V\u011b\u0159itel, kter\u00fd dra\u017ebu navrhl, \u017e\u00e1d\u00e1 o dra\u017ebu, aby z\u00edskal svou nesplacenou pen\u011b\u017eitou pohled\u00e1vku z v\u00fdt\u011b\u017eku z nemovit\u00e9ho majetku. Povinn\u00fd je vlastn\u00edkem nemovitosti, kter\u00e1 je dra\u017eena.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verfahrensschritte\">Kroky \u0159\u00edzen\u00ed<\/h2>\n\n<p>\u0158\u00edzen\u00ed o nucen\u00e9 dra\u017eb\u011b se \u0159\u00edd\u00ed jasn\u011b stanoven\u00fdm postupem, kter\u00fd krok za krokem vede od \u017e\u00e1dosti a\u017e po kone\u010dnou v\u00fdplatu v\u00fdt\u011b\u017eku z dra\u017eby. Pouze pokud ji\u017e na nemovitosti existuje z\u00e1stavn\u00ed pr\u00e1vo, lze od t\u00e9to p\u0159\u00edlohy upustit. <\/p>\n\n<p>K n\u00e1vrhu je t\u0159eba p\u0159ilo\u017eit tak\u00e9 seznam z\u00e1jemc\u016f, kter\u00fd obsahuje v\u0161echny osoby, kter\u00e9 maj\u00ed k nemovitosti v\u011bcn\u00e1 pr\u00e1va nebo zapsan\u00e1 p\u0159edkupn\u00ed \u010di zp\u011btn\u00e1 kupn\u00ed pr\u00e1va. P\u0159\u00edslu\u0161n\u00fd je okresn\u00ed soud, kter\u00fd vede katastr nemovitost\u00ed. <\/p>\n\n<p>Pokud je n\u00e1vrh povolen, soud na\u0159\u00edd\u00ed nucenou dra\u017ebu nemovitosti a poznamen\u00e1 zah\u00e1jen\u00ed \u0159\u00edzen\u00ed v katastru nemovitost\u00ed.<\/p>\n\n<p>Tato <strong>katastr\u00e1ln\u00ed pozn\u00e1mka<\/strong> m\u00e1 za n\u00e1sledek, \u017ee dra\u017ebu lze prosadit i v\u016f\u010di pozd\u011bj\u0161\u00edm vlastn\u00edk\u016fm nebo nabyvatel\u016fm pr\u00e1v k nemovitosti. Sou\u010dasn\u011b je v\u011b\u0159itel povinen ve lh\u016ft\u011b stanoven\u00e9 soudem slo\u017eit z\u00e1lohu na n\u00e1klady, kter\u00e1 se obvykle pou\u017e\u00edv\u00e1 na odhad nemovitosti. Pokud platba neprob\u011bhne, \u0159\u00edzen\u00ed se zastav\u00ed.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-schatzung\">Ocen\u011bn\u00ed<\/h2>\n\n<p>Pot\u00e9, co byla zaplacena z\u00e1loha na n\u00e1klady, provede ocen\u011bn\u00ed nemovitosti soudem jmenovan\u00fd znalec. Ocen\u011bn\u00ed se \u0159\u00edd\u00ed z\u00e1konem o oce\u0148ov\u00e1n\u00ed nemovitost\u00ed (LBG). Znalec mus\u00ed pou\u017e\u00edvat uzn\u00e1van\u00e9 metody oce\u0148ov\u00e1n\u00ed, kter\u00e9 odpov\u00eddaj\u00ed sou\u010dasn\u00e9mu stavu v\u011bdy. V praxi se pou\u017e\u00edvaj\u00ed p\u0159edev\u0161\u00edm n\u00e1sleduj\u00edc\u00ed metody:   <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Metoda srovn\u00e1vac\u00ed hodnoty:<\/strong> Hodnota se ur\u010duje na z\u00e1klad\u011b podobn\u00fdch, ned\u00e1vno prodan\u00fdch nemovitost\u00ed.