u00edch.<\/p>\n\n<p>Soud se nejprve pokus\u00ed zjistit posledn\u00ed neru\u0161en\u00fd stav dr\u017eby. Pokud se toto zji\u0161t\u011bn\u00ed poda\u0159\u00ed, pak bude hranice stanovena odpov\u00eddaj\u00edc\u00edm zp\u016fsobem.
