Aby bylo mo\u017en\u00e9 vymo\u017een\u00ed kladn\u00e9ho rozsudku proti \u017ealovan\u00e9mu, slou\u017e\u00ed exeku\u010dn\u00ed \u0159\u00edzen\u00ed k \u201enucen\u00e9mu\u201c vynucen\u00ed dodr\u017eov\u00e1n\u00ed rozsudku (\u201etitulu\u201c) (odtud tak\u00e9 \u201enucen\u00fd v\u00fdkon rozhodnut\u00ed\u201c).<\/p>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Bezplatn\u00e1 \u00favodn\u00ed konzultace\"><span class=\"mr-cta-link-normal\">Vyberte si po\u017eadovan\u00fd term\u00edn:<\/span><span class=\"mr-cta-link-bold\">Bezplatn\u00e1 \u00favodn\u00ed konzultace<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-exekutionstitel\">Exeku\u010dn\u00ed titul<\/h2>\n\n<p>Jako exeku\u010dn\u00ed tituly pro veden\u00ed exekuce mohou slou\u017eit <strong>soudn\u00ed rozsudky<\/strong>, <strong>rozhodnut\u00ed a usnesen\u00ed spr\u00e1vn\u00edch \u00fa\u0159ad\u016f a finan\u010dn\u00edch \u00fa\u0159ad\u016f<\/strong> (zpravidla stanoven\u00e1 povinnost platby z ob\u010danskopr\u00e1vn\u00edch rozhodnut\u00ed, ale mohou poch\u00e1zet i od spr\u00e1vn\u00edho \u00fa\u0159adu nebo trestn\u00edho soudu), jako\u017e i <strong>ur\u010dit\u00e9 not\u00e1\u0159sk\u00e9 z\u00e1pisy<\/strong> a jin\u00e9 <strong>tituly uveden\u00e9 v \u00a7 1 EO<\/strong>. <\/p>\n\n<p>Zahrani\u010dn\u00ed tituly mohou b\u00fdt postaveny na rove\u0148 rakousk\u00fdm, pokud byly vyd\u00e1ny v zahrani\u010d\u00ed a maj\u00ed b\u00fdt vykon\u00e1ny bez zvl\u00e1\u0161tn\u00edho prohl\u00e1\u0161en\u00ed vykonatelnosti na z\u00e1klad\u011b mezin\u00e1rodn\u00ed smlouvy nebo pr\u00e1vn\u00edho aktu Evropsk\u00e9 unie (podrobnosti viz <a href=\"https:\/\/harlander-partner.eu\/wp-admin\/post.php?post=22082&amp;action=edit\">Exekuce zahrani\u010dn\u00edch titul\u016f<\/a>).<\/p>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Bezplatn\u00e1 \u00favodn\u00ed konzultace\"><span class=\"mr-cta-link-normal\">Vyberte si po\u017eadovan\u00fd term\u00edn:<\/span><span class=\"mr-cta-link-bold\">Bezplatn\u00e1 \u00favodn\u00ed konzultace<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-exekutionsarten\">Druhy exekuc\u00ed<\/h2>\n\n<p>Exeku\u010dn\u00ed \u0159\u00e1d (EO) stanov\u00ed nejr\u016fzn\u011bj\u0161\u00ed druhy exekuc\u00ed k vymo\u017een\u00ed pohled\u00e1vky. N\u00ed\u017ee budou tyto stru\u010dn\u011b vysv\u011btleny:<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-fahrnisexekution-exekution-auf-das-bewegliche-vermogen\">Exekuce na movit\u00fd majetek<\/h3>\n\n<p>Tento druh exekuce zahrnuje exekuci na movit\u00e9 v\u011bci, kter\u00e1 slou\u017e\u00ed k vymo\u017een\u00ed otev\u0159en\u00fdch pen\u011b\u017en\u00edch pohled\u00e1vek. Nucen\u00fd v\u00fdkon rozhodnut\u00ed zde prov\u00e1d\u00ed soudn\u00ed exekutor prost\u0159ednictv\u00edm zabaven\u00ed a prodeje movit\u00fdch v\u011bc\u00ed.