To znamen\u00e1: Dot\u010den\u00e1 nemovitost slou\u017e\u00ed jako zaji\u0161t\u011bn\u00ed pro otev\u0159enou platbu.  <\/p>\n\n<p class=\"wp-block-paragraph\">I kdy\u017e je u hypot\u00e9k existence pohled\u00e1vky a z\u00e1stavn\u00edho pr\u00e1va zaps\u00e1na v katastru nemovitost\u00ed, mus\u00ed v\u011b\u0159itel <strong>prok\u00e1zat, \u017ee je dluh skute\u010dn\u011b splatn\u00fd<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-forderung-ist-durch-eine-hypothek-im-grundbuch-gesichert\">Pohled\u00e1vka je zaji\u0161t\u011bna hypot\u00e9kou v katastru nemovitost\u00ed<\/h3>\n\n<p class=\"wp-block-paragraph\">Krom\u011b toho mus\u00ed b\u00fdt <strong>z\u00e1stavn\u00ed pr\u00e1vo zaps\u00e1no v katastru nemovitost\u00ed<\/strong>. Pouze tehdy m\u016f\u017ee v\u011b\u0159itel podat hypote\u010dn\u00ed \u017ealobu a v p\u0159\u00edpad\u011b \u00fasp\u011bchu dos\u00e1hnout <strong>nucen\u00e9 dra\u017eby nemovitosti<\/strong>. D\u016fle\u017eit\u00e9 je, \u017ee <strong>pohled\u00e1vka m\u016f\u017ee b\u00fdt jednozna\u010dn\u011b prok\u00e1z\u00e1na<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">Hypote\u010dn\u00ed \u017ealoba <strong>nen\u00ed nutn\u011b zam\u011b\u0159ena proti p\u016fvodn\u00edmu dlu\u017en\u00edkovi<\/strong>, ale proti aktu\u00e1ln\u00edmu vlastn\u00edkovi nemovitosti, a to i v p\u0159\u00edpad\u011b, \u017ee tento dluh nezp\u016fsobil.
