Vedle nucen\u00e9ho z\u0159\u00edzen\u00ed z\u00e1stavn\u00edho pr\u00e1va a dra\u017eby umo\u017e\u0148uje v\u011b\u0159iteli, kter\u00fd vede exekuci, uspokojit svou pohled\u00e1vku nikoli prodejem nemovitosti, n\u00fdbr\u017e z jej\u00edch u\u017eitk\u016f a p\u0159\u00edjm\u016f.  <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p>Podle <strong><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001700&amp;Artikel=&amp;Paragraf=97&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 97 EO<\/a><\/strong> lze ve prosp\u011bch vykonateln\u00e9 pen\u011b\u017eit\u00e9 pohled\u00e1vky povolit nucenou spr\u00e1vu nemovitosti, stavby na ciz\u00edm pozemku nebo pr\u00e1va stavby. P\u0159itom se vyu\u017e\u00edvaj\u00ed u\u017eitky a p\u0159\u00edjmy z objektu. Zat\u00edmco v\u011b\u0159itel, kter\u00fd vede exekuci, po\u017eaduje zah\u00e1jen\u00ed a proveden\u00ed nucen\u00e9 spr\u00e1vy, povinn\u00fd podl\u00e9h\u00e1 z\u00e1konn\u00fdm omezen\u00edm, kter\u00e1 jsou spojena s na\u0159\u00edzenou spr\u00e1vou jeho nemovitosti. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ablauf-des-zwangsverwaltungsverfahrens\">Pr\u016fb\u011bh \u0159\u00edzen\u00ed o nucen\u00e9 spr\u00e1v\u011b<\/h2>\n\n<p>V z\u00e1sad\u011b se \u0159\u00edzen\u00ed o nucen\u00e9 spr\u00e1v\u011b skl\u00e1d\u00e1 ze t\u0159\u00ed f\u00e1z\u00ed:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Zahajovac\u00ed \u0159\u00edzen\u00ed<\/li>\n\n\n\n<li>Spr\u00e1vn\u00ed \u0159\u00edzen\u00ed<\/li>\n\n\n\n<li>Rozd\u011blovac\u00ed \u0159\u00edzen\u00ed<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-einleitungsverfahren\">Zahajovac\u00ed \u0159\u00edzen\u00ed<\/h3>\n\n<p>\u0158\u00edzen\u00ed o nucen\u00e9 spr\u00e1v\u011b za\u010d\u00edn\u00e1, jako ka\u017ed\u00e9 exeku\u010dn\u00ed \u0159\u00edzen\u00ed, <strong>exeku\u010dn\u00edm n\u00e1vrhem<\/strong>. V\u011b\u0159itel t\u00edm u soudu \u017e\u00e1d\u00e1 o proveden\u00ed nucen\u00e9 spr\u00e1vy nad ur\u010ditou nemovitost\u00ed nebo jin\u00fdm exekuovateln\u00fdm objektem. <\/p>\n\n<p>Pokud soud povol\u00ed nucenou spr\u00e1vu, bude to <strong>zaps\u00e1no do katastru nemovitost\u00ed<\/strong>. Tento z\u00e1pis zaji\u0161\u0165uje, \u017ee nucen\u00e1 spr\u00e1va p\u016fsob\u00ed i v\u016f\u010di pozd\u011bj\u0161\u00edm nabyvatel\u016fm nemovitosti. <\/p>\n\n<p>Usnesen\u00ed o povolen\u00ed se doru\u010duje jak v\u011b\u0159iteli, tak povinn\u00e9mu. Od tohoto okam\u017eiku jsou dispozice povinn\u00e9ho s nemovitost\u00ed, kter\u00e9 p\u0159esahuj\u00ed r\u00e1mec \u0159\u00e1dn\u00e9 spr\u00e1vy, v\u016f\u010di v\u011b\u0159itel\u016fm <strong>ne\u00fa\u010dinn\u00e9<\/strong>. <\/p>\n\n<p>Sou\u010dasn\u011b je v\u011b\u0159iteli, kter\u00fd vede exekuci, ulo\u017eeno, aby ve lh\u016ft\u011b nejm\u00e9n\u011b \u010dty\u0159 t\u00fddn\u016f slo\u017eil <strong>z\u00e1lohu na n\u00e1klady<\/strong>. Ta slou\u017e\u00ed k zaji\u0161t\u011bn\u00ed minim\u00e1ln\u00ed odm\u011bny pozd\u011bji ustanoven\u00e9ho nucen\u00e9ho spr\u00e1vce. <\/p>\n\n<p>Jakmile je z\u00e1loha na n\u00e1klady uhrazena, soud ustanov\u00ed <strong>spr\u00e1vce<\/strong>. Krom\u011b toho je povinn\u00fd vyrozum\u011bn, \u017ee s\u00e1m ji\u017e nesm\u00ed prov\u00e1d\u011bt \u017e\u00e1dn\u00e9 spr\u00e1vn\u00ed \u00fakony a nem\u016f\u017ee zasahovat do \u00fakol\u016f spr\u00e1vce. <\/p>\n\n<p>Usnesen\u00ed o ustanoven\u00ed se doru\u010duje n\u011bkolika m\u00edst\u016fm, v\u010detn\u011b v\u011b\u0159itele, povinn\u00e9ho, spr\u00e1vce a \u00fa\u0159ad\u016f, kter\u00e9 jsou p\u0159\u00edslu\u0161n\u00e9 pro dan\u011b a poplatky z nemovitosti. Ten p\u0159eb\u00edr\u00e1 b\u011b\u017en\u00e9 veden\u00ed, vyb\u00edr\u00e1 v\u00fdnosy a zaji\u0161\u0165uje, aby ve\u0161ker\u00e9 spr\u00e1vn\u00ed kroky prob\u00edhaly v souladu s ustanoven\u00edmi exeku\u010dn\u00edho \u0159\u00e1du. <\/p>\n\n<p>Povolen\u00ed nucen\u00e9 spr\u00e1vy na <strong>st\u00e1vaj\u00edc\u00edch n\u00e1jemn\u00edch smlouv\u00e1ch<\/strong> zpo\u010d\u00e1tku nic nem\u011bn\u00ed. Spr\u00e1vce m\u00e1 v\u0161ak ur\u010dit\u00e9 pravomoci: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>M\u016f\u017ee vypov\u011bd\u011bt st\u00e1vaj\u00edc\u00ed smlouvy podle obecn\u00fdch z\u00e1konn\u00fdch pravidel.<\/li>\n\n\n\n<li>Podat \u017ealobu na vyklizen\u00ed.<\/li>\n\n\n\n<li>Uzav\u00edrat nov\u00e9 n\u00e1jemn\u00ed smlouvy na dobu obvyklou v dan\u00e9m m\u00edst\u011b.<\/li>\n<\/ul>\n\n<p>Pro rozhodnut\u00ed, kter\u00e1 <strong>nespadaj\u00ed do \u0159\u00e1dn\u00e9 spr\u00e1vy<\/strong>, pot\u0159ebuje spr\u00e1vce souhlas exeku\u010dn\u00edho soudu. K nim pat\u0159\u00ed zejm\u00e9na:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Uzav\u0159en\u00ed dlouhodob\u00fdch n\u00e1jemn\u00edch smluv, kter\u00e9 p\u0159esahuj\u00ed p\u0159edpokl\u00e1danou dobu trv\u00e1n\u00ed nucen\u00e9 spr\u00e1vy.<\/li>\n\n\n\n<li>Pron\u00e1jem cel\u00e9 nemovitosti nebo jej\u00edch jednotliv\u00fdch \u010d\u00e1st\u00ed.<\/li>\n\n\n\n<li>Pron\u00e1jem v\u00fdnos\u016f z nemovitosti prost\u0159ednictv\u00edm ve\u0159ejn\u00e9 dra\u017eby.<\/li>\n<\/ul>\n\n<p>\u010cinnost spr\u00e1vce je kontrolov\u00e1na exeku\u010dn\u00edm soudem. Soud mu m\u016f\u017ee ud\u011blovat pokyny, vy\u017eadovat zpr\u00e1vy a vysv\u011btlen\u00ed, kontrolovat podklady a s\u00e1m prov\u00e1d\u011bt pot\u0159ebn\u00e1 zji\u0161t\u011bn\u00ed. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verteilungsverfahren\">Rozd\u011blovac\u00ed \u0159\u00edzen\u00ed<\/h3>\n\n<p>V rozd\u011blovac\u00edm \u0159\u00edzen\u00ed se rozd\u011bluj\u00ed <strong>v\u00fdnosy z nemovitosti<\/strong> dosa\u017een\u00e9 b\u011bhem nucen\u00e9 spr\u00e1vy. Tyto v\u00fdnosy slou\u017e\u00ed nejprve k pokryt\u00ed n\u00e1klad\u016f spr\u00e1vy a n\u00e1sledn\u011b k uspokojen\u00ed v\u011b\u0159itele, kter\u00fd vede exekuci, a dal\u0161\u00edch opr\u00e1vn\u011bn\u00fdch osob. <\/p>\n\n<p>N\u00e1klady, kter\u00e9 jsou spojeny se spr\u00e1vou a obvykl\u00fdm hospod\u00e1\u0159sk\u00fdm vyu\u017eit\u00edm nemovitosti, sm\u00ed spr\u00e1vce hradit p\u0159\u00edmo z v\u00fdnos\u016f. K nim pat\u0159\u00ed nap\u0159\u00edklad provozn\u00ed n\u00e1klady nebo nezbytn\u00e9 v\u00fddaje na b\u011b\u017en\u00e9 hospoda\u0159en\u00ed. Tyto v\u00fddaje jsou tedy hrazeny <strong>bez dal\u0161\u00edho \u0159\u00edzen\u00ed<\/strong>.  <\/p>\n\n<p>Teprve <strong>p\u0159ebytky v\u00fdnos\u016f<\/strong> zb\u00fdvaj\u00edc\u00ed po ode\u010dten\u00ed t\u011bchto spr\u00e1vn\u00edch v\u00fddaj\u016f se rozd\u011bluj\u00ed.