<\/p>\n\n<p>Z exekuce jsou vylou\u010deny ur\u010dit\u00e9 p\u0159edm\u011bty:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Potraviny<\/li>\n\n\n\n<li>Dom\u00e1c\u00ed zv\u00ed\u0159ata<\/li>\n\n\n\n<li>U\u010debn\u00ed pom\u016fcky<\/li>\n\n\n\n<li>Provozn\u00ed prost\u0159edky<\/li>\n\n\n\n<li>Osobn\u00ed v\u011bci<\/li>\n<\/ul>\n\n<p>V\u00fdjimku lze u\u010dinit, pokud hodnota v\u011bci, kter\u00e1 je v z\u00e1sad\u011b nezabaviteln\u00e1, p\u0159edstavuje ve srovn\u00e1n\u00ed s takovou v\u011bc\u00ed obecn\u011b vysokou hodnotu (nap\u0159. ko\u017ee\u0161inov\u00fd zimn\u00ed kab\u00e1t ve srovn\u00e1n\u00ed s b\u011b\u017en\u00fdm zimn\u00edm kab\u00e1tem). V takov\u00e9m p\u0159\u00edpad\u011b m\u016f\u017ee m\u00edt hodnotn\u00fd kus pom\u011brn\u011b vysokou prodejn\u00ed hodnotu ve srovn\u00e1n\u00ed s pot\u0159ebnou v\u011bc\u00ed (jako chr\u00e1n\u011bn\u00e1, nezabaviteln\u00e1 v\u011bc) a sm\u00ed b\u00fdt vym\u011bn\u011bn. Pokud soudn\u00ed exekutor nenajde \u017e\u00e1dn\u00e9 zabaviteln\u00e9 p\u0159edm\u011bty, je dlu\u017en\u00edk povinen odevzdat soupis majetku.<br\/>Mohou existovat zvl\u00e1\u0161tn\u00ed okolnosti t\u00fdkaj\u00edc\u00ed se pr\u00e1v k p\u0159edm\u011bt\u016fm:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Pokud jsou zabaveny p\u0159edm\u011bty, kter\u00e9 nepat\u0159\u00ed dlu\u017en\u00edkovi, mus\u00ed vlastn\u00edk proti zabaven\u00ed postupovat \u017ealobou.<\/li>\n\n\n\n<li>Pokud se v\u011bci dlu\u017en\u00edka nach\u00e1zej\u00ed u jin\u00e9 osoby, m\u016f\u017ee se soudn\u00ed exekutor t\u0159et\u00ed osoby zeptat, zda v\u011bc vyd\u00e1.<\/li>\n\n\n\n<li>Pokud to tato osoba pop\u0159e, mus\u00ed v\u011b\u0159itel s\u00e1m po\u017eadovat v\u011bc od t\u0159et\u00ed osoby (zabaven\u00ed n\u00e1roku na vyd\u00e1n\u00ed).<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-forderungsexekution-exekution-auf-das-bewegliche-vermogen\">Exekuce na pohled\u00e1vky (exekuce na movit\u00fd majetek)<\/h3>\n\n<p>U tohoto druhu exekuce je pohled\u00e1vka, kterou m\u00e1 povinn\u00fd v\u016f\u010di t\u0159et\u00ed osob\u011b, p\u0159evedena na v\u011b\u0159itele, a t\u00edm je uhrazena otev\u0159en\u00e1 pohled\u00e1vka.<\/p>\n\n<p>Nej\u010dast\u011bj\u0161\u00edm druhem exekuce pohled\u00e1vky je exekuce na mzdu. Exeku\u010dn\u00ed soud zde ulo\u017e\u00ed zam\u011bstnavateli z\u00e1kaz v\u00fdplaty. Zam\u011bstnavatel tedy nesm\u00ed vypl\u00e1cet p\u0159\u00edslu\u0161nou mzdu (s v\u00fdjimkou \u017eivotn\u00edho minima) zam\u011bstnanci, ale v\u00fdhradn\u011b v\u011b\u0159iteli. Exeku\u010dn\u00ed soud ulo\u017e\u00ed zam\u011bstnanci z\u00e1kaz dispozice. Zam\u011bstnanec tedy nesm\u00ed disponovat svou pohled\u00e1vkou na mzdu v\u016f\u010di zam\u011bstnavateli.