<\/li>\n\n\n\n<li><strong>Metoda v\u00fdnosov\u00e9 hodnoty:<\/strong> Hodnota se vypo\u010d\u00edt\u00e1 z trvale dosa\u017eiteln\u00fdch p\u0159\u00edjm\u016f z n\u00e1jemn\u00e9ho.<\/li>\n\n\n\n<li><strong>Metoda v\u011bcn\u00e9 hodnoty:<\/strong> Zde je v pop\u0159ed\u00ed stavebn\u00ed substance. Z\u00fa\u010dastn\u011bn\u00ed maj\u00ed nicm\u00e9n\u011b mo\u017enost vzn\u00e9st proti posudku n\u00e1mitky. Pokud je n\u011bkdo toho n\u00e1zoru, \u017ee zji\u0161t\u011bn\u00e1 hodnota nen\u00ed spr\u00e1vn\u00e1 nebo byla chybn\u011b vypo\u010dtena, m\u016f\u017ee to soudu sd\u011blit.  <\/p>\n\n<p>Pokud n\u011bkdo vznese n\u00e1mitky, soud p\u0159\u00edpad znovu p\u0159ezkoum\u00e1. M\u016f\u017ee znalce pov\u011b\u0159it, aby posudek doplnil nebo vylep\u0161il. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-zuschlag\">P\u0159\u00edklep<\/h2>\n\n<p>Nucen\u00e1 dra\u017eba je ve\u0159ejn\u00e1 a obvykle se kon\u00e1 u soudu. Soudce vyzve k pod\u00e1v\u00e1n\u00ed nab\u00eddek. Pokud ji\u017e nen\u00ed pod\u00e1na \u017e\u00e1dn\u00e1 vy\u0161\u0161\u00ed nab\u00eddka, soudce dra\u017ebu uzav\u0159e a ud\u011bl\u00ed p\u0159\u00edklep z\u00e1jemci s nejvy\u0161\u0161\u00ed nab\u00eddkou. T\u00edm kon\u010d\u00ed nab\u00eddkov\u00e9 \u0159\u00edzen\u00ed a p\u0159\u00edklep tvo\u0159\u00ed z\u00e1klad pro nabyt\u00ed vlastnictv\u00ed. Kupuj\u00edc\u00ed se st\u00e1v\u00e1 vlastn\u00edkem dra\u017een\u00e9 nemovitosti v\u010detn\u011b p\u0159\u00edslu\u0161enstv\u00ed p\u0159\u00edmo p\u0159\u00edklepem.    <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-meistbotsverteilung\">Rozd\u011blen\u00ed nejvy\u0161\u0161\u00edho pod\u00e1n\u00ed<\/h2>\n\n<p>Pokud je nemovitost nebo p\u0159edm\u011bt prod\u00e1n v r\u00e1mci nucen\u00e9 dra\u017eby, jde vym\u00e1haj\u00edc\u00edmu v\u011b\u0159iteli v prvn\u00ed \u0159ad\u011b o to, aby byla jeho otev\u0159en\u00e1 pohled\u00e1vka zaplacena. V\u00fdt\u011b\u017eek z prodeje je takzvan\u00e9 nejvy\u0161\u0161\u00ed pod\u00e1n\u00ed. Pokud jej kupuj\u00edc\u00ed zaplat\u00ed, soud rozd\u011bl\u00ed v\u00fdt\u011b\u017eek mezi opr\u00e1vn\u011bn\u00e9.  <\/p>\n\n<p>Jakmile kupuj\u00edc\u00ed uhrad\u00ed celou kupn\u00ed cenu, na\u0159\u00edd\u00ed soud z \u00fa\u0159edn\u00ed povinnosti jedn\u00e1n\u00ed o rozd\u011blen\u00ed tohoto nejvy\u0161\u0161\u00edho pod\u00e1n\u00ed. Toto takzvan\u00e9 jedn\u00e1n\u00ed o rozd\u011blen\u00ed nejvy\u0161\u0161\u00edho pod\u00e1n\u00ed slou\u017e\u00ed k ur\u010den\u00ed, kdo obdr\u017e\u00ed jak\u00fd pod\u00edl z