Time mo\u017eete sudskim putem posti\u0107i trenutnu obustavu gradnje i zaustaviti dalje gra\u0111evinske radove. Zakon je izri\u010dito predvi\u0111a u <g id=\"gid_1\">\u00a7 340 ABGB<\/g>. Prednost: Sud odlu\u010duje u ubrzanom postupku brzo o mjeri obustave gradnje i mo\u017ee odmah intervenisati ako je va\u0161 posjed ugro\u017een.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001622&amp;Artikel=&amp;Paragraf=340&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 340 ABGB<\/a><\/strong> daje samo pravo na zabranu (daljnje) gradnje, ali ne i na vra\u0107anje u prethodno stanje.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-voraussetzungen-fur-die-bauverbotsklage\">Uslovi za tu\u017ebu za zabranu gradnje<\/h2>\n\n<p class=\"wp-block-paragraph\">Mo\u017eete sudski zahtijevati zaustavljanje nove gradnje ako ona uti\u010de na va\u0161u parcelu. Uslov je da raspola\u017eete predmetnom parcelom i da je taj posjed akutno ugro\u017een gradnjom drugog lica. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-besitz-oder-dingliches-recht\">Posjed ili stvarno pravo<\/h3>\n\n<p class=\"wp-block-paragraph\">Tu\u017eba u principu pripada onome ko je posjednik nepokretne stvari ili nosilac stvarnog prava.<\/p>\n\n<p class=\"wp-block-paragraph\">Zakon posebno \u0161titi:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>posjed na <strong>nepokretnoj stvari<\/strong><\/li>\n\n\n\n<li><strong>stvarna prava<\/strong> poput slu\u017enosti<\/li>\n\n\n\n<li>i njihovu za\u0161titu ve\u0107 <strong>kod puke ugro\u017eenosti<\/strong>, ne tek kod nastupjelog smetanja<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-blosse-gefahrdung\">Puka ugro\u017eenost <\/h3>\n\n<p class=\"wp-block-paragraph\">Opasnost mora nastati zbog <strong>ve\u0107 zapo\u010dete, a ne tek planirane gradnje<\/strong> i sastojati se u mogu\u0107em <strong>smetanju posjeda<\/strong>. Mora proizlaziti iz same izgradnje ili postojanja gra\u0111evine, a ne samo iz pripadaju\u0107ih radova ili se o\u010dekivati iz njenog kori\u0161tenja. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-keine-wirksame-behordliche-baugenehmigung\">Bez va\u017ee\u0107e gra\u0111evinske dozvole<\/h3>\n\n<p class=\"wp-block-paragraph\">Ako <strong>ne postoji va\u017ee\u0107a gra\u0111evinska dozvola<\/strong> ili niste bili <strong>uredno pozvani<\/strong> u postupku, imate pravo podnijeti tu\u017ebu za zabranu gradnje sudu.<\/p>\n\n<p class=\"wp-block-paragraph\">Ako je gra\u0111evinski projekat slu\u017ebeno odobren i vi <strong>niste ulo\u017eili prigovore<\/strong> u postupku odobravanja, u pravilu gubite pravo na tu\u017ebu za zabranu gradnje. <\/p>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Besplatan prvi razgovor\"><span class=\"mr-cta-link-normal\">Odaberite \u017eeljeni termin sada:<\/span><span class=\"mr-cta-link-bold\">Besplatan prvi razgovor<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-ziel-und-wirkung-der-klage\">Cilj i u\u010dinak tu\u017ebe<\/h2>\n\n<p class=\"wp-block-paragraph\">Tu\u017ebom za zabranu gradnje pred sudom zahtijevate da se gradnja <strong>ne nastavi ili uop\u0107e ne zapo\u010dne<\/strong>. Postupak je osmi\u0161ljen da brzo pru\u017ei jasno\u0107u. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Obustava gradnje se mo\u017ee posti\u0107i ve\u0107 u hitnom postupku<\/strong>, dakle prije kona\u010dne odluke, kroz <strong>privremenu zabranu gradnje<\/strong>. U praksi se to redovno de\u0161ava u kratkom roku. <\/p>\n\n<p class=\"wp-block-paragraph\">Uklanjanje ve\u0107 izgra\u0111enih dijelova <strong>nije predmet ove tu\u017ebe<\/strong>, za to bi, u slu\u010daju nastalog smetanja, do\u0161la u obzir tu\u017eba zbog smetanja posjeda.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verhaltnis-zur-besitzstorungsklage\">Odnos prema tu\u017ebi zbog smetanja posjeda<\/h2>\n\n<p class=\"wp-block-paragraph\">Ako ve\u0107 do\u0111e do konkretnog smetanja posjeda (npr. pristup, o\u0161te\u0107enje, neprihvatljivo kori\u0161tenje), mo\u017eete dodatno ili umjesto toga podnijeti tu\u017ebu zbog smetanja posjeda. U mnogim slu\u010dajevima oba zahtjeva postoje paralelno. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verfahrensablauf-der-bauverbotsklage\">Tok postupka tu\u017ebe za zabranu gradnje<\/h2>\n\n<p class=\"wp-block-paragraph\">Tu\u017ebu za zabranu gradnje vodite u ubrzanom postupku direktno pred nadle\u017enim sudom.<\/p>\n\n<p class=\"wp-block-paragraph\">Podnosite tu\u017ebeni zahtjev i obrazla\u017eete za\u0161to je va\u0161 posjed akutno ugro\u017een. Budu\u0107i da se radi o hitnom slu\u010daju, va\u017ee posebno kratki rokovi.  <\/p>\n\n<p class=\"wp-block-paragraph\">\u010cesto sud donosi odluku bez usmene rasprave i izdaje rje\u0161enje. Ako se tu\u017ebi udovolji, sud izdaje rje\u0161enje o obustavi gradnje. Ono obavezuje investitora i ostaje na snazi dok se o tu\u017ebi kona\u010dno ne odlu\u010di.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Va\u017eno:<\/strong> Za\u0161tita posjeda mo\u017ee djelovati \u010dak i protiv ve\u0107 odobrenih gra\u0111evinskih mjera, ako postoji akutna potreba za djelovanjem.