<br\/>Pokud se zm\u011bn\u00ed majetkov\u00e9 pom\u011bry povinn\u00e9ho (zejm\u00e9na u pr\u016fb\u011b\u017en\u00fdch exekuc\u00ed, jako jsou mzdov\u00e9 pohled\u00e1vky), m\u016f\u017ee soud kdykoli upravit (nezabavitelnou \u010d\u00e1stku).<\/p>\n\n<p>Zpravidla se inkaso pohled\u00e1vky prov\u00e1d\u00ed prost\u0159ednictv\u00edm p\u0159evodu. Mo\u017en\u00e9 je ale i,<\/p>\n\n<ul class=\"wp-block-list\">\n<li>prodej<\/li>\n\n\n\n<li>ve\u0159ejn\u00e1 dra\u017eba<\/li>\n\n\n\n<li>nucen\u00e1 spr\u00e1va<\/li>\n<\/ul>\n\n<p>pohled\u00e1vky.<br\/>Z exekuce je vylou\u010deno:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Podpory (nap\u0159. od \u00fa\u0159adu pr\u00e1ce)<\/li>\n\n\n\n<li>P\u0159\u00edsp\u011bvek na p\u00e9\u010di<\/li>\n\n\n\n<li>P\u0159\u00edsp\u011bvky na n\u00e1jemn\u00e9<\/li>\n\n\n\n<li>Rodinn\u00e9 p\u0159\u00eddavky<\/li>\n\n\n\n<li>Pen\u00edze za rodi\u010dovskou dovolenou<\/li>\n\n\n\n<li>Stipendia<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-liegenschaftsexekution\">Exekuce na nemovitosti<\/h3>\n\n<p>V p\u0159\u00edpad\u011b exekuce na nemovitosti m\u00e1 v\u011b\u0159itel t\u0159i r\u016fzn\u00e9 mo\u017enosti, jak uspokojit svou pen\u011b\u017en\u00ed pohled\u00e1vku:<\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>Nucen\u00e9 z\u0159\u00edzen\u00ed z\u00e1stavn\u00edho pr\u00e1va<\/strong><\/li>\n<\/ol>\n\n<p>Zaji\u0161t\u011bn\u00ed pohled\u00e1vky se prov\u00e1d\u00ed z\u00e1pisem hypot\u00e9ky, z\u00e1stavn\u00edho pr\u00e1va nebo pr\u00e1va stavby pro v\u011b\u0159itele.<\/p>\n\n<p>Je t\u0159eba vz\u00edt v \u00favahu, \u017ee t\u00edmto nen\u00ed v\u011b\u0159iteli zaji\u0161t\u011bno \u017e\u00e1dn\u00e9 p\u0159\u00edm\u00e9 uspokojen\u00ed. Z\u00edsk\u00e1 v\u0161ak zaji\u0161\u0165ovac\u00ed pr\u00e1vo. V\u011b\u0159itel si m\u016f\u017ee zajistit nucenou spr\u00e1vu \u2013 nebo dra\u017ebu prost\u0159ednictv\u00edm nucen\u00e9ho zabaven\u00ed \u2013 a\u017e pozd\u011bji na z\u00e1klad\u011b n\u00e1vrhu u soudu. Pokud m\u011bl v\u011b\u0159itel ji\u017e d\u0159\u00edve (smluvn\u00ed) z\u00e1stavn\u00ed pr\u00e1vo, bude p\u0159\u00edmo zaps\u00e1na pozn\u00e1mka o v\u00fdkonu rozhodnut\u00ed. To pak znamen\u00e1, \u017ee:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Pokud dlu\u017en\u00edk nezaplat\u00ed, m\u016f\u017ee v\u011b\u0159itel p\u0159\u00edmo prov\u00e9st exekuci<\/li>\n\n\n\n<li>I v p\u0159\u00edpad\u011b jin\u00e9ho zat\u00ed\u017een\u00ed pozemku dlu\u017en\u00edkem nebo dokonce prodeje m\u00e1 v\u011b\u0159itel sv\u00e9 pr\u00e1vo zaji\u0161t\u011bno ve ve\u0159ejn\u00e9m rejst\u0159\u00edku<\/li>\n\n\n\n<li>Nov\u00fd vlastn\u00edk v\u00ed o mo\u017enosti nucen\u00e9 dra\u017eby nebo exekuce