v\u00fdt\u011b\u017eku. <\/p>\n\n<p>K tomuto jedn\u00e1n\u00ed jsou mimo jin\u00e9 zv\u00e1ni:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>povinn\u00e1 strana<\/li>\n\n\n\n<li>vym\u00e1haj\u00edc\u00ed strana<\/li>\n\n\n\n<li>v\u0161echny osoby, kter\u00e9 maj\u00ed podle listin pr\u00e1va nebo zat\u00ed\u017een\u00ed na dra\u017een\u00e9 nemovitosti<\/li>\n\n\n\n<li>kupuj\u00edc\u00ed se m\u016f\u017ee z\u00fa\u010dastnit dobrovoln\u011b<\/li>\n<\/ul>\n\n<p>Soud jedn\u00e1n\u00ed o rozd\u011blen\u00ed nejvy\u0161\u0161\u00ed nab\u00eddky tak\u00e9 ve\u0159ejn\u011b ozn\u00e1m\u00ed. Pokud je dosa\u017een\u00e1 kupn\u00ed cena ni\u017e\u0161\u00ed ne\u017e t\u0159i \u010dtvrtiny odhadn\u00ed ceny nemovitosti, existuje dal\u0161\u00ed mo\u017enost: takzvan\u00e9 p\u0159ekro\u010den\u00ed nab\u00eddky. T\u00edm se m\u00e1 zajistit, aby nemovitost nebyla prod\u00e1na p\u0159\u00edli\u0161 levn\u011b a v\u011b\u0159itel\u00e9 obdr\u017eeli co nejvy\u0161\u0161\u00ed v\u00fdt\u011b\u017eek.  <\/p>\n\n<p>P\u0159ekro\u010den\u00ed nab\u00eddky je nov\u00e1 nab\u00eddka, kterou m\u016f\u017ee n\u011bkdo podat u exeku\u010dn\u00edho soudu do 14 dn\u016f po ve\u0159ejn\u00e9m ozn\u00e1men\u00ed p\u0159\u00edklepu. Aby bylo p\u0159ekro\u010den\u00ed nab\u00eddky platn\u00e9, mus\u00ed b\u00fdt nab\u00edzen\u00e1 cena <strong>alespo\u0148 o \u010dtvrtinu vy\u0161\u0161\u00ed<\/strong> ne\u017e p\u016fvodn\u00ed nejvy\u0161\u0161\u00ed pod\u00e1n\u00ed. Krom\u011b toho mus\u00ed z\u00e1jemce o <g id=\"gid_1\">p\u0159ekro\u010den\u00ed nab\u00eddky slo\u017eit u soudu jako jistotu \u010dtvrtinu nab\u00edzen\u00e9 kupn\u00ed ceny<\/g>. Teprve pot\u00e9 se p\u0159ekro\u010den\u00ed nab\u00eddky stane \u00fa\u010dinn\u00fdm.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-eingang-mehrere-uberbote\">Obdr\u017een\u00ed n\u011bkolika nab\u00eddek<\/h3>\n\n<p>Pokud existuje n\u011bkolik nab\u00eddek, rozhoduje <strong>v\u00fd\u0161e nab\u00eddky<\/strong>. Kdo nab\u00eddne nejvy\u0161\u0161\u00ed cenu, bude p\u0159ijat. Pokud dv\u011b osoby nab\u00eddnou stejnou \u010d\u00e1stku, rozhoduje, kdo podal nab\u00eddku d\u0159\u00edve.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wirkung-des-uberbots\">\u00da\u010dinek p\u0159ekro\u010den\u00ed nab\u00eddky<\/h3>\n\n<p>Pokud soud p\u0159ekro\u010den\u00ed nab\u00eddky p\u0159ijme a usnesen\u00ed nabude pr\u00e1vn\u00ed moci, ztr\u00e1c\u00ed p\u016fvodn\u00ed dra\u017eba platnost. Soud zru\u0161\u00ed prvn\u00ed p\u0159\u00edklep a ud\u011bl\u00ed p\u0159\u00edklep nov\u00e9mu z\u00e1jemci.