pozemku<\/li>\n\n\n\n<li>V\u011b\u0159itel m\u00e1 p\u0159ednost p\u0159ed ostatn\u00edmi v\u011b\u0159iteli, kte\u0159\u00ed n\u00e1sledn\u011b uplat\u0148uj\u00ed pohled\u00e1vky na pozemku<\/li>\n<\/ul>\n\n<p><strong>2. Nucen\u00e1 spr\u00e1va<\/strong><\/p>\n\n<p>Zaji\u0161t\u011bn\u00ed pohled\u00e1vky se prov\u00e1d\u00ed pr\u016fb\u011b\u017en\u00fdm u\u017e\u00edv\u00e1n\u00edm nemovitosti a ziskem z toho plynouc\u00edm, kter\u00fd se pou\u017e\u00edv\u00e1 k pokryt\u00ed pen\u011b\u017en\u00ed pohled\u00e1vky.<\/p>\n\n<p>Pro nucenou spr\u00e1vu ur\u010d\u00ed soud osobu. Nucen\u00fd spr\u00e1vce je odpov\u011bdn\u00fd za to, aby p\u0159\u00edjmy plynuly v\u011b\u0159iteli nam\u00edsto dlu\u017en\u00edka.<\/p>\n\n<p><strong>3. Nucen\u00e1 dra\u017eba<\/strong><\/p>\n\n<p>Zaji\u0161t\u011bn\u00ed pohled\u00e1vky se prov\u00e1d\u00ed dra\u017ebou nemovitosti. P\u0159i nucen\u00e9 dra\u017eb\u011b doch\u00e1z\u00ed k p\u0159\u00edm\u00e9mu uspokojen\u00ed zpen\u011b\u017een\u00edm nemovitosti, \u010d\u00edm\u017e v\u011b\u0159itel obdr\u017e\u00ed v\u00fdt\u011b\u017eek v pen\u011bz\u00edch.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-naturalexekution\">Natur\u00e1ln\u00ed exekuce<\/h3>\n\n<p>Pod natur\u00e1ln\u00ed exekuci spadaj\u00ed r\u016fzn\u00e9 druhy exekuc\u00ed, jako nap\u0159\u00edklad exekuce k dosa\u017een\u00ed jedn\u00e1n\u00ed (nap\u0159. exekuce vyklizen\u00edm), strpen\u00ed a zdr\u017een\u00ed se (nap\u0159. k prosazen\u00ed n\u00e1rok\u016f na vyd\u00e1n\u00ed nebo pln\u011bn\u00ed). P\u0159itom je dlu\u017en\u00e9 jedn\u00e1n\u00ed prosazov\u00e1no v\u00fdkonem p\u0159\u00edm\u00e9ho donucen\u00ed, u ur\u010dit\u00fdch natur\u00e1ln\u00edch exekuc\u00ed ulo\u017een\u00edm po\u0159\u00e1dkov\u00fdch pokut.<\/p>\n\n<p><strong>N\u00e1roky na vyd\u00e1n\u00ed<\/strong> se prosazuj\u00ed prost\u0159ednictv\u00edm soudn\u00edho exekutora. Pokud nelze zajistit vyd\u00e1vanou v\u011bc ani u povinn\u00e9ho, ani u t\u0159et\u00ed osoby, m\u016f\u017ee v\u011b\u0159itel podat \u017ealobu na n\u00e1hradu \u0161kody z d\u016fvodu nespln\u011bn\u00ed.<\/p>\n\n<p>Pokud m\u00e1 b\u00fdt objekt <strong>vyklizen<\/strong> (nap\u0159. \u010din\u017eovn\u00ed d\u016fm), plat\u00ed exeku\u010dn\u00ed titul proti v\u0161em, kte\u0159\u00ed odvozuj\u00ed pr\u00e1vo od povinn\u00e9ho (stejn\u011b jako rodinn\u00ed p\u0159\u00edslu\u0161n\u00edci). Pokud m\u00e1 jin\u00e1 osoba sv\u00e9 pr\u00e1vo nez\u00e1visle na povinn\u00e9m (nap\u0159. vlastn\u00ed n\u00e1jemn\u00ed smlouva), \u00fa\u010dinnost exeku\u010dn\u00edho titulu se na ni nevztahuje.<\/p>\n\n<p>Pokud je v\u011bc v <strong>spole\u010dn\u00e9m vlastnictv\u00ed<\/strong> s jin\u00fdmi osobami, m\u016f\u017ee doj\u00edt bu\u010f k rozd\u011blen\u00ed v\u011bci samotn\u00e9, nebo k vyplacen\u00ed p\u0159\u00edslu\u0161n\u00e9ho n\u00e1roku ostatn\u00edm (spolu)vlastn\u00edk\u016fm cestou zpen\u011b\u017een\u00ed.<\/p>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Bezplatn\u00e1 \u00favodn\u00ed konzultace\"><span class=\"mr-cta-link-normal\">Vyberte si po\u017eadovan\u00fd term\u00edn:<\/span><span class=\"mr-cta-link-bold\">Bezplatn\u00e1 \u00favodn\u00ed konzultace<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-zustandiges-gericht\">P\u0159\u00edslu\u0161n\u00fd soud <\/h2>\n\n<p>Zde se rozli\u0161uje mezi v\u011bcn\u011b a m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00fdm soudem.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-sachliche-zustandigkeit\">V\u011bcn\u00e1 p\u0159\u00edslu\u0161nost<\/h3>\n\n<p>V\u011bcn\u011b p\u0159\u00edslu\u0161n\u00e9 pro exeku\u010dn\u00ed \u0159\u00edzen\u00ed v prvn\u00edm stupni jsou v\u017edy obecn\u00e9 okresn\u00ed soudy. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ortliche-zustandigkeit\">M\u00edstn\u00ed p\u0159\u00edslu\u0161nost<\/h3>\n\n<p>M\u00edstn\u00ed p\u0159\u00edslu\u0161nost se v z\u00e1sad\u011b \u0159\u00edd\u00ed obecnou soudn\u00ed p\u0159\u00edslu\u0161nost\u00ed povinn\u00e9ho. U fyzick\u00fdch osob se proto vych\u00e1z\u00ed z obvykl\u00e9ho bydli\u0161t\u011b, u pr\u00e1vnick\u00fdch osob nap\u0159\u00edklad ze s\u00eddla spole\u010dnosti. V\u00fd\u0161e <strong>soudn\u00edch a exeku\u010dn\u00edch n\u00e1klad\u016f<\/strong> se \u0159\u00edd\u00ed z\u00e1konem o soudn\u00edch poplatc\u00edch (GGG) a z\u00e1konem o exeku\u010dn\u00edch poplatc\u00edch (VGebG). Jako <strong>z\u00e1klad pro v\u00fdpo\u010det<\/strong> se zpravidla pou\u017e\u00edv\u00e1 v\u00fd\u0161e vym\u00e1han\u00e9 (hlavn\u00ed) pohled\u00e1vky. <\/p>\n\n<p>P\u0159i p\u0159izn\u00e1n\u00ed n\u00e1klad\u016f se tyto n\u00e1klady na pr\u00e1vn\u00edho z\u00e1stupce a soudn\u00ed n\u00e1klady p\u0159i\u010d\u00edtaj\u00ed jako dal\u0161\u00ed (n\u00e1kladov\u00e1) pohled\u00e1vka k prob\u00edhaj\u00edc\u00edmu exeku\u010dn\u00edmu \u0159\u00edzen\u00ed a vym\u00e1haj\u00ed se soudn\u00edm exekutorem. <\/p>\n\n<p>Stru\u010dn\u011b \u0159e\u010deno: V\u011b\u0159itel sice mus\u00ed n\u00e1klady exeku\u010dn\u00edho \u0159\u00edzen\u00ed p\u0159edem uhradit. To by byla sp\u00ed\u0161e ot\u00e1zka opravn\u00fdch prost\u0159edk\u016f v soudn\u00edm \u0159\u00edzen\u00ed (tzv. nal\u00e9zac\u00ed \u0159\u00edzen\u00ed, ve srovn\u00e1n\u00ed s n\u00e1sledn\u00fdm exeku\u010dn\u00edm \u0159\u00edzen\u00edm). <br\/>Lze v\u0161ak postupovat proti \u0159\u00edzen\u00ed o exekuci jako takov\u00e9 (tedy proti zp\u016fsobu nebo rozd\u011blen\u00ed z v\u00fdkonu rozhodnut\u00ed).<\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>Odvol\u00e1n\u00ed<\/strong><\/li>\n<\/ol>\n\n<p>S pomoc\u00ed odvol\u00e1n\u00ed lze napadnout ur\u010dit\u00e9 opat\u0159en\u00ed v exeku\u010dn\u00edm \u0159\u00edzen\u00ed. Odvol\u00e1n\u00ed je opravn\u00fd prost\u0159edek k napaden\u00ed usnesen\u00ed soudu.<br\/>Zejm\u00e9na lze napadnout usnesen\u00ed o<\/p>\n\n<ul class=\"wp-block-list\">\n<li>exekuci, zastaven\u00ed, odkladu, pokra\u010dov\u00e1n\u00ed exekuc\u00ed,<\/li>\n\n\n\n<li>nemovitost\u00ed nebo<\/li>\n\n\n\n<li>povolen\u00ed a<\/li>\n\n\n\n<li>o pen\u011b\u017eit\u00fdch trestech, vazb\u011b a<\/li>\n\n\n\n<li>\u0159\u00edzen\u00ed o dispozic\u00edch<\/li>\n<\/ul>\n\n<p>prost\u0159ednictv\u00edm odvol\u00e1n\u00ed.<br\/>Odvol\u00e1n\u00ed je vylou\u010deno proti:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>N\u00e1klady<\/li>\n\n\n\n<li>Pomoc v \u0159\u00edzen\u00ed<\/li>\n\n\n\n<li>N\u00e1klad\u016fm na znalce<\/li>\n\n\n\n<li>Pokud je p\u0159edm\u011bt rozhodnut\u00ed ni\u017e\u0161\u00ed ne\u017e 5000 EUR<\/li>\n<\/ul>\n\n<p><strong>2. N\u00e1mitka<\/strong><\/p>\n\n<p>Pokud se postupuje proti rozsudku, v z\u00e1sad\u011b nesm\u011bj\u00ed b\u00fdt jako argumenty uv\u00e1d\u011bna \u017e\u00e1dn\u00e1 nov\u00e1 fakta. To vych\u00e1z\u00ed z rozli\u0161en\u00ed mezi soudn\u00edm \u0159\u00edzen\u00edm a opravn\u00fdmi prost\u0159edky. Pokud by bylo mo\u017en\u00e9 i zp\u011btn\u011b p\u0159edkl\u00e1dat dal\u0161\u00ed nov\u00e1 fakta, p\u016fsobil by opravn\u00fd prost\u0159edek jako druh\u00e9 soudn\u00ed \u0159\u00edzen\u00ed. Co je v odvolac\u00edm \u0159\u00edzen\u00ed je\u0161t\u011b zak\u00e1z\u00e1no, je v r\u00e1mci odporu povoleno. V\u00fdjime\u010dn\u011b mohou b\u00fdt p\u0159edlo\u017eena nov\u00e1 fakta.<\/p>\n\n<p>N\u00e1mitka slou\u017e\u00ed zejm\u00e9na k postupu proti rozd\u011blen\u00ed v\u00fdnos\u016f nebo nedostatku v nucen\u00e9 dra\u017eb\u011b.<\/p>\n\n<p>Prost\u0159ednictv\u00edm n\u00e1mitky m\u016f\u017ee tak\u00e9 v\u011b\u0159itel postupovat proti rozd\u011blen\u00ed \u010d\u00e1stek, v\u00fd\u0161i nebo po\u0159ad\u00ed p\u0159ihl\u00e1\u0161en\u00fdch pohled\u00e1vek.<\/p>\n\n<p><strong>3. P\u0159edlo\u017een\u00ed<\/strong><\/p>\n\n<p>Pokud bylo rozhodnut\u00ed o v\u00fdkonu rozhodnut\u00ed vyd\u00e1no vy\u0161\u0161\u00edm soudn\u00edm \u00fa\u0159edn\u00edkem (nam\u00edsto soudce) (zpravidla u \u010dist\u011b pen\u011b\u017en\u00edch pohled\u00e1vek), lze proti n\u011bmu postupovat pomoc\u00ed opravn\u00e9ho prost\u0159edku n\u00e1mitky. Stejn\u011b jako odvol\u00e1n\u00ed je i zde napad\u00e1no opat\u0159en\u00ed nucen\u00e9ho v\u00fdkonu rozhodnut\u00ed. Spornou v\u011bc nyn\u00ed p\u0159ezkoum\u00e1 soudce.<\/p>\n\n<p><strong>4. St\u00ed\u017enost<\/strong><\/p>\n\n<p>Pokud chcete nam\u00edtat zp\u016fsob proveden\u00ed exeku\u010dn\u00edho \u00fakonu jako \u00fa\u0159edn\u00ed \u00fakon, m\u016f\u017eete podat st\u00ed\u017enost u exeku\u010dn\u00edho soudu.<br\/>Rozli\u0161uje se st\u00ed\u017enost na:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>St\u00ed\u017enost na proveden\u00ed, kter\u00e1 m\u016f\u017ee b\u00fdt p\u0159ijata, pokud je proveden\u00ed v rozporu se z\u00e1konem nebo v rozporu s pokynem<\/li>\n\n\n\n<li>Dozor\u010d\u00ed st\u00ed\u017enost, pokud bylo proveden\u00ed zcela odep\u0159eno nebo se zpozdilo<\/li>\n<\/ul>\n\n<p><strong>5. N\u00e1mitka<\/strong><\/p>\n\n<p>N\u00e1mitku m\u016f\u017ee povinn\u00fd podat neform\u00e1ln\u011b, pokud:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Chyb\u00ed exeku\u010dn\u00ed titul v\u010detn\u011b potvrzen\u00ed vykonatelnosti<\/li>\n\n\n\n<li>\u00dadaje v exeku\u010dn\u00edm titulu se neshoduj\u00ed s \u00fadaji v n\u00e1vrhu<\/li>\n<\/ul>\n\n<p>Z toho vypl\u00fdv\u00e1, \u017ee v\u011b\u0159itel mus\u00ed ve lh\u016ft\u011b p\u011bti dn\u016f p\u0159edlo\u017eit zlep\u0161en\u00ed \u00fadaj\u016f, resp. titulu, aby mohl \u00fa\u010dinn\u011b v\u00e9st exekuci. V opa\u010dn\u00e9m p\u0159\u00edpad\u011b mus\u00ed b\u00fdt exeku\u010dn\u00ed \u0159\u00edzen\u00ed zastaveno (i ji\u017e proveden\u00e9 \u00fakony). V\u011b\u0159itel se dokonce m\u016f\u017ee st\u00e1t odpov\u011bdn\u00fdm za \u0161kodu, pokud povinn\u00e9mu vznikly majetkov\u00e9 \u00fajmy. <\/p>\n\n<p>6. <strong>Do\u010dasn\u00e9 p\u0159eru\u0161en\u00ed v\u00fdkonu rozhodnut\u00ed<\/strong><\/p>\n\n<p>V z\u00e1sad\u011b nelze dos\u00e1hnout p\u0159eru\u0161en\u00ed exeku\u010dn\u00edho \u0159\u00edzen\u00ed. Ani opravn\u00e9 prost\u0159edky (odvol\u00e1n\u00ed, st\u00ed\u017enost atd.) nezastav\u00ed \u0159\u00edzen\u00ed v jeho sou\u010dasn\u00e9m stavu.<br\/>Pokud je vysloven odklad, z\u016fst\u00e1vaj\u00ed v z\u00e1sad\u011b ji\u017e proveden\u00e9 \u00fakony v platnosti. V\u00fdjimka z t\u00e9to z\u00e1sady v\u0161ak nastane, pokud povinn\u00fd<\/p>\n\n<ul class=\"wp-block-list\">\n<li>z toho utrp\u011bl t\u011b\u017eko nahraditelnou \u00fajmu a<\/li>\n\n\n\n<li>m\u016f\u017ee poskytnout plnou jistotu pro uspokojen\u00ed n\u00e1roku (kter\u00fd m\u00e1 b\u00fdt vykon\u00e1n).<\/li>\n<\/ul>\n\n<p>Krom\u011b toho v\u0161ak mus\u00ed b\u00fdt spln\u011bny dal\u0161\u00ed p\u0159edpoklady, kter\u00e9 vypl\u00fdvaj\u00ed zejm\u00e9na z napaden\u00ed samotn\u00e9ho exeku\u010dn\u00edho titulu (\u00a7 42 EO). To znamen\u00e1, \u017ee se nepostupuje pouze proti postupu nucen\u00e9ho v\u00fdkonu rozhodnut\u00ed (\u00fakonu), ale i proti soudn\u00edmu rozsudku. Titul, kter\u00fd teprve oprav\u0148uje exeku\u010dn\u00ed org\u00e1ny k prov\u00e1d\u011bn\u00ed exeku\u010dn\u00edch \u00fakon\u016f, m\u00e1 b\u00fdt zru\u0161en. Krom\u011b toho nesm\u011bj\u00ed b\u00fdt ohro\u017eeny z\u00e1jmy v\u011b\u0159itele. To vypl\u00fdv\u00e1 z dal\u0161\u00edho p\u0159edpokladu, zv\u00e1\u017een\u00ed rozd\u011blen\u00ed z\u00e1jm\u016f a jistoty, \u017ee n\u00e1vrh povinn\u00e9ho nesm\u00ed b\u00fdt bezv\u00fdsledn\u00fd.<\/p>\n\n<p>Pokud mezit\u00edm ji\u017e do\u0161lo k uspokojen\u00ed v\u011b\u0159itele nebo byla dohodnuta odkladn\u00e1 lh\u016fta, mus\u00ed i exeku\u010dn\u00ed org\u00e1n upustit od exekuce (\u201ezadr\u017een\u00ed\u201c). Tot\u00e9\u017e plat\u00ed samoz\u0159ejm\u011b i pro opa\u010dn\u00fd p\u0159\u00edpad, a to insolvenci povinn\u00e9ho.<\/p>\n\n<p><strong>Ot\u00e1zky k \u017ealob\u011b na rozd\u011blen\u00ed<\/strong><\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>M\u016fj pozemek byl sv\u011b\u0159en nucen\u00e9mu spr\u00e1vci. Dostanu ho te\u010f u\u017e nikdy zp\u011bt?<\/strong><\/li>\n<\/ol>\n\n<p>Ano. Sv\u016fj pozemek dostanete zp\u011bt, pokud budou ve\u0161ker\u00e9 pohled\u00e1vky uhrazeny jin\u00fdm zp\u016fsobem nebo pokud bude vyd\u00e1no usnesen\u00ed soudu o zastaven\u00ed \u0159\u00edzen\u00ed (nap\u0159. pokud byl exeku\u010dn\u00ed titul prohl\u00e1\u0161en za neplatn\u00fd nebo jste uzav\u0159eli odli\u0161nou dohodu).<\/p>\n\n<p><strong>2. Bydl\u00edm na pozemku, kter\u00fd je nyn\u00ed v nucen\u00e9 spr\u00e1v\u011b. Mus\u00edm se s rodinou vyst\u011bhovat?<\/strong><\/p>\n\n<p>Ne. Po dobu trv\u00e1n\u00ed nucen\u00e9 spr\u00e1vy V\u00e1m a Va\u0161\u00ed rodin\u011b mus\u00ed b\u00fdt k dispozici odd\u011blen\u00e1 bytov\u00e1 jednotka na pozemku. Ta v\u0161ak zahrnuje pouze nepostradateln\u00e9 obytn\u00e9 prostory. Pokud jste vyu\u017e\u00edvali dal\u0161\u00ed prostory, mus\u00edte je po tuto dobu d\u00e1t k dispozici nucen\u00e9mu spr\u00e1vci.<\/p>\n\n<p><strong>3. M\u016fj pozemek m\u00e1 b\u00fdt vydra\u017een v nucen\u00e9 dra\u017eb\u011b. Mohu proti tomu je\u0161t\u011b n\u011bco ud\u011blat?<\/strong><\/p>\n\n<p>Pokud jsou n\u00e1roky v\u011b\u0159itele opr\u00e1vn\u011bn\u00e9, m\u00e1 v z\u00e1sad\u011b pr\u00e1vo zah\u00e1jit nucenou dra\u017ebu. A\u017e do zah\u00e1jen\u00ed dra\u017eby se v\u0161ak m\u016f\u017eete je\u0161t\u011b pokusit dos\u00e1hnout s n\u00edm dohody. Jin\u00e1 dohoda o platb\u011b m\u016f\u017ee zp\u016fsobit odklad dra\u017eebn\u00edho \u0159\u00edzen\u00ed.<br\/>Pokud soudu v\u010das p\u0159edlo\u017e\u00edte takovou dohodu s d\u016fkazem, bude tzv. n\u00e1vrh na odklad schv\u00e1len, ani\u017e by musely b\u00fdt spln\u011bny dal\u0161\u00ed p\u0159edpoklady.<br\/>\u0158\u00edzen\u00ed o nucen\u00e9 dra\u017eb\u011b m\u016f\u017ee b\u00fdt pot\u00e9 obnoveno nejd\u0159\u00edve po uplynut\u00ed t\u0159\u00ed m\u011bs\u00edc\u016f.
